Custom Foster Saddles

Business was paid $2470 on 11/4/19 for custom saddle. Saddle has not been delivered. business unwilling to refund money.
I reached out to Chali, owner of said business, on 9/1/19 while she was in Hattiesburg, MS offering people to try the fit of her saddles. October 29, 2019 I reached out to her through Messenger and Instagram to place order and send payment. She wanted payment thru Facebook Messenger Chali ***. I was unable to do so despite multiple attempts. I sent her message of messenger for a 13.5" Foster saddle all rough out with white buckstitching and custom conchos. I sent a personal check *** dated 10/30/19 to Chali *** for $2470.00 to cover the saddle and cost of shipping. It was sent via mail to *** County Rd *** Kaufman, TX XXXXX. The check cleared Regions bank and out of my banking account on 11/4/19. I reached out to her on 11/5/19 asking for invoice however her response was she would send it with the shipment of said saddle. I reached out again on FB Messenger 11/21/19 asking when it would be delivered- her response 6/8 weeks. I responded again on 12/20/19 inquiring about shipment- her response was 8/10 weeks due to Christmas and holidays that she had not accounted for originally. I reached out again inquiring on saddle's progress on 1/16/20 with a response of "we are taking our time to make sure quality is top." I responded again on 2/1/20 for an update. She then informs me that she is in a financial bind and that it would be another month ultimately. I responded again on 3/2/20 and 3/3/20 inquiring again and that can I just get a refund at this time since it had been 4 months; her response I don't have the saddle or money to send. She asked if she could send the refund in monthly installments. I do not feel this appropriate business etiquette and I as a consumer was not given an option like that when making the purchase. I did respond that I would seek legal counsel, however I felt this was a better resolution if it can be handled this way.

I ordered a custom saddle through *** who had started her own saddle making business. She allowed two payments to be made. I paid $1,700 on October 27th and paid $1,000 on January 23rd. It has been four months and I still had not received my saddle. When I asked her a few weeks ago she said they were behind on business. I asked her again today when she informed me she was unable to complete my saddle and does not have the money to pay me back. If I didn't reach out to her again today I strongly believe she would have left me in limbo. She says she will try to make 9 payments over the next 9 months but this is unacceptable. I had to pay her in two payments and I dont trust that she will pay me back nor do I think waiting for 9 months is acceptable. She has several other people she did this too as well and she is refusing to tell me what she did with my money.
