Review: In July of 2013 I hired a contractor, [redacted], to build a 30 x 40 pole barn on my property. the contracts were signed, and permits pulled by the company. as requested we paid him 90% of the contract in two installments. he received $27,600.00. He stopped construction on 11-26-2013 after receiving the second installment. He has only put up the structure of the barn and the roof, he was to pour concrete flooring and put up the siding to finish the project. We have contacted him numerous times by phone and email, and finally on March 10 of 2014 we sent him a certified return receipt letter asking him to please finish the barn. We asked him to respond in writing within 7 days as to why he has quit working on our barn. We gave him the option of refunding our money for the concrete and siding and we would hire someone else to finish the barn, or to finish the barn himself, we just asked that he respond within the 7 days. After 8 days we did not hear from him and we asked our attorney to help us. He sent him a cease and desist letter and to know longer contact us. We received an email from [redacted] two days after receiving the letter from the company and the email was more excuses and more delays but no actual promise of doing anything. So upon advice of our attorney we did not reply to the email. We have hired another contractor to finish the pole barn for us at our expense. the first check we gave him was for $13,800.00 on July 25, 2013. this was considered a deposit. the second installment was for $12,046.76 and was issued on November 26, 2013. We were told that the pole barn would be started as soon as he could get a permit. We have since found out that the permit was not even applied for until October of 2013. We have the documents to prove all the information. We called several times pleading with him to finish the project, we sent emails asking for updates and information and asking for a date for completion. We were living out of the state, and was unaware that he had not even started yet. We moved here in December of 2013 and because of his delays our driveway was unable to be finished so all winter we have had a 100 foot muddy mess. Our home contractor could not finish our driveway because it needed to be tied into the pole barn.Desired Settlement: We ask that [redacted] refund our money for the concrete and siding on the pole barn. We ask that it be paid in cash. The framing was done and the amount of that was $12,046.76., this includes the engineered plans and [redacted] County Permit. Since that is all that was completed by [redacted] and Custom Sheds, we ask that the other money we paid to the company be refunded either in a cashiers check or cash, in the amount of $13,800.00. the remaining balance of 10% will of course no longer be owed to Custom Sheds, and we will no longer be responsible for the final payment of 10% original contract.($1,753.24)

Response:

First miss statement and direction is to address any of thes matters to me, [redacted]. I did NOT own the company Custom Sheds that the contract and agreement with [redacted] was made. My position with Custom Sheds was as a design consultant and marketing. The owner of Custom Sheds was [redacted] who had some personal issues and had to closs the business.

For your general information, I do know the only things left to do on [redacted] building was to finish the metal siding and pour the concrete floor. Custom Sheds costs to finish the work would have been approx. $3,500 for the metal and application, Plus approx. $4,000 to finish the concrete work. That would be a total of $7,500. Since [redacted] still owed a balance of $2,760 (10% of the total agreement) when completed the net cost to Custom Sheds would have been approx. $4,740.

Even though I did not own Custom Sheds I personally felt so bad that Custom Sheds went out of business, that through my attorney I offered to personally furnish and install the remaining metal siding, plus make up the differance between the $2,760 [redacted] still owed and the actual cost to pour the concrete floor (approx. $1,240). However there was No Response to my attorney.

[redacted]'s building did need a small amount of final finish work done before Custom Shed went out of business, however the contract was between [redacted] and Custom Sheds, NOT Me.... Get my name off this dispute. My only guilt is in offering to help which was turned down by not responding to my attorney. [redacted]
