BEWARE OF CUSTOM WINDOWS & EXTERIOR DESIGN OF LEESBURG! They did a good job on our lanai windows; HOWEVER, they put a lien on our house! We paid half the charges up front with the balance paid on the day of installation/completion. We were very happy--until we went to pay off our mortgage and discovered the lien. We were irate! (It would probably have been better if we had owed something to them because we could have paid the lien along with the house payoff, but not owing anything caused us a LOT of problems.) I called the manager and was told it would come off after a year. WHAT?! Why did they put the lien on the property in the first place? There was nothing owed to them. They told us that according to Florida Law, they are "required" to put a lien on any job they do that exceeds $2,500. No one else we've asked has ever heard of such a "law." We've spent over a month trying to resolve the issue and FINALLY have the release in hand and an appointment with the bank to pay the balance of our mortgage. All I can say is if you decide to use them, be aware of this "issue" because they certainly don't advise you up front. We will never use them again; however, we did learn a lesson. Now, any work we contract to have done we always ask if a lien will be involved. 100% of the time, the contractor has been surprised and assured us they don't do business like that. Still seething about the experience...
We here at Custom Window & Exterior Design Inc. apologize for any inconvenience which occurred from this misunderstanding. As per Florida regulations, to receive a construction permit where the cost exceeds $2300.00, a notice of commencement is required. A permit can not be executed without this recorded document. In all cases a notice of commencement form is singed by the homeowner. For further details about our Florida construction requirements, please call your local permitting department regarding filling procedures.
This state required lien automatically drops off after 1 year. Occasionally we do receive requests for early termination of a homeowners lien. If this occurs, as it did in this situation, we process all necessary documents in a expedited manner.
We resolved this matter by working with Mr. W and his financial institution to the best of our ability. Unfortunately it appears the homeowner was unaware of the Florida Construction Lien Law parameters.
The other contract work being done for this homeowner does not appear to have exceed the monetary price threshold or they simply are not filing for permits or require a permit for their job scope.
Custom Windows & Exterior Design are missing the point. Our issue is that a lien was put on our property without our knowledge & at the very least should have been removed immediately upon final payment. As stated many times we have no complaints about the windows or install but rather their sloppy business practices of not removing the lien and that they were prepared to just let it expire after a year instead of following up & keeping a happy client. This is just pure laziness.The lien may be Florida law, we can't change that but to us a lien is for non payment . This is not the case here.
Once again, we apologize for your dissatisfaction. It is unfortunate that we cannot come to an understanding and reverse the negative impact these complaints can have towards our company.
A note to Any future customers reading this. Please be aware as a homeowner doing business with ANY reputable contractor who is performing a high dollar work that requires a permit, you will sign a form called a notice of commencement which places a lien on the property where the work is being done as was the case in this transaction. These forms are standard public documents and each homeowner should take responsibility for understanding legal documents they sign. In the hundreds of sale we've had this year alone, this is the only complaint we've had about this specific situation. We wish it could have been handled through the phone call to our office.
