In lieu of the circumstances, I believe it would be best served if I grant Ms [redacted] a refund Please email me to set up a time and location to take care of business as I have a document I will need signed at the time

Complaint: [redacted] I am rejecting this response because: [redacted] and I have worked together for four years and developed a flexible relationship, which included scheduling and re-scheduling my personal training sessions On several occasions, [redacted] understood I was not able to provide a hour notice to cancel and reschedule a training session; and in fact several times, [redacted] ***, herself canceled my sessions when she had determined it was in my best interest for that day/time I called her [redacted] ***, included, didn't provide a hour notice when she had to cancel and re-schedule a training session.In January, I developed a health issue which included nausea and dizziness This issue escalated to develop severe earaches in both ears In February, I learned I had developed a contagious viral pneumonia and was advised to rest As the viral pneumonia was nearing its end, I developed viral bronchitis until I had recovered During my HIIT sessions and Personal Training, the same muscle group, Hamstrings and Glute Minimus, was repeatedly isolated and the focus of my workout began to develop an extremely sore muscle group to the point developing severe muscle strain to pulled muscle I was unable to workout the bigger muscles below the waist for six to eight weeks I was ordered to rest my muscles for six to eight weeks The combination of health issues and pulled muscles caused the numerous months without personal training, workouts, and all other activity until the end of April.When I call, text, email to notify I'm not able to attend my personal training sessions, I try to notify [redacted] as early as possible to accommodate [redacted] ***'s schedule and not cause [redacted] to arrive at her location unnecessarily early and sit around for me or anyone else she may be training.On February 12th and 15th, I notified [redacted] and the intern, I would not have a training session because I was ill with degree temperature and was contagious I was not notified by [redacted] that I was being charged for two HIIT sessions and one training session at the time I canceled my sessions As for nutrition, [redacted] recommended I speak to her intern, which my understanding would be about ten minutes The intern asked numerous questions, recommended a diet plan, and spoke of the necessity of the variations of foods This explanation extended the time especially with questions and answers I never would have agreed to speak to the inexperienced nutritionist intern knowing it was going to be a problemThis was unproductive time for me, especially when I have other things to do, plus appointments after my sessions.Then on February 17th, I suspended all of my personal training sessions to contemplate a course of actionWhen [redacted] worked at 24Hr Fitness, I also sustained injuries as I did at her current location in Buda [redacted] blatantly chose to ignore the last injuries Regarding training and HIIT sessions, I have called, text, and emailed [redacted] several times to arrange a time to discuss sessions and agree on the protocol; but, [redacted] refused all efforts on my part [redacted] stated she did not have time for my training issues, and made herself unavailable As for a note from my doctor and even though I do have such a note, I am not a school child who needs to present such a note Plus, HIPPA laws dictate that medical issues are between myself and my doctor I don't need to publicize it on CNNMy recovery took several months because the viral pneumonia and viral bronchitis weakened my body I have begun my recuperation since that time and continue to return to function and beyond.I have notified [redacted] I was terminating all remaining training and HIIT sessions and requesting a refund [redacted] has refused to refund the remaining amount.Regarding the question: why am I just now coming to Revdex.com in July'2016? One, because I was providing time for [redacted] to do the right action and refund; two, I've been in South Texas with my Uncle who's in severe health and his issues needed my undivided attention I was in South Texas in May and June' I have recently returned to Austin hoping to return to a somewhat life I am on stauntil I am contacted of an urgency to travel to South Texas I am my Uncle's Power of Attorney.As for quality of service, it has changed [redacted] does not want to talk We cannot have a non-speaking training session It has strained our working personal training sessions As for the length of time on the contract, [redacted] has provided up to months on my previous contracts and recently changed the length of time on the last contract without notification, because I signed on her phone and was just provided a copy recently Notification of termination of training and HIIT sessions was provided to [redacted] six weeks after he sessions began I was not offered any workable scheduling because [redacted] would not discuss I am still requesting a refund for the remaining personal training and HIIT sessions No Discussion No Sessions No Argument Just Peace R E F U N D ! ! !Regards, [redacted]

I have worked with *** *** since as her trainer I have attached a few copies of correspondence via email The issue began on February when I informed her that I charged her for two HIIT sessions and one personal training session due to her lack of hours notice for
cancellation I have worked around her scheduling issues for four years The reason I for this charge is and was a direct result of the time she spent with my intern Ms*** spent an hour and a half of my intern's time going over nutrition while my intern spent a great deal of time listening and planning a nutrition plan for her (She had regained pounds over the course of the previous year due to nutrition plans laid out by others) On my website and my pricing pages, I cite clearly the requirement for hours notice for cancellation The two HIIT classes were scheduled to take place at 6:in the morning and my intern was travelling more than minutes to come in and oversee this class Ms *** was the only person who signed up for the classes On two separate occasions, Friday Feb12th and the 15th, Ms*** texted my intern at 5:or 5:AM to inform *** that she would not be coming in I offered to work around all her scheduling issues and finish up her sessions HIIT classes were discontinued at the end of February due to low attendance I also informed her that CustomFitt is still open and doing business and that I am the trainer who would be doing all her training In other words, CustomFitt held up its part of the contract Refunds are not an option simply because the client chooses to no longer train My contracts also have a time frame in which they must be used I gave Ms*** months to use her sessions She claims CustomFitt is responsible for injury She trained on her own when she was not in CustomFitt's facility I have four years of training her and never has she received an injury under my supervision Had she come back with a doctor's note citing she must not train, I would have addressed the issue There was no note In addition, I wish to point out how she gave CustomFitt a 5-star review and it is on "CustomFitt Texas" Facebook page I have copies of dozens of her emails (of which I have attached two), contracts and other documentation regarding this situation Since her initial complaint began February 17, 2016, why is it she is just now coming to the Revdex.com in July, 2016? Customer Service is something Custom Fitt takes very seriously with clients as well as their healthThere has been no change in that quality service and its provision for Ms ***
