Review: Firm failed to remove tree as close to the ground as was discussed. Failed to refund approximately $300+ for sale of walnut wood that was removed when tree was cut down.Called and left 2 voice mail messages that were not returned. Mr.Brinegar also ignored an email and a letter.[redacted]Desired Settlement: I want some additional stump work performed and a refund on the sale of the walnut wood. Receipt showing sale of wood less his expense to deliver the wood to verify the refund.

Response:

Eric Brinegar stated he fulfilled everything that was agreed upon and he was paid for. The stump was cut to the agreed upon height of 18". After realizing it was hollow [redacted] asked what could be done. Mr. Brinegar stated he would come back and cut it lower, as a favor and for no additional charge. Before he was able to come back there was an illness in the family which prevented him from working for over 2 weeks. Again, the additional work was to be done as a favor - at no additional cost. Before he could get back and trim the stump, a complaint was filed and Mr. Brinegar stated he no longer wanted to do them a favor.

In regard to the wood being sold on your behalf, there were four pieces of wood, but only one piece was good enough to be used as timber. The $80 he received for that was only enough to cover the fuel and labor costs, therefore no money will be refunded to you.

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Eric indicated when I first inquired about cutting the stump lower to the ground that he was not sure he would be able to do so but that he would be back the next week after we talked. I NEVER heard back from him again and he never responded to any voice mails that I left on his cell phone and he didn't respond to the letter that I mailed to him. That was why a complaint was finally filed with the Revdex.com. Additionally, I was told there was quite a bit of good lumber in the tree that he could sell. Again, he never responded to any voice mails or letters that I sent inquiring about the sale of the timber. I only have his word that $80.00 was all he received for the sale of the wood. Since he refused to reply to my voice mails or letters I don't have much confidence in his word that $80.00 was all he received from that large amount of wood.

As to the stump, it has finally been cut down to an acceptable level by another person.
