I took over a contract (I thought was a loan to get 2 coffee makers machines) on July 9, 2019. When I sent the assignment signed I called CWB asking for the terms and conditions of that contract - because I know I have 10 days to cancel for any reason. She didn't reply back. I've called back to her and to the bank two times per month about that but no answer. When the payment in Jan/2020 didn't go through, Val *** got in contact with me about the payment when I asked about the contract. She sent me contract by email on Feb 5. After read carefully I sent some questions to her and she didn't reply. So, I decided to cancel the contract based on my 10 days (considered Feb 5 - the date that I have the contract on hands) and she's saying that the contract is not cancel able.

As part of our standard assumption process, in early July, 2019, the customer submitted an assumption application and upon acceptance, was provided with the assumption documents and a copy of the contract that was being assumed. Upon signing the documents, CWB National Leasing approved the customer's assumption of the lease and, over the course of the month, made payment arrangements for pre-authorized debit from the customer's account.

At the beginning of January, 2020, the customer's automatic payment withdrawal was rejected showing the account had been closed. CWB National Leasing staff made several attempts to connect with the customer. The customer was again provided with a copy of the contract he'd assumed, and over the course of several interactions, staff provided the customer with his options for returning the equipment and settling the payment amounts that are in arrears. As of today's date, the customer is liable for the amounts outlined in the contract, and CWB National Leasing has been unable to collect payments for the outstanding amounts.

The document called "Assumption Package pg 1 signed by both" is part of the email train (and I sent it, after received it from the previous owner) but the file "Assumption Package" is not and there is no mention on email train that the rep was forwarding the contract - I didn't receive that file inside any of the emails that I have.

By the way, when I asked about the terms and conditions for the contract, the rep told me that I can only have access to that info after the paperwork signed.

So, we still have an issue about that: I didn't receive the contract before or after the signature, only on Feb 5, 2020.

Please proceed the cancellation with respective reimbursement.

While we understand that the customer is not in agreement, our position remains the same as stated in our initial response. To support this, we have attached the following related documentation:

1. A copy of the July 10, 2019 email to the customer (and the other party to the transaction), which included the full assumption package
2. A PDF of the full assumption package that was emailed July 10, 2019

The contract was provided as required and the customer made payments until 2020 without issue. When the customer contacted us in 2020, he cited the Consumer Protection Act of Alberta, which would have only been applicable in July of 2019, however the Act does not cover commercial agreements, such as the one he signed, which is governed by the terms and conditions of the agreement itself.

Our position remains, the agreement is in properly in place and the customer is liable for the amounts outlined in the contract.
