The contractor failed to adequately install ventilation when finishing a craft room. The resulting rot in the craft room was caused by water accumulation between the roof and the ceiling. Moisture and humidity were prevented from evaporating as the insulation was installed without ventilation or circulation. Capillary action allowed water to migrate from a tiny leak area throughout the room, rotting the roof decks and rafters from within creating extensive damage and a health issue as mold formed.

Secondarily, additional rot on an upper deck was caused by the installation of horizontal 2-by board surfaces intended to support a star design pattern in the deck which allowed water to pool. As a result, numerous support joists are severely rotted and the deck construction is compromised.

We have contacted CWC to express our concerns and invite their response. We submitted to them complete details and many supporting photographs. So far, CWC and its president Rick B, have denied responsibility for these design errors.

l returned from vacation on Friday, 6-22-18 and received the letter which was mailed to us dated. 6-14-18 and assigned an ID # *** filed by ***. Below is our response to his complaint.My company was contracted on 4-28-08 to replace the existing decking and railings on a deck whichwas built over an existing craft room as well as build an extension to the existing deck for a new hot tub.Plans for this work along with a permit application were submitted to Montgomery Country. All of ourwork was inspected by the Country and final inspection was approved on 8-8-2008.

The problems which *** are experiencing with his craft room are due to the fact that the roofis too shallow and leaks, not anything which CWC completed to cause this problem. This was evidentwhen *** contracted another company a couple of years ago. according to him, to seal theleaky roof. The star design on the deck was supported by pressure treated lumber, which docs have ashelve life like any other wood product and after 10 years, long after our warranty expired, this woodsupport failed according to ***.

I am rejecting this response because: While we and other experts who have conducted an inperson inspection are in concurance with Mr. B’ ***essment that the slope of the roof was too shallow for standard shingles and that his company did not construct the roof, CEC nevertheless installed insulation between the roof and ceiling (without providing for ventilation), finished the interior of the room to house a model railroad, and constructed a deck above the roof with full knowledge that the slope of the roof was too shallow and would eventually fail. Had CWC brought this design flaw to our attention, we would have gladly paid his company to remidate the roof, given the delicate and expensive model railroad it was to house. Neither Mr. B nor his on-site project manager ever mentioned this thereby ensuring the roof would eventually fail. If they did this unknowingly, I fault them for ignorance. If they did it knowingly, I fault them for negligence. With respect to the rotting of the pressure treated boards, rotting of other pressure treated boards supporting the deck did not occur except where support boards were installed horizontally, a design flaw that inevitably lead to premature failure of construction. Mr. B acknowledged this premature rot after we first contacted him, indicating that pressure treated wood typically lasts 20 years. We believe it does, when properly installed. Regards
