False payment amount given want to return UTV to dealer but they will not accept this return. Filed complaint with business 15 days after purchase.I bought a new side by side UTV about a month ago from Cycle Design in Phillipston. They told me what my payment would be and it was within budget so I purchased it. When I got my first bill the payment was more then double what I wanted to pay and agreed upon. I brought the payment stub to Cycle Design and explained how this payment wasn't what we agreed upon. The owner called that bank and we found out she messed up. She went to another bank and told me she could get me a loan there which was a bit more then what we agreed upon but was in budget. I agreed again and after it was signed for the next day calls me saying I need insurance on this machine. Irritated I went back in and the insurance was going to cost $189 per year (owner set it up through [redacted] for me) So I figured it wasn't too big of a deal and paid for it. Well last Friday she called me back and says I didn't have enough collision for the bank to approve the loan. I called [redacted] and it was going to cost $90 more per year. I was now really irritated and called Cycle Design back and talked to her saying I could not afford the insurance never mind having more of a payment then originally agreed upon so I would like to return the machine. She tells me they are not like [redacted] and I cannot just return it but she would put it on consignment. So basically I would have to buy the extra insurance (which she said she would pay for) and I would have to make the payments on the machine until it was sold. I told her that was not acceptable and called the bank and told them to cancel my loan which they say wasn't active because I didn't have insurance and I took a loan out elsewhere to help with my payment issue. I emailed the owner and told her to cancel my new loan but when I called the bank they said nobody called them to cancel but since there was no insurance the loan wasn't active yet. I would like to return the machine and get all of my money back because the machine is more then I can afford and the dealer messed up on the payment but the dealer will not accept it back.Desired SettlementI am seeking a full refund and return for this 2015 Yamaha [redacted] I have purchased. Total amount of $15427.94Business Response Contact Name and Title: [redacted]Contact Phone: XXXXXXXXXXContact Email: [redacted]@cycledesignonline.comMr. [redacted] requested the loan be done through [redacted] because he wanted the 1.99% interest, we advised Mr. [redacted] that we did not recommend using the [redacted] card but he was insistant that he wanted to use it. When Mr. [redacted] got his first payment he was upset with the amount. I told him I would see if we could refinance at a lower payment through a local credit union which we did. He was advised that the loan would require insurance which I helped him get, we did not know that he needed additional collision until the bank called in an effort to assist him we offered to pay the additional $90.dollars. He then said he wanted to return the machine; I explained that a vehicle is not returnable but I would help him consign it which he refused. He then rescinded the second loan and told me he would figure something else out. In no way was Mr. [redacted] mislead on the price of the machine or any of the loans we arranged for him. In addition, Mr. [redacted] did sign all disclosure forms for each of the loans and received copies of said signed forms. We believe this is a case of buyer's remourse.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)[redacted] did say she did not like to use the [redacted] card but assured my my payment would be $44.00 and change per month as I wanted to pay $200.00 max per month. I did make sure I asked her that. The payment actually came in at $443.00 per month. She did mislead me there. She did offer to help out but to consign I would have to pay for the machine as it was being consigned and was unable to use it as I needed to leave it there. The point here is she said my minimum payment would be around $44.00 per month and I had a max of $200.00 the payment which came in was $443.00 per month. If I was told this in the first place I would have not bought the machine as I could not afford that payment. This is a very bad business practice making up low numbers and misleading customers to buy a machine. The low interest rate was attractive and also her payment which is why I went with it. I later found out her payment was way off and way over my budget. I am willing to take this case further and have talked to a lawyer.Final Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)[redacted] is now lying about not quoting me. I had concerns when I went back to take delivery of the vehicle and sign for the loan because I could only afford $200 per month. I asked [redacted] what the minimum monthly payment would be to make sure I could afford the vehicle. She calculated the amount out in front of me on her computer. At first it came up to over $400 then she said no that isn't correct and recalculated it to $44 give or take a few dollars she said. I wrote that down at that time because it didn't sound right. When my monthly statement came in it was over $440. At no time did the sales manager go over any figures with me for a monthly payment only [redacted] did in her office. I wish my 4 year old was able to understand what was going on as she would be my witness. I mentioned to [redacted] and her sales manager multiple times my budget was $200 per month. They never did say to not use this loan source as a matter of fact her sales manager recommended it to get a lower payment. [redacted] did tell me to make sure I paid over the minimum so I do not have the loan forever and she said she didn't like this type of loan but never did either of them try talking me out of going this route as it was supposed to meet my budget.Final Business Response My sales Manager and I both told Mr. [redacted] that we preferred not to use this loan source since it was a revolving and not closed end loan. At no time did I quote a $44.00 payment on a $15,427.94 loan. Both my sales manager and I went over figures with Mr. [redacted]. All paperwork and loan documents were reviewed and signed by him. I feel we have done everything possible to assist Mr. [redacted].
