I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint The Company keeps referring to the 'contract' however, as they have been informed on multiple occasions, our copy was destroyed in the flood that destroyed the houseThe Company has failed to provide us with a copy of the contract, which they keep referring toTherefore we have no validation of their claim. A refund has been requested many times, and Patrick responded on Nov13th he was mailing a check that dayNo check ever arrived and therefore his resolution of paying us back in installments of $per month is not acceptableHe has acted in bad faith, promising payment that never arrivedWe gave him the down payment, in good faith, August 1st, and he subsequently deposited our checkWe paid him 100% of the down payment in one checkWe would like 100% refund, in a cashier's check, with no fake promises of 'the check being in the mail'It is a shame that this Company has chosen to take advantage of the flood situation as an excuse to keep our moneyHe had a full weeks to install the fence, prior to the hurricane, yet there were no attempts in start and complete the installation in a timely fashionWe only want to be treated fairly, and being lied to and have this situation drag out for 3+ months is an indication this contractor has no plans to do the right thing

Tell us why here...The *** signed a contract with a no-refund policy which is clearly outlined in the contract terms and conditions they agree toI have done previous work for them so they are aware of my contract and how I operateI have offer to complete this job at any time as there are
no dates of completion outlined within the contractThe *** cancelled the job which put them in breach of contractSince the *** were previous customers that have been satisfied with previous jobs I have agreed to go above and beyond the contractual agreement of refunding them $per month and have offered twice two double this payment monthlyI have not done anything but communicate with them throughout the process and have tried to explain to them and help them understand the contract terms and conditions that *** signed
