I will address the specific remedies I provided to the customer, but first I would like to address a couple of inconsistencies in the story told by *** ***.First, he stated that he had some repair work done for $only to be told that it would not solve his problem and that the vehicle needed a
new engineWhy did he allow a mechanic to do work when he was informed that it needed an engine? Secondly, he states that we violated the warrantyThis is not a fact since when we had the vehicle returned to us and diagnosed by a mechanic that we know and trust, the actual diagnosis was a faulty oil pumpUpon complete inspection of the engine, it was determined that there was no internal damage to the engine, and upon replacement of the oil pump and other ancillary parts at OUR expense of $**(we have a Invoice for the work), the vehicle was in perfect running orderSince the work we completed resolved the customer’s issue, we in fact honored our commitment as we always do. Once the work was completed on January ***, 2017, we notified *** ***, in writing via Certified Mail (we have the receipt)and in a phone conversation that the vehicle was fixed and ready for pick upWe also informed him that that if he did not pick it up, it would begin to incur a storage charge of $per day*** *** has failed to respond to us directly, and as of this date we still have the vehicle in storage. Based on the facts that we have stated, we attest that this complaint is baseless, and we request that it be dismissed. Thank you for your time and consideration.Pat Bonavita- Owner 02/**/

there is misleading information in ** *** response, when I took the car to the first mechanic ,Spanish American,to get checked, we called bonavita pat more than once to get his permission to have the car fixed, the mechanic called him and you can call the mechanic at his number to get the truth:***Secondly I took the car to the Chevy dealer in Darien ,Ct he diagnosed and gave me his report which I gave to Bonavita patNow I can may be make some concessions if you send me my car to ** *** *** *** *** and I will drop the case which is in court by the wayAnd do not tell me you will charge me $a day while the car is sitting in the streetI forgot to say that I replaced the battery too in that car

I have read the business response,however there are some discrepancies as to who said what,I understood the refund policy that the business had in place how ever it was only 3days after my deal fell through I left the deposit pending I was waiting for a check to come but it didn't because of legal reasons I notified the business emediately the 3 days via his brother Vinny at the same time I was under going [redacted] treatments after speaking with the owner of the business over several phone calls I explain my situation and I ask him if he would consider giving me a a portion of the deposit back understanding the refun policy he said no I ask him so I just gave you a $1000 just for walking through your door his response was yes things happen did not entertain the suggestion any further.But before we got to this point we did go back & fourth on the phone a couple of times about purchasing a different vehicle but I would have to bring him another $2500 in order to get me approved because of my credit situation I explain that I didn't have it well because I wasn't working at the time so I could not. That's pretty much where it left off.

While the complainants response does not provide any legal grounds for a refund, in good faith we would like to provide [redacted] a partial cash refund in the amount of $250, or if he prefers, will allow him to apply the full $1,000 deposit toward a future purchase at any time. He can contact us directly and let us know which choice he prefers. We are sorry for his situation, however, our refund policies were clearly stated and we did take the vehicle off the market due to his assurances that he was going to complete the purchase. The particular vehicle in question was one that was not particularly common in the market and due to this fact, we received a lot of interest in the vehicle. However, based on [redacted] assurances that he would follow through with the purchase as soon as he received a check he was waiting on, we held the vehicle for him and took it off the market in spite of the fact that we could have sold it several times over, for more money, from other customers. While we empathize with [redacted] stated health issues and wish the best for him, this does not change the fact that we clearly explained our refund policy to him and are within our rights to deny the refund. Had the request been made within a few days, or had he not made us hold the vehicle for a period of time under the assurance that he was definitely going to complete the purchase, perhaps we could have made a partial allowance like we sometimes do at our discretion. In closing, I would like to state that if [redacted] is still in the market for a vehicle, we will use our best efforts to locate a similar vehicle and of similar cost through our various contacts and resources, and apply the previous deposit towards the purchase of that vehicle, or any other vehicle that we have in inventory. There was no misleading information in my initial response. We acknowledged the customers issue, made an agreement on how we were going to resolve the issue and completed the repair at our expense. The customer never came to pick up the repaired vehicle, and therefore is responsible for the storage fees for the vehicle. He claims the vehicle is sitting in the street, but this is not true since the vehicle is placed in a locked facility every evening. We will not agree to deliver the vehicle to him, however, if he will contact me to arrange pick up, I will work with him regarding the storage fees. Thank You
