May 2019: contracted CZ Landscaping for lg landscaping project. Cost of project: over $30K. Project included trees, shrubs, grading, lighting, sprinklers, sod, etc. I specifically asked about guarantee for plants & trees - told 2 yrs.

Project began right away & done in timely fashion. Job paid in full. Several small issues with project; eventually issues addressed although always necessitated substantial calls & texting.

Fall 2019: several arbovite trees died as well as 1 lg red maple tree. Arbovite trees replaced with smaller trees & 10' red maple tree replaced with 6' pear tree. I was told the arbovite trees "seemed smaller" because the other trees had grown. Not true since I have photographs of trees and their height when originally planted. Regarding red maple tree, several landscapers told me the substitution of pear tree for maple tree is far less costly. I was never given any sort of rebate in difference in tree costs.

Also during Fall 2019: I told *** (owner) AT LEAST 3 of 7' evergreens were dying. Kept asking him to come look. I was concerned they had fungus & it could spread to remaining evergreens. During phone call he STRESSED trees were fine & trees would "come back" in Spring. I have photographs of these trees. They were dead. Were obviously dead to neighbors & everyone who saw them. Nonetheless I waited until Spring. Still not certain remaining trees don't also have fungus. Asked *** to come look at trees to discuss replacement.

He came without my knowledge. Never gave me the chance to show him my other concerns and said he'd replace 3 trees. Wants to replace blue spruce with Norway spruce. I want to make sure I am GETTING WHAT I ORIGINALLY PAID FOR!! I don't want something smaller or less costly unless he's will to reimburse me.

I have called him, emailed him, texted him. He never comes. Always too busy. He works right across the street at my neighbors. I see him across the street but he won't show up & talk to me about my trees.

I received the following text from *** (business owner) on Saturday, 4/18: (I cut and paste this text so you are reading the exact message I received from ***):"I just received a letter from the Revdex.com from a complaint you wrote about my company the facts are not true. I replace everything as it was first installed shipment vary throughout the year but time they all grow the same size. The norways I had at the nursury ready to be installed weather permitting and because of the covid 19 I don't want to risk getting you myself or my family sick meeting you at the time in the spring. They were going to be 8' as a favor to you and are $100 more each than the original blue spruce I installed I can't control what's sold to me but my best judgement with the diseases they in counter to replace with a better species. They are not cheaper all spruce run the same price it's just color difference. At this time I will not be replacing anything since you put my company at jeopardy as the favor I was going to do, you can now have your fertilizing company that burnt the lawn and overspray caused the death of the pines close to the edge of lawn area to die have them come out and replace them. I'm sure you remember when all that happened after I told you I would have a company of my own that I trust with my follow up services, and as I said not to have anyone do anything without discussion first. My lawyer will get the info Im sure they documented when they caused the damage to lawn and plantings. I will be contacting my lawyer about the situation and will hold you accountable for any lost business do to your poor judgment and complaint made about my company on the public web. Please don't contact me anymore my lawyer will handle this for now on." My comments related to his text are this:According to ***, my facts are untrue although he doesn't address most of my statements in the complaint.He claims he had set aside 3 trees for me but because I filed this complaint, he won't replace the trees (isn't that an admission that he knows he needed to replace the trees?).He's falsely claiming the trees died because of fertilizer company -- this is laughable on its face -- *** never mentioned anything like this before and I NEVER HAD *** FERTILIZE THE BACKYARD LAST SUMMER WHICH IS WHERE THE TREES ARE LOCATED.Statement after statement in ***'s text is patently FALSE -- he NEVER recommended a fertilizer company, etc, etc -- he's simply looking for an excuse not to replace the trees. I can dispute every single thing he stated - I have texts, emails, and photos to prove my position.*** has not communicated with me since MARCH 12 (6 weeks!) despite my reaching out to him by text, phone, and email.He claims he's turning this over to his lawyer -- holding me accountable for "jeopardizing his business" and causing him any loss in business.He told me not to contact him again -- his lawyer will handle everything from now on.My questions to you going forward:Will my complaint ever appear on Revdex.com website?Now what? I really don't trust him -- I don't want him on my property to replace the dead trees.What do I do now? I want to replace these dead trees (not by him) -- they should have been replaced last Fall and I don't want to miss the small window of opportunity to plant trees in the Spring. I would like to hire another landscaper -- any likelihood that I may recoup damages monetarily?*** seems to be threatening and intimidating me for filing a complaint -- isn't this the purpose of the Revdex.com to issue a complaint if you suspect you are being treated unethically?Please call me at your earliest opportunity. I would really like to know how to proceed.

Did the landscaping last year did replace some trees that failed. It was hot.

She had a company come in which burned some grass and caused damage. They sprayed the trees she has a report of it. They had to fix the trees. I told her I would replace them and she has decided to file this complaint. Now I am the middle of getting an attorney because she shouldn't have filed a complaint. Covid has stopped this from happening. I went and took a look at it and was working across the street - she said I hope *** is bringing me some tress too. She cost me a client. I've told everyone to give me two weeks. That's where I am now with everything. Please don't contact me anymore my attorney will take care of it.

I looked at this a week prior before this letter.

We planted a Maple and it didn't do well with the area. I suggested a Cleveland Pear. They do best here.

I tried making it right. Its been snowing here in May in Ohio.

FYI, *** is lying over and over again in his statement below. I have no idea what he is talking about with his statement about the spraying of the trees -- I never filed a report with anyone other than Revdex.com last month (end of April) against HIM. And I never had *** spaying fertilizer in the backyard where ***'s work was located (the *** contract was for the FRONT YARD ONLY). And only once did an organic fertilizer company spray the GRASS in the backyard at the VERY END of the season. That HAD NOTHING TO DO WITH THE TREES! The organic company applied too much iron and it left a mark on the grass -- it didn't kill anything! The trees were already dying by that time which *** fully knows.And I don't know of any client that he lost because of me. I never said anything to anyone about hoping *** is bringing me trees. He is lying. This has nothing to do with COVID-19. He planted the trees last May, they were dead by September of the same year (4 months!). I waited until this spring because of his resistance. Then he never returned my calls, emails, or texts beginning in March. How long was I supposed to wait? He was planting trees at a neighbor's house, and he had never responded to me at all. So I filed the complaint. Please add the fact that I have now spent another $1,945.37 to replace the dead trees that *** guaranteed for two years. ($1,225.37 for materials and the remainder in labor). The 1st attached photo was taken on 10-6-2019 and depicts one of the blue spruce trees that died -- obviously already dead last Fall. *** INSISTED they would all come back in the Spring. I gave him the benefit of the doubt that he would make good on replacing the trees this Spring. The 2nd and 3rd photos (both taken on 4-28-2020) are all the dead trees just before being cut down. My guess is that the stack of dead trees sitting on my tree lawn for several days while waiting to be hauled away certainly enlightened the neighborhood.

She had issues with every contractor on this job. I was going to make do. She decided to go this route.

I do high end landscaping and don't run into this very often. She had an issue with the sewer I worked with her on that. I did a lot of back and forth and a lot of extra work that I never complained about or charged her for. I got the job done and it was beautiful.

I just feel like there is nothing that is going to please her.

Iron doesn't kill lawns.

The customer did call me and told me she walked across the street.

I returned every call she sent me and I even came to her house. I was working across the street. I checked how the trees were doing. I have texts of her completely pleased with everything. I went to her house when Covid was going on and looked at the trees she sent me a text message saying she wanted to meet with me that she was home.

I could tell that the fertilizer company killed the trees. She hired another company for the safety of her dog.

This contractor has lied and misled at every turn and in every response. If anyone were willing to review all of his responses, you would see that he has blamed the death of my FOUR trees on it being too cold, too hot, too wet, too dry, and COVID-19. Every excuse has been used except his dog ate his homework. His train of thought isn't even coherent.His responses mostly are not even related to the four dead trees that are the basis of my complaint -- he keeps mentioning the dead lawn (it isn't), the fertilizer company (wasn't even treating the area at issue), etc.My issue with this contractor was that I had FOUR trees that died within his 2-year guarantee time frame. He was evading my calls, emails, and texts to replace the trees. He HAS NOT returned every call -- that is an outrageous lie. In my opinion, he had no intention of replacing the trees that died. Consequently, I filed a complaint. I think other potential clients should know the character of the individual who is being considered for a landscaping project.
