We are writing in response to a complain filed by ** ***:The actual cost of this contract was $18,The contract included drainage work which totaled $1,When we subtract the cost of the drainage work from the total of the contract we are left with $16,as the cost to build
the patio The cost of the patio based on these figures is $per square footIf we multiply that amount by square feet we arrive at a price of $The difference between the cost of a sq ft patio and a sq ft patio is $2,By 8/1/our company had already completed excavation and framing on a sq ft patio The cement truck was on its way on 8/1/to pour the concrete for the foundationOn 8/1/16, after excavation and framing were complete and as the cement truck was on its way the scope of the project was changed by the homeownerAt this time we had to: acancel and reschedule the shipment of concrete bpull up the frame. carrange for and haul in dirt to fill in the areas that were no longer going to be used for the patio. dour employees then had to shovel this dirt into the area fill it earrange for and purchase sod to cover the dirt and bring the yard back to its natural state f lay the sod gbuild a new frame for a sq ft patioAt no time during this process did the homeowner ever ask for a credit for the changes they requestedThis request was not made until the patio was completed and the balance was dueCombined cost of dirt, sod, framing materials and labor was explained in our email conversation dated 9/2/16:***,Below is breakdown of credit mentioned on invoice:1) Change order requested after patio had been set for square feet as mentioned in proposalAll forms, stone, concrete wire was set and installed with delivery of concrete in transit as change was made morning of concrete delivery August 1:aCredit for reducing patio square feet for material cost of flagstone/concrete $1,150.00bCost/delivery of adding yards of soil and sod to fill area where patio was reduced -$675.00cCredit on reduction of patio $475.00Since change order was requested after all work had been done on original design, there was labor expense to accommodate change by redoing forms to change patio as requestedWe had the expense of removing the dirt of original design and the hauling expense of the dirt(yards) in the area where patio was reduced. The total square footage of patio is approximately square feet as we measure in straight lines to allow for cutting of flagstone which results in waste materialIf a patio is not square there is usually around 10% waste material depending on how many stones need to be cutWe purchased and delivered square feet of flagstone which was used on your patio.**please note: the above email does not include cost of reframing and the fee for hauling away yards of dirtThe fee is $As for the "Complaint Background" of your complaintThere is no model number for a patio, we did not refuse to provide that informationThe account number and the order number are the same as the estimate number, #***Again, we did not refuse to provide this informationWe would like to note that according to the proposal that the homeowner agreed to 50% of the total invoice ($9,150) was due on the day that the concrete slab was pouredThe slab was poured on 8/2/Homeowner refused to pay this amount and instead paid only 25% of the total job at that timeWe had no choice but to accept this amount even though it was not what was agreed to before the job was startedWe strongly disagree with the homeowners statement claiming that we exploit our employees and falsely inflate pricesWe have in our possession numerous emails and texts from the homeowner threatening to sue us and making disparaging comments against the owners characterThis is a proper example of threatening languageAfter the homeowner had threatened by email and text to sue us ("see you in court") numerous times we realized that we may not be paid by the homeownerAt that time we decided that, in the event that we were not paid, a legal mechanics lien may need to be placed on the homeowners property to recover the cost of monies owed
