D and S Concrete

D&S Concrete was to concrete both sides of my driveway culvert but did not finish the job that we agreed on. They were to come back but never did.
I hired Overton Garages to add onto my shop. Overton contracted out D&S Concrete to pour and finish the concrete. Before Mr. Overton starts a job, he and Sammy Dixion (the owner of D&S Concrete) go over the job with the property owner. While Mr. Overton and Sammy Dixion was at my home, I hired Sammy Dixion (D&S Concrete) for a side job. They were to pour concrete on both sides of my driveway culvert. The County Road Department has put rock over the culvert three times because the water keeps washing the rock away. So, that is why I needed the concrete poured. Sammy and I both agreed that the concrete needed to be poured from one side of the ditch to the other (5 feet), and from the top of the driveway to the bottom (2.5 to 3 feet), which includes the culvert. He charged me for one yard of concrete plus labor. $250.00 total. July 31, 2012 D&S Concrete poured the jobs for Mr.Overton and me. I was out of town when they did the jobs. When I came home, I found that the side job that D&S Concrete did for me was not completed the way Sammy Dixion and I agreed to. They just poured concrete around the culvert on both sides of the driveway (not from one side of the ditch to the other). Only about 1/2 yard of concrete was poured. I called Sammy Dixion, and he said he was not there at the time the side job was poured. He said that he would come back and finish the job in a few days. He did not show up. Over the following month, I tried calling him several times because he had not finished the job. Finally he answered and said he had to get another phone because his was broken. He once again said he would be out the next week to finish the concrete job. He did not show up that following week. So, off and on since then I have tried to reach him and there has not been an answer. He also would not return my calls. I finally called from my work phone and he called back wondering who has called his number. I told him who I was and suprisingly he said his newest phone had also broke. That's two phones in 2 1/2 to 3 months that has broken (so he says). He said he would be out that Wednesday. He never did. Since July 31, 2012, this concrete job has not been finished. Ever time it rains, more rock continually washes away from my driveway. I have tried to contact him on numerous occasions (several times a week), but he will not answer nor return my phone calls.
[redacted] I am aware that Overton Garages is NOT liable for any side jobs that his contractors do. My complaint is not with Overton Garages but with D&S Concrete.
