good person, well I am I want to get this resolved quickly and fairly. Regarding the refund of your overpayment of $2,000,00, with all of the confusion from the majority of your rent checks bouncing, the accountant working on this rental has been trying to reconcile the account to be sure that she was accurate when returning any funds That along with the fact that we could not get anybody to confirm the actual date that you moved out caused a delay I am sure you can understand that with all of the bounced checks etc., why my accountant wanted to be 100% sure of the amount to refund It has always been the intention to return any money owed to you You will be receiving the $2,for overpayment of December rent in a few days, it will be mailed from Washington State. In response to being paid the difference in what you paid and the fair market value, there is no money to be returned here for two reasons. You were well aware of the existing condition of the unit when you rented it In documented conversations with the property manager ***, you needed to get moved in quickly and were ok with its condition at the time, which was not that bad As for the 2nd bathroom, it is my understanding that the slow draining sink/toilet was attended to after learning about it and fixed by a licensed contractor that the property manager hired New chairs were ordered and delivered, I believe you told *** that you or your son could put them together Your contract was for $4,per month which is on the lower end of the scale for short term rentals for this caliber of condo near Waikiki (comps enclosed)This breaks down to approximately $per day which is a good rate for you All of this is confirmed if you go to VRBO to see what these rent for With that said, your original agreement was to go only to September 9, 2015, so I could raise the rent as we entered the high season, particularly, Thanksgiving and Christmas holidays, where rent is considerably higher As you extended month to month, and because of your health issues, I chose not to make you leave, or raise the rent I could have made much more money by holding you to your contract, but that was not the case. I am surprised that you are even asking for reimbursement here The condo was not misrepresented at the time of the rental, you saw the unit, signed the contract, and the manager accommodated you the best of her ability during your stay As you know, there were times that you would not allow access for some of the repairs (bathroom, air conditioning) due to your schedule and/or health issues The property manager would be better to talk to about this since she was the one trying to accommodate you.More importantly, if you were so dissatisfied, why did you choose to continue to rent the condo? On the contrary, you continued on a month to month basisThis does not sound like a dissatisfied tenant to me, unless you planned all along to try to get reimbursed “after the fact” I am not suggesting that this was premeditated, but it could be argued Reimbursement, $0.00 Regarding the security deposit, as I told you on the phone, there has never been any intention of keeping any money that was due to you As you know, you left the property without cleaning it whatsoever There were items left in the cupboards, the refrigerator was full of your food, the 2nd bathroom smelled of urine due to lack of care, the carpets were a mess, and general cleaning of all rooms did not happen The place was left significantly worse than when you moved in Four days of deep cleaning with one person finally got the unit back in rentable condition *** had a good price to clean it up, and it was approximately $ That along with the elevator opener and key, I should be holding back a minimum of $750.00, but I am going to reimburse you the full amount less the key charge of $ Amount I will send, $3,825.00. As for theft, I have never accused you of taking anything That is between you and the property manager. I am prepared to write you a check for a total of $7,to complete this transaction If you agree, the amount will be considered payment in full for the rental transaction I look forward to your response so I can process the checks quickly If you disagree, please let me know why so we can resolve it. I will be sending a copy of this letter along with backup records that show that what I say here is true to the best of my knowledge, and I am hoping that you see this the way I do and send an amendment to the Revdex.com that puts my business in a better light This could have been resolved easily had you contacted me before writing to the Revdex.com; I am not sure what could have been said to you that made you ever think that I was unreasonable.
