Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below In response to reply sent by D & H Contractors: To whom it may concern, To begin, I was not aware the company was going to connect with a rubber ferncoThe first time I had seen or heard the word "fernco" was in the response letter, which was not sent in a timely fashionThe problem was not correctedI again had total blockage in my main line, as detailed in my initial letterI'm now being told through this reply re: the cleanout that "the pipe exiting the house had to be put in at an angle, leaving the mandatory cleanout at somewhat of an angle." This is the first time I'm hearing this, although I posed this question to MrMedcalf over the phone before I wrote to the Revdex.com; at that time no explanation was offeredI've attatched a photo to illustrate what I'm left with The statement made by the company spokesman in reply that "Mr [redacted] is evidently blaming us for his tree roots growing" is an insultIf MrMedcalf possesses the experience he claims to have had, why could he not tell me I had a maple tree growing in my front yard; that maple is one of the worst possible trees to have next to a sewer line, and that my line blockage would reoccur? I had to find this out through my own researchIn retrospect, this might have been a more pleasant transaction had D & H been forthcoming and responsive to my queries and concernsHad I all the information at hand, I would've chosen to eliminate the tree firstI would not have gone with this company, after reviewing the other experiences individuals have had to deal with, posted on the Revdex.com siteI would not recommend D & H to anyone in need of excavating Regards, *** [redacted]

The complaint filed by this homeowner is very misleadingThey did sign the contract in July of However, we made multiple attempts to contact them regarding the [redacted] check ($2766) used to pay the sewer connection feeThis is because we cannot pull their permit without the fee being paidWe did not receive the check for [redacted] until October of When we spoke with the homeowner after the check was received, we did tell them we would schedule them for the week after ThanksgivingUnfortunately, the weather did not permit us to dig that week, nor did it allow us to maintain our schedule for weeks followingNow we are playing catch up since the weather seems to have let up for a bitNow, regarding the check not being cashed for the permit, I do not send payment through until I am certain we will be on that particular job within the next day or twoI do this to keep the permit from expiring, thereby costing either our company or the homeowner an extra fee for renewalI spoke with Mrs [redacted] yesterday morning to let her know that the crew was behind schedule due to weather, but was finishing up the job scheduled before them, literally right across the streetThis was unacceptable to her and she requested her deposit back, stating she hired another companyFirst of all, deciding to hire someone else to do the work is not a valid reason to cancel a signed contract and would never hold up in courtSecond, we offered to give her a partial refund because yes, there were administrative feesNamely, the sales commission, the pay to office personnel for time spent scheduling, pulling lateral locates, applying and pulling the permit, notifying utilities so they may locate underground wires and pipe on their property, as well as the time spent contacting and updating the homeownersMr [redacted] did call back this morning and spoke to meI informed him that the owner was on the other line and that he would get back with himThat was at 9:this morningIt is now 1:50pm and our phones are still ringing, keeping myself and Mr [redacted] tied up answering questions on top of meetings that were scheduled for todayHowever, Mr [redacted] , has NOT called back since his phone call this morningI have not left the office and have not let even one call go to voicemailWe have already pulled their permitThe job directly across the street from them will be completed today and we would've had the opportunity to move to their property as early as tomorrow morningWe will not issue a full refund because they simply changed their mindIf they'd like us to do their job as contracted, we will do soIf they'd like a partial refund, we will do soI have documentation for their check and the dates written/cashedMy scanner is not connecting to the network for some reason, so I will fax them over after sending this responseThank you

"Again, another weather related delayAlso, we have NEVER asked or required payment in full up front or as a down paymentWe do require a nominal down payment only to assist in material purchases and to validate contract."

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below. The photo that the contractor provided of the replaced fence panel was taken on the wrong side of the house The work was done on the north side of the house The contractor DID replace the fence panel, but in doing so, caused property damage to my neighbor's driveway I had a note (attached PDF) from the neighbor on my front door when I arrived home on 11/stating that mud had been tracked all over his driveway I placed a call to D&H at 3:40pm on the 7th to ask them to come out and clean the driveway Nobody answered so I left a voicemail No call back by 5pm so I went ahead and cleaned the mud off of his driveway myselfTo date, I still haven't received a call back from D&H regarding my voicemail (or any of my previous voicemails, for that matter)You can see in the attached photos that heavy machinery was driven on the neighbor's driveway (even though I said during the estimation meeting that D&H MUST keep any type of equipment off of the neighbor's property) Anyone can see in the photos that his driveway was already in bad shape and one should assume that rolling heavy machinery over that cracked asphalt would break it apart, as it did I now have a very unhappy neighbor Damaged caused to my own property, including broken fence pickets and a broken downspout will be taken care of by me, but I expect the neighbor's drive to be patched where D&H caused damage D&H did not receive permission from me or my neighbor to be on his property Regards, [redacted] %

Ok, you need to hook into city sewers, you want to know about D & H Contractors, LLC - All you need to do is look at the complaint history, If you can find any good comments that's greatCall the City of Indianapolis and ask them if there have been any problems with D & H or the ownerHas this individual had a similar business? Research the mycase website and look under [redacted]   [redacted] to get another perspectiveIt's public information, you have my permission, and you have a right to knowAlthough I won my court case against them and received compensation I spent way more than small claims court max in attorneys fee'sSo, the choice is yours Good luck and do your research before you hire anyone!

took deposit old guy ( he calls himself business owner) months ago and never started the jobI was calling every weeks and they just kept telling me that will start in week or two( phone answers some girl and I think it was his daughter)Today the guy told me that they are out of businessThey were suppose to connect sewage from septic tank to city sewageIt took me two months of callingToday he said he wont be able to return my deposit $and the bus sines is closedBeware of this companyThey have two addresses at leasti am taking them to small court tomorrowOld guy looked so hones and turned out to scammer

It took D&H months to complete a job And only after I contacted the city and had them intervene I can't tell you how many phone calls I made to them pleading to get the job finished and how many lies they made in response saying they would be out to finish it I would not recommend them to anyone

Entered into contract w/ this company for city connection in March it is now Oct Paid 1k deposit; no return on calls, no response from certified letterNext step is sue for refund & damages

The hold up on this property was finding where the sewer line came out of the houseWe hired a subcontractor to investigate and found this in DecemberThe sewer line is ft deep, which will require a ft riserWe
will be back out to finish her jobThis is the first full week of work we've had due to weather, since the second week of DecemberAs far as her getting a notice of being fined, we will contact the Board of Health and get an extension on her property

I'm wondering if this complaint was filed just before we went out to rectify the situationI visited the property this morning to ensure that the work had been completed at his property.Pictures are attached, showing his fence panel was put back up, as well as the yardIt has only been a
couple months since we've done the digging and the ditch line still needs to settleBut, it doesn't look like it will even need graded after settlingYou can see in the pictures that the ditch line is already pretty flatIf it does end up needing graded, we will return to do so before I take the crew out of the area.Thank you

"Mr *** was aware of where we were going to connect a new pvc sewer line to the old clay pipe in the street areaWe went to the edge of the city sidewalk and connected the only
possible way, with a rubber ferncoThis job was inspected by Citizens Energy Group and approvedProblem correctedWe also repaired the pipe at the perimeter drain by the house which the connection had been compromised by the tree rootsIn making this repair (at no charge) the angle of the pipe exiting the house had to be put in at an angle, leaving the mandatory cleanout at somewhat of an angleWe only charged Mr *** $1875, barely above costHad one of the larger companies got to him, their charge would have been in the neighborhood of $I know this for a fact because I bid against them every dayWe don't treat people like they do
When Mr *** paid me for this job, everything was drainingTree roots do grow quickly and in this case are between the sidewalk and into the street area
Mr *** also stated that he had been saving for over a year to get this problem fixed and thanked me for not having the excavate the street area, also his responsibility which would have cost thousands of dollars more, depending on how far into the street we would have to excavateMr *** is evidently blaming us for his tree roots growing
Also, we are not responsible for landscaping his yardWe do leave a small mound of dirt over the ditchline to allow for natural settling."

Revdex.com:I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below. The company’s response has too many untruths to address them all in this type of forum. If the company had truly intended to start the job the week after Thanksgiving then why was the permit applied for and pulled, the utilities contacted to locate underground utilities, etcthe 3rd week in January, instead of the 3rd or 4th week of November of last year? Why were we not notified of an any schedule or updates for/in October, November, December or January? Why were we not notified that they were not going to do the work the week after Thanksgiving if they truly intended to do the work?If the company was to begin the job on January 28th (as stated in their Revdex.com response) why were we not previously notified of that? Why has there been absolutely no contact by the company, not first initiated by us, in more than months?Obviously these are rhetorical questions therefore a reply is not necessary or desired."We will not issue a full refund because they simply changed their mind."It is not that we 'simply changed [our] mind(s).' It is because the company has not performed a single action as contracted to do for months despite multiple inquiries by us including our concern of the threat of thousands of dollars in fines to us by the city for the contracted work not being done by the companyThis non-action has put an unreasonable burden on us and forced us to find another company to do the work to avoid these additional feesBecause of this nonperformance by the company and their refusal to issue a full refund it would appear that our only courses of action are a detailed account of this incident from July until now to be sent to the Attorney General as well as other sources and services and lastly through the court system.(It is interesting to note that the company was so busy on the 27th ("It is now 1:50pm and our phones are still ringing, keeping myself and Mr*** tied up answering questions...") that they could not return my call as they stated they would yet they somehow seemed to have had ample time that day to compose a detailed response to our complaint to the Revdex.com.)Regards,*** ***

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that the response would not resolve my complaint. For your reference, details of the offer I reviewed appear belowI filed a complaint on 12/22/against D&H Excavators. The complaint # is ***. They responded saying they would complete the job. There were several untrue statements in the response to the complaint. The sewer hoproject is not completeNothing has been done since the complaint date. Yesterday I was informed the money ($5000) was used for something elseThey do not have the funds to complete the project. My yard has large holesCan you reopen the complaint? I am not sure what to do

In response to reply sent by D & H Contractors:
To whom it may concern,
To begin, I was not aware the company was going to connect with a rubber fernco. The first time I had seen or heard the word "fernco" was in the response letter, which was not sent in a timely fashion. The problem was not corrected. I again had total blockage in my main line, as detailed in my initial letter. I'm now being told through this reply re: the cleanout that "... the pipe exiting the house had to be put in at an angle, leaving the mandatory cleanout at somewhat of an angle." This is the first time I'm hearing this, although I posed this question to Mr. Medcalf over the phone before I wrote to the Revdex.com; at that time no explanation was offered. I've attatched a photo to illustrate what I'm left with.
The statement made by the company spokesman in reply that "Mr. [redacted] is evidently blaming us for his tree roots growing" is an insult. If Mr. Medcalf possesses the experience he claims to have had, why could he not tell me I had a maple tree growing in my front yard; that maple is one of the worst possible trees to have next to a sewer line, and that my line blockage would reoccur? The complaint filed by this homeowner is very misleading. They did sign the contract in July of 2014. However, we made multiple attempts to contact them regarding the [redacted] check ($2766) used to pay the sewer connection fee. This is because we cannot pull their permit without the fee...

being paid. We did not receive the check for [redacted] until October of 2014. When we spoke with the homeowner after the check was received, we did tell them we would schedule them for the week after Thanksgiving. Unfortunately, the weather did not permit us to dig that week, nor did it allow us to maintain our schedule for weeks following. Now we are playing catch up since the weather seems to have let up for a bit. Now, regarding the check not being cashed for the permit, I do not send payment through until I am certain we will be on that particular job within the next day or two. I do this to keep the permit from expiring, thereby costing either our company or the homeowner an extra fee for renewal. I spoke with Mrs. [redacted] yesterday morning to let her know that the crew was behind schedule due to weather, but was finishing up the job scheduled before them, literally right across the street. This was unacceptable to her and she requested her deposit back, stating she hired another company. First of all, deciding to hire someone else to do the work is not a valid reason to cancel a signed contract and would never hold up in court. Second, we offered to give her a partial refund because yes, there were administrative fees. Namely, the sales commission, the pay to office personnel for time spent scheduling, pulling lateral locates, applying and pulling the permit, notifying utilities so they may locate underground wires and pipe on their property, as well as the time spent contacting and updating the homeowners. Mr. [redacted] did call back this morning and spoke to me. I informed him that the owner was on the other line and that he would get back with him. That was at 9:27 this morning. It is now 1:50pm and our phones are still ringing, keeping myself and Mr. [redacted] tied up answering questions on top of meetings that were scheduled for today. However, Mr. [redacted], has NOT called back since his phone call this morning. I have not left the office and have not let even one call go to voicemail. We have already pulled their permit. The job directly across the street from them will be completed today and we would've had the opportunity to move to their property as early as tomorrow morning. We will not issue a full refund because they simply changed their mind. If they'd like us to do their job as contracted, we will do so. If they'd like a partial refund, we will do so. I have documentation for their check and the dates written/cashed. My scanner is not connecting to the network for some reason, so I will fax them over after sending this response. Thank you.
