I took my client's engagement photos back in August as she mentions, then she and I talked about hiring me for her wedding photosThe contract and pricing included:
Continuous wedding day coverage up to hours
Engagement session: August 18, hours (2nd session at
no charge)
high-resolution photo files on USB Engagement & Wedding Daytotal
Includes: (1) 11xprint of engagement session (upgraded at no charge to a 16x20)
Can exchage print for: a(2) 8x
b(3) 5x
c (2) 5x& (1) wallet sheet
(1) 16xStandout engagement or wedding
(1) page book with pictures from both engagement and wedding day (which will be given once client receives all photos and can custom book with the images they want.)
Hours, mileage, extra sessions, hours editing, products is worth just about or more than what they paid, but I never over charged or gave them less.
The engagement session on 8/** was in Galveston, TXThen I offered another session at no additional cost and ended up in Spring, TX - they accepted the second engagement session.
I edited more than images and uploaded them in a private gallery for them to viewBride asked to unlock several photos so they could send for print and other published work, which I unlocked and allowed to downloadI have more than 2,photos to edit since I gave them an extra engagement session, a post wedding session and arrived to hotel where they were staying hours prior to ceremony starting(Arrived at p.mceremony started at 5) Took the Groom and bridal party only to a park nearby because bride was not readyAll guest knew I was there and all kept looking down instead of the cameraIt is not professional to wave or stop people as the ceremony is going on for photos - party is suppose to look at camera knowing that it is there for a reasonThe ceremony lasted about minutes to which after there was a toast made by the bridal party with the bride and groomNo time for family photos or many bridal party photos that included the bride because there was only minutes left of lightSomething that was explained to clients because the natural lighting wouldn't be available for longTook as many pictures as I could with the bridal party, but they needed to be at the reception by p.mwhich was across the streetThe reception was from - p.m( This is a total of hours total of continuous shooting after contract only stated hours) I arrived there and started taking pictures of all the details as bride wanted and had seen with my previous weddingsI photographed everything that she put in the agenda and within those hours I sat down for minutes to eat and get back to workA "Thank you" to her guest asking them to come up to their table to give them gifts was not in the agenda that was providedThe dances happen, along with everything summed up in hoursI asked the bride to take a few pictures and she then called her mom and sister and photos were taken with them as well as with her bridesmaids, but groom was not aroundSoon after it was time to wait for them outside as they made their exit with all waiting outside with sparklers.
During the reception I talked to both and offered to take more photos of just the two upon their arrival from their honeymoon to be able to give them more photos that were not possible to take on that day because of the time constraintsThey accepted and called one day before the tux was to be turned inI was not given previous notice just called on that day to say they were ready for their picturesI was not prepared and rushed home to get equipment and rushed in traffic to get to them on time before once again the daylight was gone, but I was too late and took what I could with the little light I had left.
Keep in mind all of these extra sessions at no charge are adding up as well as mileage that I never asked anything for because I did it out of kindness as I go above and beyond for all my clientsAll know that if I take a little longer in giving back their images it is only because I am trying to give them memories that they will enjoyI never said I didn't have any pictures, just that it was taking a bit longer than expected because I had other sessions and two major weddings prior to theirsWhen I received a message from the bride on my personal/private page I told her I had other sessions in front of hers that I was working onI received an "ok." I later received a message on my photography site from the groom stating that none of the pictures uploaded were the ones they asked forI continued to make them understand that I do not upload all pictures and just wanted for them to see what my progress was, but hadn't uploaded any new photos that I had been working onThis takes time to edit and then uploadI mentioned that I was taking more time then expected because I was giving them more than the contract stated, but they asked for me not to go out of my way as I would for other clientAgain, I don't allow my other clients to view the photos so they can select themAlso, I asked the bride whose photos I was working on to give me more time since I was going to be working on these clients whose wedding came after theirsThey graciously agreed and am currently working on all of this current client's photosUSB will be send out for them to choose the photos for their prints and book within the next week
As far as the comment on Social MediaI repeat this was done on MY PERSONAL and PRIVATE pageThe only reason why this person saw it was because she requested me as a friend since I took her first engagement photosI do not understand where she gets that I was posting bad things about them when I never mentioned their names or even if it was about themShe all of the sudden jumped to conclusions and wrote a very nasty comment on my photography pageAgain, two separate thingsShe mentions that my friends (again on my personal and private page) were saying horrible things about her, however none of my friends knew who I was talking about nor did they say horrible things about the clientIt is aside the point what I wrote on my personal page because it was simply stating to my friends and family that I would be taking a break to finish all the work that I had pending, paid and free sessionsHer bad comment about what was posted on my personal page is the reason why I blocked her off my personal page and it automatically blocked her off my photography page.
I am including parts of the contract where it states that they do not get to select the images edited and all other things that will give more explanation to the clientThis contract should have been read at the time they signed, not understand why all of the sudden things are said otherwiseAs far as me stating no one could take photos, I never asked them to do thatAll I asked was that they not get in my way when trying to take photos or use the flash as it would cause strange lighting with my flashThe groom's mother took her camera and was taking photos I never mentioned anything about no other cameras I will say that time was an issue as no 15-minutes was reserved for family photos or group photos in the receptionEverything was done at a fast pace, but could have offered those photos as I do for all of my other brides if they would have reserved time for photos
Responsibilities: Unless agreed upon in advance, Loveli Photography shall be the exclusive photographer retained for the eventPhotographer may bring one assistant at her discretion
Photographers must not obstruct or interfere with the official photography and are not allowed to
take any still photos during formal sessionsWedding guests may take photos, but it is the responsibility of Client to prevent family and friends from interfering with Photographer's dutiesPhotographer is not responsible for compromised coverage due to causes beyond her control such as other people's camera or flash, the lateness of the bride, groom, family members and bridal party members or other principles, weather conditions, schedule complications, rendering of decorations, or restrictions of the venues or officiatePhotographer is not responsible for existing backgrounds or lighting conditions which may negatively impact or restrict the photography coverageClient agrees to confirm the schedule one-week prior to the event and to send the Photographer a copy of the invitation prior to the weddingNotification of any changes in schedule or location must be made in a timely mannerChanges can be made by phone with a follemail for documentationIf email is sent, confirmation of receipt must be obtainedCoverage: Photographer will provide coverage for the dates, locations and continuous hours specified in this AgreementAdditional travel or coverage hours may be added by agreement on the wedding day and must be paid in full before any photos or products are released to the ClientEvery reasonable effort will be made to take requested pictures, but no specific pose or photograph can be promisedAny lists supplied will be used for organizational purposes onlyImages determined by the photographer to be substandard or duplicated may be edited outThe Photographer will use her professional judgment and sole discretion to select which photos to deliverSuch selection shall constitute all images that will be made available to ClientImage Processing/Printing: Unless agreed upon prior to any editing work, high-resolution discs and/or proof sets may contain a mixture of color, black and white, and selective color imagesAn alternately colored version of a photo may be purchased at the current rateLimited color correction and/or retouching are included at Photographer's discretionClient may request further changes for an additional chargePhotographer is not responsible for any prints that are not ordered directly from herFor best results, clients with the high-resolution files should order their prints through a reputable labClient will receive (1) 11xprint from engagement and has the option to change for other size prints, (1) 16xstandout of engagement of wedding photo, (1) page book with pictures from engagement and wedding day, images on a USB drive that include from the engagement session

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
I summarized the events in my complaint leaving out all minor details and my emotions to keep the complaint strictly professional. I also stopped all communication with Loveli Photography as of February **, 2014 which was the last time my husband emailed her. There are details about the response from Loveli Photography that would be considered hearsay. I am aware of my rights as a consumer. I have decided to exercise my constitutional right to have a judge of my peers decide who is correct in this situation.
