Review: In March of 2014 we hired DK Home Improvement to do some work at our new home as soon as we closed in April. The owner, [redacted], came to the home to discuss the work we needed completed and we requested an estimate. We never received a professional, written estimate but we did verbally agree on the following:

Total Budget $6500 ($3500 materials & $3000 labor)

Install bedroom doors (x5), trim out basement windows (x5), trim out master closet door, install base trim, repair gouge in floor and install cover on top stair, patch and repair damaged drywall in entry way, help my husband move shed in backyard, and order and install vinyl-coated chain link fence.

On May 1, 2014 we gave him a $2500 check to cover the fencing materials.

On May 16, 2014 we gave him a $1000 check to cover additional materials.

On May 23, 2014 we gave him a $1500 check to cover half the remaining balance for labor; assuming we would give him the final $1500 when all the work was complete.

When we hired DK Home Improvement, we made it very clear that the fence was our priority and we expected him to set aside time for our job to get done in a timely manner. He advised us it would take two weeks for the fencing materials to arrive and that it would take him an additional few days to install the fence. In the meantime he would work inside the home.

We later discovered that DK had ended up ordering our fence from an online company and had no idea when the order would ship; not from Lowe’s with a two week delivery as he had advised us. As we waited for the fence to ship he would come out here and there to do some work around the house, but he was very inconsistent and we quickly realized that our job was not a priority for him.

He did do a fair amount of work in our basement but a lot of the work is unfinished. This includes some damaged and untreated base trim, untreated doors and door jambs, doors that don't close properly, trim and handles on the closet door not installed, trim that was installed with glue and cardboard, insulation under stairway was not installed, gouges in the entry and kitchen floor that were not repaired, four basement windows that were not trimmed, two laminate transition strips that DK damaged and did not repair/replace, and lots of exposed nail holes and joints throughout the basement.

The fence finally arrived on June 11, 2014 and he got started on the installation. As he was laying out the materials he advised us that he was short on supplies and he would not be able to install posts every 8 feet as we had discussed. Apparently he had not measured correctly and did not order enough material. We also realized that he had not ordered or planned on installing a bottom tension cable to keep the fence tight at the ground; which was very important to us as we have a toddler and were afraid the lose chain link would not be able to contain a child if he was pushing against the fence. While working on the fence, I could see from the window that [redacted] was very upset about something as he was stomping around and throwing his equipment into the newly seeded patch of grass by our shed. I went out to see what was wrong and he was cursing about how our neighbor had touched his string for lining up the fence posts and that the fence would be crooked now. It was very uncomfortable.

After two days of working on the fence [redacted] advised me that he was taking a better paying job on Monday and he would need to hurry and get as much of the fence done as possible and the rest would be on us to finish. He said he would be gone a week and then would be back to finish the work in the basement. When he took off that day, he did not come to the door or say anything to us about what was left unfinished. I just noticed he was gone and I went out to look at the fence. He had not tied any of the chain link to the posts or rails and we had to do that ourselves. We also had to spend time picking dirt out of the neighbors lawn as DK tossed piles of dirt outside our property line and left garbage and debris when he left our home. Several of the posts were not lined up straight or level. There was also a large damaged section of fence where he had pulled too hard with his stretcher and pulled apart some of the links.

We finally heard from [redacted] about a month later on July 11, 2014 via text message. At that time we advised him that we didn’t want to continue anymore work at the home. I later received a text threatening to bill us for everything separately as change orders and not part of the initial agreement.

A couple weeks later we received an invoice for an additional $2193.80. We then sent him a letter, expressing our dissatisfaction with the work that was left incomplete and the damage that was caused to our home and fence. We explained that we would not be paying any more money in addition to the $5000 we had already given him and we did not agree with the additional charges he was trying to invoice us for.

On October 3, 2014 we received a notice from CBB Collections that DK had turned our invoice over to collections. We have sent several letters to CBB explaining the situation and that we are not responsible for the additional charges. As of today DK is still pursuing the collection and we are continuing to receive letters and phone calls requesting us to pay the balance plus $76.33 in interest.Desired Settlement: At this point we would like DK to remove our account from collection and adjust our invoice to $0 balance.

This is a complaint coming from a customer that refuses

to pay their overdue bill, which was sent to collections. Rather than paying

their bill, which is rightly owed to DK Home Improvement, they are using their

time placing slanderous ads. When the homeowners moved into their new home

there were some items needing completed/repaired throughout the home and asked

about installing a basic chain link fence around the perimeter, which were

assessed and a budget agreed upon. After such discussions, the homeowners

decided they needed a vinyl-coated fence, which DKHI warned would be

significantly more expensive. This was not a problem, as this was a necessity

to contain their toddler. DKHI let the homeowners know in advance that he would

be gone on vacation for a week or so but that he would get the fencing

materials ordered, which they were fine with.

Between the time the homeowners moved in and DKHI came to

do the walk through, the homeowners had managed to create SEVERAL holes and

abrasions throughout the home due to carelessness while moving furniture and appliances,

which were added to the list of things needing done. These things included a

gouge on the banister at the top of the stairs, gouges in the tile in the

entryway, and gouges in the dry wall.

While on vacation, DKHI researched fencing material and

AS DISCUSSED, Lowe’s did not carry the specific material the homeowners

requested so found another company that carried it, and for a reasonable price.

It was ordered and the homeowners were kept informed as the information came in

to DKHI. A couple weeks had passed and the fencing materials still had not

arrived. DKHI had sent emails and placed phone calls to the fencing company and

they were very difficult to work with. Finally, approximately a month later,

the materials arrived and the fence was put in. In a perfect world,

distributors ship the materials when the homeowner wants them. Unfortunately,

this was not the case and beyond the control of DK Home Improvement.

As the work was being completed, the homeowners came up

with SEVERAL additional items they wanted DKHI to complete, including (and not

listed on the complaint for some reason) installing a wall mount and television

in living room, installing a broom and mop holder in the upstairs hall closet,

installed a cat door, etc. These things take additional time and materials,

which therefore, cost extra money.

In the end, DKHI used many of their own materials and

spent extra time making sure things were done to the specifications of Mrs. Homeowner,

which were added and changed daily. In

speaking with some of the neighbors, it was quoted that “She will never be

happy.” DKHI worked around Mr. Homeowner’s schedule, as he often worked night

shifts and slept during the day. DKHI was very generous with the end bill,

considering everything that was added and the circumstances with which they had

to work. The complaint states “a lot of work was unfinished.” Perhaps when Mrs.

Homeowner sent a text that said they didn’t want any further work done, this

may be an indicator why it was “unfinished,” not the choice or the mode of

operation of DK Home Improvement. They were given ample opportunity to pay their

bill, and at a VERY appropriate rate. Unfortunately, in doing business, if the

goods are not paid for, further action must be taken, hence sending this

account to collections.

The repairs in the entry

way and moving the shed did come about after our original meeting with [redacted] but

our agreement was to add an additional $500 to our budget to cover the

additional work, which we are fine with.

Other than that nothing

else was added to the agreement. We never wanted a standard chain link fence.

We had debated between vinyl and vinyl coated chain link depending on

price.

We were not told the

fence was not going to be ordered from Lowes or a local company. We found out

several weeks later after asking him numerous times what the status of the

order was. Obviously we were very disappointed as we never would have agreed to

that. We had received a quote from a local fence company for a vinyl coated

chain link fence for $3500 and installation beginning of June. [redacted] had

guaranteed he could beat the price and we would have a fence in about two

weeks. Both of which he failed to come through on. Why doesn't [redacted] address any

of our concerns with the fence in his response?

Installation of the cat

door was always part of the contract, we had already decided to have that done

before we even bought the house and we went out and bought the cat door

ourselves.

As far as hanging the TV

bracket, we were never advised of any charge. Basically [redacted] offered to help

hang it up and never mentioned charging us. If we had known that, we would have

just had my husband do it by himself. This took about 30 minutes to drill a

couple holes in the wall.

The mop holder is a bit

ridiculous and shows his true character. I had asked to borrow his drill as we

did not have one available during our move. He said yes and before I knew it he

had hung the holder up himself. Took about 3 minutes. If he feels $15 is truly

necessary than I guess we will pay that.

These items were all

purchased on our own so I'm not sure what additional material costs [redacted] is

referring to.

The

reason we asked [redacted] to not continue working at our home was due to the

hostility he was showing in the last days he was working for us. His anger

towards our neighbor, his disregard for our lawn and carelessness while

installing the fence in the middle of the night because he had another job to

get to, and the fact that we had not heard from in nearly a month to come

finish the work. We decided it was in everyone's best interest to discontinue

working with this man due to his unprofessional work ethic and disregard for

quality of work performed.

I do not understand what

hearsay from a neighbor has to do with anything. I also do not understand why

the professional contractor I hired would be engaging in complaining about me

with my new neighbors.

How can [redacted] justify

charging us more than we ever agreed to for work not finished and a fence that

was not properly installed? We are not just trying to get out of paying a bill.

If [redacted] would have devoted the time needed to come out and get the job done in a

timely manner, despite our concerns with some of the quality of work, we would

have paid him the full amount agreed to and he would have made a good profit.

Instead he chose to continuously blow us off and drag the job out over three

months. Then when he got mad he decided to renege on our verbal contract and

came up with an invoice with inflated numbers.

Again we request our

account to be removed from collections immediately and an updated invoice be

sent reflecting numbers based on our agreement and consideration of the work

not completed and done poorly.

The response from the business is the exact same as his original answer. He is not willing to compromise or honestly consider how he mishandled his job performance or keep to his word regarding the price. So no, we do not accept this resolution.
