well aware that our company is closed for business during the winter season.  Another thing she did not mention is that we have tried on 3 occasions to set up a meeting with her.  The owner tried to contact her on the first attempt, then SHE was not available on the second attempt as you can see in the attached email.  On our third attempt to meet with her she simply didn’t respond.  Ms. [redacted] has also neglected to mention that she actually scrubbed the surface of her concrete to get the spots from the leaves staining it off which would greatly impact the integrity of the surface of the concrete as she did this in November which is well before the concrete had time to cure.  This action would also impact the sealer.  Our estimate/contract that our customers sign before we do the work clearly states that the customer accepts full responsibility for damage due to weather and having leaves shower down on the concrete while it is being installed is most definitely an act of nature.  While our crew was tearing out the existing concrete the previous day the leaves were not falling as heavily or we would not have tried to put the concrete back. The fact that the owners grand-daughter and her father stopped by has no bearing on any of this because her father is actually a concrete contractor as well and knows not to interfere with the job at any time the concrete needs attention.  He would have actually helped if need be.  They were only actually there for twenty to thirty minutes and his grand-daughter is allowed to stop any time she wants.

she never responded to our second request.  if she has provided a copy of an email then she has created it for the purposes of this complaint.  He would have been there had she responded to my second email and I supplied a copy of that email in my last response.  It was sent to her just days before she filed this complaint. As I told the BB representative during our discussion I believe she didn't respond because she filed this complaint.  I also [provided documentation to prove that she had stated she was having trouble with her email.

I did respond back to them both times they contacted me about coming out.  (see attached ref 2nd)   I cant prove they 'got' the 2nd one but if not, its the first time ever that they didn't.    (I have approx. 20 emails back and forth & they never missed a reply b4).     as for scrubbing the porch, I had leaves staining the porch right at my front door where my welcome mat sits.   I only used a green scrub pad for dishes and some dawn dish washing liquid directly in front of the mat where the porch was stained.   I certainly did 'not' scrub the entire porch.  in fact in the place the mat sits where I did try to remove the stains, there ARE NO missing spots of concrete, it 'is' everywhere else on the porch however.     and yes I did know they close for the winter but I contacted them several times b4 they left, and was told that he'd try to stop by, or he was too busy, etc etc. for the 3 or so weeks b4 I received the mid-December email saying that 'if' I was still unhappy in spring 2017, he would come out then.   last year Janet told me that they work march-oct, weather permitting.   it was very nice in November with many opportunities he could have come out to see the porch but they put me off.    there were also many nice days in March so I began emailing them then.    I was told that if and or when doug was already in my neighborhood giving estimates he would try to stop by.  I'm sorry but they got my money back when they did the job; then when notified i'm having problems with the job they did, i'm like a 2nd class citizen, made to wait behind other folks he is signing up for new jobs.    the reason the porch is having so many problems is that the sealer WAS put on the driveway, but 'NOT' applied to the sidewalk or porch.   I didn't notice it at the time as I was inside the house most of the afternoon.   but there was (and still is) a very distinctive difference in appearance to the driveway vs. the sidewalk and porch.  its because the water soaks into the concrete on porch and sidewalk BUT NOT the driveway.    the water soaks in and then in spots where leaves dropped, as they were putting in the porch, water has seeped in under and is lifting and breaking thru the concrete.   and I've had 3 contractors agree with me on that.    as to how long the son in law and granddaughter were there, they were sitting out by the street in lawn chairs talking and I actually thought it was some of my neighbors asking doug about concrete work possibly for themselves.    and 'thinking' it was my neighbors keeping him from his work for so long, I called out, 'what, are we serving drinks on the lanai now?', hoping they would move along.   it 'was' more than half an hour.   #yiv2735127996 #yiv2735127996 -- filtered {panose-1:2 4 5 3 5 4 6 3 2 4;} #yiv2735127996 filtered {font-family:Calibri;panose-1:2 15 5 2 2 2 4 3 2 4;} #yiv2735127996 p.yiv2735127996MsoNormal, #yiv2735127996 li.yiv2735127996MsoNormal, #yiv2735127996 div.yiv2735127996MsoNormal {margin:0in;margin-bottom:.0001pt;font-size:11.0pt;} #yiv2735127996 a:link, #yiv2735127996 span.yiv2735127996MsoHyperlink {color:#0563C1;text-decoration:underline;} #yiv2735127996 a:visited, #yiv2735127996 span.yiv2735127996MsoHyperlinkFollowed {color:#954F72;text-decoration:underline;} #yiv2735127996 span.yiv2735127996EmailStyle17 {color:windowtext;font-weight:normal;font-style:normal;text-decoration:none none;} #yiv2735127996 .yiv2735127996MsoChpDefault {} #yiv2735127996 filtered {margin:1.0in 1.0in 1.0in 1.0in;} #yiv2735127996 div.yiv2735127996WordSection1 {} #yiv2735127996

READ YOUR CONTRACT.  it is specific about acts of nature.  If D&M installed your window and an hour later a bird flew into it and busted it would you expect us to replace it? NO.  when we are finishing concrete and leaves fall out of YOUR tree and get all over the concrete we are only expected to do our best to remove them which we did.  Your porch has plenty of gravel, you witnessed us installing it.  you saw us hand remove the old porch which had 10 to 12 inch footings around the edges. Also, as far as returning to your home for an inspection if you will remember when Janet set up the original estimate she put you on a schedule and assigned an approximate time for your estimate and this time is based on a map that she does every week to get me all of the places I have to go in one day.  We have tried three times since March and you were not available once and didn’t respond the other times.  You can see in the email that you sent that you were having trouble getting emails so maybe you just missed them but if you don’t respond then you don’t get put on the schedule.  As far as 3 contractors who supposedly are experts about concrete I will gladly accept their names and phone numbers so that I can call and verify their expertise.  For the more than 28 years that my aunt was a judge in Indiana she heard from hundreds and hundreds of people who said they had experts only to be proven later to be novices.  If they are concrete experts they wouldn’t have to do other work at your house as there is plenty of money to be made in concrete right now. I spoke to my son in law who swears that he was there for 20 to 30 minutes but what type of person are you to bring up someone’s granddaughter stopping by the job to give kisses and are you somehow suggesting this caused your tree to drop leaves on your concrete?  as far as you thinking it was your neighbors after speaking to them they would never step foot on your property because they refer to you as the crazy lady.  After all the false accusations you have made against me I believe them.  I have instructed Janet to cease communications with you on this matter because her time is better spent on true, factual and warrantable situations.
