Case is being mediated through the Massillon court today. Closing case

I am rejecting this response because: June 2016 D. Rielly Plumbing was contracted to rough plumb a duplex of [redacted]..  On June 6, 2016 I paid Mr. R[redacted] $3,890.00 as down payment to start the rough plumbing.  1867 is a duplex which consist of a one bedroom, one floor apartment on one side and a 3 bedroom, two story apartment on the other side.  The rough plumbing also consisted of him finishing the plumbing once the insulation and drywall was done.  At no time was this price only for the first floor apartment nor did we ever discuss not romoving the main stack.  Another 300.00 is nothing to pay when I just paid him $8,220.00.   On June 20, 2016 Mr. R[redacted] was done with rough plumbing and paid the balance of $4,330.00.  This price included his labor, material for new pipes of plastic, two tubes and two hot water tanks.  I do alot of my own work so when this rough plumbing was done and new electric I then could finish.  The one bedroom, one floor apartment was finished in the spring of 2017.   The one floor apartment, one bedroom was rented and I personally had to hook up the sinks and toilets because could not get D. R[redacted] back in a fashionable manner and had to get this rented out.   In November of 2017 I finished the other side which is a two story apartment and the bathroom is on the second floor which is over the kitchen and living room of the one bedroom.   Mr. R[redacted] was called back out to finish hooking up sinks, toilets, etc.   The first week of December Mr. R[redacted] came to finish the plumbing.  Him and his son Dan R[redacted], **.   I questioned both of them about the toilet flange because it was rusted and not changed out.  They both assured me that was their job and not to worry.   Of couse knowing the bathroom was over the first floor apartment I did worry because the flange was rusted but at no time did I know that the main stack was not changed out as why would I know.  Im not the professional plumber, they are.   Dan asked me to pay another 300.00 because he needed more material so I did. which now I paid him over $8,500.00.  When he left I noticed my sink was not hooked up and called him and he said he was leaving for Vegas and would get to it when he got back.   Working in my duplex putting installation in the attic of upper floor behind bathroom wall of upper floor I noticed my antique water tank was cut out which was there 2 weeks prior because me and my boyfriend had made a comment about it and how cool it was.  I never advised D. Rielly to cut it out and take it.  He said he would bring this back and did not until I filed a police report.    This was well over a year since he put the rough plumbing in and removed all of old plumbing.  I sent him a text message and he responded by saying "Still in Vegas but I will call you to set time to finish sink and bring tank back.  Sorry I didn't think you wanted it.  I collect antique plumbing tools and materials.   Then on December 15, 2017 after he sent his son to install sink is when I was running water and trying to get hot water (which by the way the bathtub fawcett was put on wrong) that I realized I had no hot water so I went to the basement down stairs and realized water all in basement and coming through floor boards.    Mr. R[redacted] wanted to charge me another 800.00 to fix something that should of been replaced in the first place.   Again, we never discussed the main stack.  This is his job to know this and I hired him to rough plumb which means change all the old plumbing.  THis house is 118 years old.  Common sense should tell a licensed plumber to do this.  Secondly, he did not do a seal or water test or he would have known this and not been so confident that I should not worry, that was his job.   He did not do his job and he is a thief.  He overcharged me and then stole from me.  If he was to remove all old plumbing why did'nt he removed in June of 2016 when he removed and replaced other plumbing.   Because of him not doing his job, the one bedroom could not be re-rented out because of damages to ceiling and had to tear down wall to change stack.  Lost rent for January and February which cost me $1,230.00.00 in rent plus the labor and material to drywall and paint.   Could not rent the 3 bedroom until February  because had to rip floor out to get to stack and therefore lost rent for January and February which was another $1,500.00 in rent plus repair cost.    I have attached receipts, pictures of hole in stack and crack and also his response admitting to taking my antique water tank and please note the date is over a year later than original work.

Tell us why here...                Approximately a year and a half ago my company was contacted by Ms [redacted] to quote a plumbing job on a 2 unit (up and down) building that she owned.  The job consisted primarily of...

re-plumbing drains and water lines in the downstairs apartment.  During the inspection while preparing the quote, it was discovered that the pipes were old and all cast iron, of which would be replaced with pvc pipe.  The downstairs stack was leaking and obviously needed repair.  At the time of preparing the quote it was stated to Ms [redacted] that the upstairs stack was old and should be replaced.  The extra cost would have been approximately $300.00.  Ms [redacted] said that money was tight and if is not leaking then leave it.  Subsequent to this conversation with Ms [redacted] a bid was submitted to her for $8,500.00 which did not include replacing the upstairs cast iron pipe.  Our company performed the rough plumbing that was approved by Ms [redacted] and instructed her to contact us when the drywall, floors, painting, ect was completed and we would complete our finish plumbing. Although we  seal tested our work that utilized plastic pipe, we did not seal test the plumbing that had the cast iron pipe as cast iron pipe, even new cast iron pipe, cannot be seal tested as it never holds a seal. Approximately one year later, Ms [redacted] contacted us to complete the finish plumbing of which we completed.  during our clean up, we removed an old water tank that appeared to be junk.  We received a call from Ms [redacted] accusing us of stealing the water tank that she claimed to be an antique.  I assured here that we did not discard it and that I would return it to her when we were in her area next.  Having not returned it to her in a timely enough fashion for her, she called the police and reported it stolen by us.  After being called by the police on this matter, I personally took the water tank to the police department and left it with Officer [redacted], who said would contact her to pick up.                We finished the rough and a year and a half later she contacted us to complete the finished portion of the job ( set toilets, sinks ect.) I was then contacted by Ms [redacted] complaining that the upstairs stack that she did not want to replace was leaking.  I reminded her of her decision to myself and another employee, of her decision not to spend the extra money to replace the stack.  She replied, “you should’ve changed my mind”.  I told her that because the drywall had to be removed then replaced, the cost to replace that stack would be about $800.00.  She did not accept our proposal to replace that upstairs stack.                 Although at the time of the inspection of this job, the undersigned and another employee specifically and emphatically recommended replacing the upstairs cast iron pipe, Ms [redacted] did not want to spend the extra money.
