Dear *** ***,
I hope this email finds you well and thank you for allowing me the opportunity to relay the events which took place regarding the *** residenceWe were contacted about an upstairs toilet that was backing up into a tub and leaking
into
the ceiling below on 1/6/On 1/7/we augured the toilet in the guest bathroom and removed the original wax seal that was not properly installed and we reset the toilet
The homeowner stated, "Nearly immediately after completion of "guaranteed work" both upstairs toilets, showers, bathtubs, and sinks flooded waste water on both floors causing extension damage requiring drywall removal and carpet treatment." This damaged was not caused from our work involving the unplugging of a toilet and resetting of a wax ring! We returned to the home at the OWNER'S Request on 1/21/to find the source of the flooding of waste water We used the camera down the toilet drain and saw there was a broken back flow preventer we also went under the home where the sewer line was and we found sewage coming through an openingWe dug down along side the owners rockery on the left side facing the homeWe could not locate the leak at that locationWe then needed to remove a tree (which the *** authorized) on the right side of the rockery to try and find the source of the leakAfter digging along the right side we came to the conclusion the leak was directly beneath the rockeryIn order to repair the leak the rockery would need to be removedAt the owners request we contacted *** *** *** to get an estimate for the rockery removalThe estimate we were given was for which half was required by *** *** on the day the work was to beginWe tried contacting the *** by phone on 2/5/to get an email address to forward the estimate from *** ***, the amount needed fro *** *** to begin, and a timetable for the repair workWe called multiple phone numbers and left multiple messages that we needed them to call and discuss the plan for moving forward with the workWe received no return calls on 2/5/On Monday 2/8/we finally received a voicemail with the *** email addressI then sent the email with the estimate and timetable information so we could get a confirmation that the job was a goWe never heard back until the *** did not want to pay the bill for all the work we had previously done to locate the sewer leak, which included the camera, the digging on both sides of the rockery on multiple days, and tree removalWe were not responsible for the damage the flooding did they had serious problems with their sewer that we were actively trying to help them solveWe are requesting payment for the work we did not anything moreThere is no grounds for them not to pay their billWe wanted to finish the work and repair the sewer leak but never heard back from them
We have all of the invoices, the estimate and email communications that transpired between us that we have attachedAlso the *** told me that they were not going to pay a Slab Jack they hired to do work, I guess I should have realized this seems to be a pattern with themThey clearly knew the work we were doing was not free and we were in NO way responsible for a leak in their sewer that caused water damage

All that followed were days of unfulfilled promises to locate the problemDespite multiple requests for a written estimate for any additional charges the response was always "more time was needed to locate the source"At no time did contractor ever provide requested written estimate for any pending and/or future chargesThe invoice claims now being submitted were provided after the fact to the homeowner, days after contractor failed to respond to previously attached final email request for a written estimate."
As we stated before we charged for work we did at the Sakamoto residence we do not bill for work before, we bill after the work is done.We could not complete the work as the homeowners could not be reached by phone or emailThey wanted an estimate for their rockery to be removed and we provided them with that estimateNever did we ask for dollars that is a completely statementAgain the rockery company required half down for work to beginWe tried to reach the homeowners so the equipment could be dropped off, the rockery removed so we then could do the repairThat repair never took place because they never called us backthat does not negate the fact that we did previous work to locate the problem which is the bill in questionWe are not asking to be paid for a repair we didn't do only for all the time we spent on multiple days helping the homeowner locate the problemWe will turn this over to our attorney if we do not receive payment

Unsubstantiated personal attacks on our family name are completely falseAll parties who resolved the mess left behind by said contractor have been paid in full at the agreed upon estimateAs a matter of principal, the plumbing contractor who completed the job was compensated for additional time and material well above his original written estimate due to main break never identified by original contractor requiring significant additional resourcesIn spite of increased final project scope, work was completed by replacement contractor within hours while original contractor walked out on consumer over one month after issue was first reportedAs a contractor, 30+ year homeowner, and man of faith, one's reputation stands above all elseAt no time, have any contractors and/or bills associated to me or my wife have ever gone unpaidThis can be substantiated through our employment history, tax records, credit scores, public records, and social mediaAll statements to the contrary are completely fabricatedThe previously submitted email attachment from Feb8th illustrates the continued misstatement of facts and unreasonable communication throughout the processThe content of the email brings to light suddenly requiring an immediate same day check for $4K made out to a newly named 3rd partyClearly this should have been mentioned during multiple conversations up and thru the previous business day to allow homeowners to discuss and research over the weekendAs usual, all homeowners received previously were conflicting messages whether a landscape contractor had even been contactedPlus continued promises to fix the problem never materializedWith excuse after excuse backing unsubstantiated claims such as the alleged video were "lost".The second email attachment further substantiates fact that contractor failed to respond to final written request for detailed estimateFailing to get any type of return communication, homeowner reached out to several reputable industry experts who satisfactorily completed all work within hours-Consumers Rights Matter
