I, David Porzio owner of D.A.A.CLandscaping & Snowplowing am writing in regards to *** *** complaintThis project was not beyond my level of expertiseWe just needed other equipment to handle the job that I brought back the next dayWe did not know the cinder block wall was filled with
concreteI did explain to *** that some of her landscape would be lost as we would have to dig to feet behind wallWe did not leave the property a mess cleaned up at the end of each work dayWe had to wait for the gas company to move a gas line because it was only foot from wall and in the way of excavationThis took them about weeks to doWhen we returned to complete the work she was not happy with some of the block saying that they were different colorI told her they were just dirty and I would power wash them and clean them up*** said no that she wanted them replaced with new blockI then ordered new blockBefore the block came in she called and told me she did not want me to finish the projectShe told me that she would pay me for the materialI gave her the price for the material that was on hand she paid I apologizedThe job was a little more than half finished when she asked me to not come back this was at the end of JulyI am an honest and reputable business man running an honest businessI have many of satisfied customers that will attest to thatThank youDave Porzio

Dear ***:
Please be aware that I have received your letter including *** *** ***’s/Owner D.A.A.CLandscaping & Snowplowing letter/response to my complaint It is March 30, and I want to let you know that D.A.A.C did come out to “SnowPlow” my driveway and shoveled the front walk in the A.Mon March 30,however, I am disappointed because his “SnowPlow” driver/worker left a large dumping of snow in the street in front of my curb area after “Plowing” my driveway. It is illegal to dump snow in the street in the City Of Buffalo, therefore after his “SnowPlow” guy did my driveway and left I had to get out there and “Hand Shovel” the large mound of snow he left on the street. The following is my disagreement statement regarding *** ***’s response/Owner DAAC Snowplowing to my initial complaint: It is obvious that *** *** is not taking any responsibility for my customer concerns and dissatisfaction with “Snowplowing” my driveway. I did mention/reference in my initial letter of complaint the term “Snow Removal”, however, this was a typographical error. I fully understood that *** ***/D.A.A.CLandscaping & SNOWPLOWING services was to Snowplow my driveway.
The main focus/issue regarding my complaint is as follows: *** *** mentioned in his response to my complaint that he came out more than times. His business did not come out more than times. And yes, I did have to call *** *** to remind him to come out to fulfill the contract “Snowplowing Agreement” I signed with him and paid in full. If I did not make reminder calls to him, nothing would have been done. *** *** denies that he left huge piles of snow on the sidewalk initially however the first time there was a heavy snowfall one of his workers left a huge pile of snow on the sidewalk I called him and told him that it is unacceptable for him to do that, he attempted to justify by stating “well when the snow is too heavy like that we cannot help the snow ending up on the walk”. I responded to him that is a ridiculous and unacceptable excuse and that I expect him to advise his workers not to leave huge amounts of snow on my sidewalk. He then responded “O.K., I will discuss it with them and take care of it”. I still had to clean up/shovel snow from my driveway and sidewalk any time his business came out.
*** *** stated in his response to my complaint that “she did not have to park in the street”. Yes, I did park in the street, walked through heavy snow to get through my driveway and had to call him to tell him I could not get in with the car and asked him to come out to “Plow” the driveway. It was not just due to the city plow blocking me in as *** *** claims, it was due to the “whole driveway” not being done. *** ***’s snowplowing workers did not come to “Plow” my driveway before I left for work, it was always after. On weekends, if I had to go to a.mor 12:noon church I had to call him. *** *** did not respond to my complaint honestly. He did not come out when most needed which is expected before work. He did not “Snowplow” my driveway any where near my customer expectations which should be expected for a customer with a paid contract. *** *** seemed to expect me to accommodate him versus me the customer having paid a contract and I being the customer who hired him.
*** *** claims he asked me during the Blizzard Storm on 3/12/when I called him “Do you need to go anywhere” He did not ask me that question and he certainly did not state he would ensure to get me out before I left for work in the morning. If *** *** would have stated he would be out to my residence later after greater amount of snow/ on 3/12/Blizzard before a.m leave for work this would have been enough to appease me, but he did not. He kept stating to me “Yeah, we are out, we will be there”. If he were “Out” during the snowfall on 3/12/why did he contradict himself by telling me the third time there was a “Travel Ban In Effect”. There was no travel ban and definitely questionable as to why he would state “Yeah, we are OUT” three times and then use the excuse “there is a travel ban” and I was told by “Ms*** ***/Call Action” Investigator of whom I sent a Customer Complaint about this issue that there was no travel ban in Buffalo or surrounding area. By the way I live in Buffalo, if *** *** is not allowed/licensed to do snowplowing in Buffalo, then he should not have told me he can do SNOWPLOWING at my residence. *** *** stated in his response he follows the laws, he does not follow the laws. THERE WAS NO TRAVEL BAN as *** *** *** * ***/*** * *** verified this in response to this same complaint.
I am dissatisfied and appalled and *** ***’s sarcastic, disrespectful manner in which he spoke to me during my attempts to resolve my issues with him and/or services. *** *** *** * ***/*** * *** told *** *** I was not pleased with his sarcastic comments to me and poor communication. *** *** told me that *** *** stated he would contact me about my concerns and try to resolve. To date, *** *** has not attempted to call me or contact me
*** *** also stated in his written response to my complaint that he “cleared my sidewalk as a favor”. I did not expect any favors from him and he never indicated to me that this was not part of his service and an additional charge is added to do the sidewalk. *** *** lacks good business communication
This is what the issue is about: I was dissatisfied with *** ***’s poor business tactics and lack of snowplowing services according to what he promised verbally as well as what he would provide according to the contract I signed with him. *** *** told me he would stake/mark my driveway before he began the snowplowing at my residence. When I called to advise him that no one from his business came to stake my driveway before November 1, 2013, he stated, I do not know why my daughter never staked your driveway? He never came out to stake my driveway and I had to purchase my own orange stakes at Home Depot and staked my own driveway. *** *** has broken a lot of promises he made to me regarding what he would do according to the contract and his services I would have been more satisfied if *** *** would have mentioned to me or communicated to me on Blizzard Date 3/12/that he would be out before the next morning. He did notHe never was concerned about my medical issues He had a defensive comeback for every concern I listed in my complaint and took no responsibility for his sarcastic communication, inappropriate business tactics and broken promises to me. He certainly had no problem taking my $dollars of which I paid to him for the signed agreement/contract Bottom line is, I don’t like irresponsible business practices and will not hire him again, nor will I recommend D.A.A.Cfor “SNOWPLOWING” to anyone else. I think it should be expected for me to receive at a minimum an apology for his lack of good customer service. I also think that *** *** should reimburse me for the cost of the orange stakes of which he stated he would do/provide as well as reimburse me for one day of snowplowing that I had done due to him not coming out on 3/12/
It is ridiculous that I should have to go through all of this frustration due to *** ***’s lack of appropriate customer service to me and/or ability to take responsibility for . However, I feel it is important for my customer concerns be known. It is expected for customers to be spoken to appropriately and if *** *** were a responsible businessman he would have attempted to contact me to resolve in a more respectable manner. He failed at taking this responsibility. And, Yes of course I am going to complain about lack of SNOWPLOWING services, poor communication from DAAC. I had to shovel at 11:00p.m., on handicapped feet, despite paying *** *** $for the SNOWPLOWING Contract. I do not complain for no reason. And I do not pay large sums of money for nothing

I, *** *** owner of D.A.A.CLandscaping & Snowplowing am writing in regards to *** ***’s complaintI do have a 2013-contract with *** *** for snow plowing not for snow removal(As in the contract you can see) Her driveway was plowed times, not counting the times we were there to clear the end of her driveway after she called because the city plow went byWe went every time she called to do that for her
*** did not have to call and remind me to come and plow her driveway and I did not leave snow on her sidewalk as she stated and I know this because her front walk was also cleared by usThe only time the plowing got done after she went to work is if it was a later heavier snowfall between 5&7am in which my contract states there may be delays with excess accumulationsThe only time she had to park in the street is when she got home and called to ask if we can get the end of her driveway because the plow went byAs I stated before it got done
As far as the second Blizzard Storm, when she called the first time I asked her if she needed to go anywhereShe said, “No not until the following morning,” I said “ok you will be plowed out by then.” She called the second time I told her, “We will be there later.” When she called the third time I asked her, “have we ever not showed up to plow your driveway?” She said, “no but why is it not done?” I replied “there is a lot of snow out here and there is travel advisory and driving ban in effect.” (Erie County had a travel advisory and Cheektowaga had a Driving ban in effect.)
What people may not know is, when there is a travel advisory or driving ban in effectIt includes private contractorsJust because we have a plow on our truck does not give us a free pass to driveWe have to follow the laws like everyone else
I am an honest and reputable business man running an honest businessI have many of satisfied customers that will attest to thatI did not get this far by taking people’s money and not do the job I was paid to do
In conclusion I feel I went above and beyond for this customerI cleared her front sidewalk because she told me she was Handicap and has Medical IssuesNormally I would add an additional charge for that but as it is a short walkway I agreed to do it and we didWe showed up every time she called to plow after the plows went byThere was never a time we did not show up to do what we were obligated to do
