Deposits are non refundable when buying a used car, unless the dealer agrees to certain terms and conditions with the buyer. On 09/07/13 [redacted] was interested in purchasing 02 Ford Focus.At that time the Focus had a misfire due to bad alternator and a few other issues.[redacted] had agreed to purchase the vehicle once the issues were resolved and had left $85 deposit under these terms.That I would refund him his deposit if the misfire issue had not been fixed. I had held my end of the bargain and had resolved all the ongoing issues. And when it was all set and done he did not hold his end of the bargain and had told me that he decided not to go threw with the deal we made and that he wanted his deposit back. I have explained [redacted] that I will not be able to refund him his deposit back because we had an understanding and an agreement that he would buy it ones issues were resolved. I have lost more than few clients (potential buyers) for that Focus in that time being because I was holding [redacted] deposit. If every client of mine was like [redacted] that would leave a deposit on a car and soon after ask for the deposit back I would be out of business. As a used car dealer I do my best to buy and sell reliable used cars to the general public. People need to understand that buying a used car is buying a used car! Buying a used car is not like buying a new car, if you want a 100% perfect car than go buy a new car! As a used car dealer I sell my cars under The Massachusetts used car warranty law 30 days or 1250 miles whichever comes first for vehicles with 80,000 to 124,999 miles . I obey the law, I pay my taxes, and im here for my costumers, my door is always open to reason with clients. I can not give [redacted] his deposit back but I can put the $85 towards another car of his choice on my lot, and thats the best I can do.
