Review: Mr Harrison was to cut timber on my property Part of it was to be clear cut the other part just timbered. When this agreement was entered into Mr Harrison stated that he would take anything 6" in diameter and up. When he finished he hadn't done as promised the left logs laying that were over the 6" limit he said he would take, of course this just added to the mess that I knew there was already going to be. But the main part of my complaint is the loading area he left a lot of junk in a pile it's not far from my house and is an eyesore also he made a mud hole out of what used to be a field. Originally Mr. Harrison told me he could do all the loading in the woods but then he wanted to use that spot so I moved some stuff out of his way. He also destroyed the road I had to my barn it used to be gravel now it's mud.Desired Settlement: I would like for Mr Harrison to haul off all the debris that's left in this area regrade it, reseed it and put some gravel on the road he destroyed I would like more done but I know he won't I have a list of five things I would him to do but what's listed above would be the most important.

Here is a copy of the contract that was drew-up for Mr. [redacted]. This has not been closed out by the forrester yet. This will be closed on 4-24-14. As stated in contract, if there were any "specifications", he was to list those. I've done everything in my power to sastify Mr. [redacted]. Just planted grass seed and spread 22 bails of straw on 4-14-14. The junk he is referring to is blocks from the butts of the trees, that his neighbor wanted to get for firewood. A load of gravel was put down. I have never had a complaint. Never stated that I would cut everything up 6" and up. I have a gentleman by the name of [redacted] that was present when Mr. [redacted] and I discussed this. I never stated that I would load the logs in the woods. Mr [redacted] showed me where he wanted me to load at, and thats exactly where I set-up. Like I said, I just spread the grass seed and put all the straw down on Monday. I definetely will do nothing else for Mr. [redacted]. I follow all forrester guidlines and I am in compliance of all rules and regulations. I'm sorry that he is not sastified. Some people cannot be sastified.

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Mr Harrison makes it seem as this so called contract was "Drawn-up" just for me this is just an agreement he uses for all his jobs. When we set down to discuss the job Mr Harrison as well as Mr [redacted] I originally told them I wanted all my property clear cut I asked what all they would use and it was then that Mr Harrison stated that that he would take everything 6" and up it was because of what he told me that he got the job. No contract s signed at this time because I needed to get my property lines marked. Because his contract did state that he wouldn't be responsible for the boundaries. Mr Harrison addresses the Junk as blocks that MY NEIGHBOR wanted to get for firewood? Mr Harrison hauled 45 loads of timber and 13 loads of pulp There would have been more butts than he left behind but he gave away wood I could have used to his friends without my permission the contract clearly states the only thing he is to haul is Timber & pulp nothing else but that's another matter entirely, that the court system will deal with. The only gravel Mr Harrison hauled in was for his own use he didn't repair the road to my barn it was to keep his truck from getting stuck. If I instructed Mr Harrison where to load his logs why didn't HE list it on his SPECIFICATIONS area of his contract. Mr Harrison & Mr [redacted] visited the property and I asked if I needed to move anything out of their way and they said no that they would load up on the hill pointing to the area on the hill behind my barn. How would I know what they would need for a loading area anyway. Two weeks before Mr Harrison moved on my property he said that he would like to use the area that he used and I didn't object I even moved things out of his way had I known the mess he would make and leave behind I would never have agreed to it. I would think a RESPONSIBLE businessman would have cleaned up after himself after all it's right off 220 and can be seen by a lot of people. Mr Harrison has only done what it takes to satisfy the Division of Forrestry under the threat of a $5,000 a day fine he's had to be called back to the property several times because he didn't satisfy the Forresters. I can provide Pictures to back up what I say about the mess he's left behind I tried to include them in this email but they wouldn't load. Mr Harrison is not a man of his word and Mr [redacted] goes out to get work for Mr Harrison so he's on his payroll of course he'll back up Mr Harrison. Mr Harrison says he's had no complaints but I've heard there's more people who are dissatisfied with his work. I'm going to encourage them to file complaints too. Oh yeah I walked my property with Brad Carrico the Forrester from Stuart VA. and he said this guy is one sorry logger. If Mr. Harrison wats to resolve this complaint he can clean up the loading area remove the debris also get the peices of wood out of the dirt and THEN reseed the area that was grass and put a load of #1 stone on the road to my barn. He's spread grass seed and straw over the debris only to satisfy the Forrester.

In regards to Case # [redacted], all contractual negotiations have been met. My contract very

simply states: Seller is responsible for marking boundary lines to all adjoining properties and is

also responsible for overcuts to adjoining properties if boundary lines are incorrect. No tops or

limbs are to be left across property lines. Purchaser is responsible for any injuries that may

occur as well as pick-up litter while on job site. I also include a "specfications" section on my

contract that any customer may list when agreeing upon the use of my services. Other than Mr.

[redacted] mentioning that his neighbor would be using them for firewood - No specifications

were listed or verbal agreement was made in regards to trees over 6 inches being taken, cut or

used by Harrison Logging.

The Virginia Department of Forestry issued Water Quality Protection Recommendations on

April 10 2014 based off the inspection date of April 08 2014 to determine if a water quality

concern existed. There were 2 recommendations listed.

1) landing 01 - Seed and mulch all bare mineral soils capable of contributing sediment

to streams or stream channels in appropriate measure and method to establish 70% permanent

vegetative cover. Mulch should be applied to the top of slope or to grade break.

2) Sk¡d Trail 01 . Seed and mulch bare mineral soils capable of contribut¡ng sediment to

Both recommendations were required to be completed by the Virginia Department of Forestry

no later than April 25th 2014 and both recommendations were completed on April 14 2014. A

follow up inspection letter from the Virginia Department of Forestry dated April 29 2014 states

that the concerns were addressed and no further action is required. I could not take any

pictures after the work had been completed as Mr. [redacted] advised me to leave his property.

In regards to the look of Mr. [redacted]s property; Quoted directly from the Virginia Department

of Forestry's website, it "urges landowners who consider selling trees and timber to consider

the appearance and condition of land after the trees have been removed. The sight of a barren

area, after trees existed on it for decades is appalling to some people". Unfortunately it seems

this was not considered and he is now dissatisfied with the end result.

In conclusion : No further action will be taken on my part.

As in my original complaint I never made refrence to how my property looked after the logging was done. Mr Harrison knows very well what he promised to do even if when he DREW-UP the contract he neglected to put it on the contract, He still was bound by the promise he made when he came to the house to discuss the logging. I only complained about the Loading area that he left in such a mess and instead of trying to clean it up he ran his bulldozer over the small peices of wood further embedding them in the mud so it would be more difficult to be cleaned up Mr Harrison is not a good businessman he doesn't know how to do a good job or satisfy his customers He didn't do anything I asked for as far cleaning up before he left the property, He only satisfied the Division of Forrestry's minimum standards and had to make several trips to do it.
