Initial Business Response /* (1000, 5, 2015/09/05) */
To whom this may concern,
First off, I am appalled by the accusations that have been placed against [redacted] and my tattoo establishment by [redacted], no relation. They are completely inaccurate and false. I will start by acknowledging...

[redacted]s statement, "Gave a shoddy product that they acknowledged was a mess by not posting images of their work online." It is not our duty to post every tattoo we do on social media. Each artist at Damaged Lifestyle Tattoo produces an average of eight hundred to nine hundred tattoos a year. Therefore we do not post every single tattoo that we do. There are plenty of tattoos that we are extremely proud of that do not get posted because we do not make social media a priority, we make our trade our priority .
"artist was frazzled, unprepared and unprofessional"-[redacted]. This is the first time I have had this accusation about [redacted] after the thousands of tattoos that [redacted] has produced at Damaged Lifestyle Tattoos. yelp, google, etc.... reviews to back this up. [redacted] states in her complaint: "he had not looked at the image closely, he had not printed it, he had not stenciled it or drawn it out." [redacted] later in the letter of complaint contradicts herself saying: "The STENCIL overlapped." Damaged Lifestyle Tattoos has audio and video camera systems to protect my artists and our customers from situations such as this. I have reviewed, saved and documented the camera footage from the date and time of [redacted]'s visit to our establishment. Not one time did I see [redacted] seem "frazzled, unprepared and unprofessional". Not once did I see [redacted] dissatisfied with the artwork she had received. [redacted] had even posted her new artwork from [redacted] on her social media shortly after she received it saying: "stupid faces with my new best friend, [redacted]!" which I have the reference picture saved and documented. Clearly if you were as unhappy with your new tattoo as [redacted] claims, you are defiantly not going to post a picture of it on social media showing how happy you are with it and calling it "your new best friend".. [redacted] is actually one of [redacted]s returning customers as well. [redacted] knowing the style of artwork that [redacted] executes, American Traditional, and once following both of his social media sites, which he has over nine thousand followers on, she knew the style of artwork that he does. If [redacted] was unprofessional, unprepared and frazzled, then why would you come back to get another tattoo by him?
In the twelve years that I have been a well respected, professional tattoo artist, I have never heard of the phrase "tattoo euphoria". I do not know this mental condition, which goes to the Tattoo consent, liability waver that [redacted] filled out, signed and dated with a copy of her drivers license on the back. In the consent, liability waver that [redacted] signed, which I have a copy of in hand, that states "I acknowledge by signing these agreement that I have been given the full opportunity to ask any and all questions that I might have about the obtaining of a tattoo. and that all questions have been answered to my full satisfaction. I specifically acknowledge I have been advised of the facts and matters set forth below and I agree as follows:". On the sixth paragraph it states: "I realize that variations in color and design may exist between any tattoo as selected and approved by me and as ultimately applied to my body" Paragraph eight states: I acknowledge that a tattoo is a permanent change to my appearance and that no representations have been made to me as to the ability to later change or remove my tattoo. to my knowledge, I do not have any physical, MENTAL, medical impairment or disability which might effect my well beings as a direct or indirect decision to have this tattoo." This consent waver was written by my lawyer, approved by the county, state and federal department of health and human resources, approved by my business insurance company, to ensure the protection of my business, employees and the consumer. In this consent waver is states that any fixing or touch up work need for the tattoo, due to the customers own physical or mental negligence, will be covered by the consumers expense. I personally replied to [redacted]s complaint letter that she had written [redacted] and told her that [redacted] is more than willing and happy to correct any issues she feels need be to her tattoo at no cost and that I am not issuing a refund for a tattoo a month later that she was seemingly happy with when she left our establishment. [redacted] stated "as soon as I got home and looked at the work closely I realized how bad it was and immediately emailed the artist, [redacted]." This is false! [redacted] received her tattoo from Damaged Lifestyle Tattoos on July XX XXXX. The very first email that [redacted] sent [redacted] giving any sign of her being unhappy about the tattoo was on August XX XXXX at 5:56pm. almost a full month later, I have the email printed and documented showing the exact date and time that the e mail was sent by [redacted]. [redacted] says she was quoted $250 for the tattoo, but in her own writing, writes in the consent and liability waver $300 in the price portion of the document. If there was a miscommunication issue with estimate price of her procedure then she should not have written in the waver and consulted with [redacted]. If [redacted] was not happy with her artwork before or during the procedure, she had the power to view and or stop the artist at any time to make corrections or conclude the tattoo session.
Before contacting us about her dissatisfaction with her tattoo, [redacted] went to another artist and shop to get the same tattoo but a different variation of it on her other arm. She has slandered my business and artist, has contradicted herself and given false accusations in her complaint letter. All that I have documented, screen shot proof of. This has all gone to my lawyer and has copies of all images and documentation to prove this.
Damaged Lifestyle tattoos is 2014's number one tattoo shop, rated and voted by the public under the Reporters "solano's best of 2014" we pride ourself and our success was based off of great customer service, amazing award winning artists and a clean professional atmosphere. This is not a business or industry where you can receive permanent body art, then regret your decision and demand a refund a month later using a false excuse of "tattoo euphoria". Clearly this is a case where someone got a tattoo and later on, a month later, regretted it. It is not fair that Damaged Lifestyle Tattoos and [redacted] should have to pay money to anyone who regrets their tattoo decision a month later. We offered to touch up her tattoo at no cost and she declined. So this being said, I will not refund [redacted] $300 for her tattoo and I will not issue [redacted] $1000 for corrections on a tattoo that she thought was overpriced at $300. These accusations against [redacted] and Damaged Lifestyle Tattoos are false and inaccurate. If I have to further due this accusation I will be forced to take legal action for slander and the time and money spent on this case. I have sufficient evidence showing her accusations are false.
I have attached image files showing proof to back my statements
image 2: showing [redacted] liked the tattoo 2 weeks after she got it
image 3: comparing the new work with [redacted]'s work. [redacted]s's work on the left, clearly more contrast, smoother shading, more detail, all around better tattoo.
image 4: complaint letter that shows date and time she sent it, almost a month after receiving the tattoo by [redacted].
image 5: consent waver signed and filled out by [redacted]
image 6: [redacted]s I.D.

Final Business Response /* (4000, 10, 2015/09/19) */
First off, [redacted] was given the option to upload images. I feel that [redacted] declines to upload them because they are taken over a month after the initial tattoo was made and quite possibly after my first response to her complaint. [redacted]s complaint is all hearsay. she has provided no physical evidence to back her statement. I have provided physical evidence towards my defense to [redacted]s claim against Damaged Lifestyle Tattoos and [redacted]. I have Proven, with evidence attached in the last reply that [redacted] lied and gave false accusations in her complaint against us. [redacted] made up a mental condition to "coin" in her letter against us. I have a release liability waver that [redacted] signed and dated that protects us from claims by customers such as this that will hold up in court alone. I will not pay [redacted] a refund of $300 and I will not pay [redacted] $1000 for follow up work and corrections. From this point on if the claim is not closed by [redacted] my lawyer will fully take this matter and [redacted] will compensate myself, Lonny Fritch, owner of Damaged Lifestyle Tattoos, for all of the lawyer fees and time I have put into this case. I will also Take Legal action against [redacted] for slander against Damaged Lifestyle Tattoos and [redacted] that I have Screen shot, dated proof from her social media sites.
Final Consumer Response /* (4200, 12, 2015/10/01) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Again, no way to upload images I took the day of and the day after this atrocious thing was placed on me. Had it been small I could cover it up but my artist says it is too scarred and dark. I am happy to discuss this with you and your lawyers but in no way will I fund your poor work and bad business ethic.
