Bought a house and not given the correct keys to get in. told to hire a lock smith
Purchased a home from Damon Gettier and Associates. Closed on Wednesday 14th at 130 pm and had to ask for keys after finishing with the title company. Rushed to the house to let my helpers in to beat the rain. I received 3 sets of keys and none of them fit the doors. I texted the realtor Ben Creasey and his response was "your best bet is to call a locksmith". I called him and it went to voice mail, so I texted him and asked him to call me.
His response back was I am in a meeting, I will call you after that,,,,, I called the office phone and he answered, I said I thought you were in a meeting. I asked to speak to Damon and he said he would let him know I called. I called back to the office 2 times on wed and 2 on Thursday and again asked to speak to Damon who has not to this date returned my calls.

Review: I contracted with Damon Gettier and Associates to sell my home after hearing praises about their services via radio advertisements. Initially they were pleasant and helpful however I do not have much equity in my home and I specifically told them I would not have monies for commission/closing. They indicated understanding and we proceeded. After I paid the initial fee for professional photographs et cetera the house went on the market. They were unable to remember initially that I had paid them in full. Once that was resolved they were unable to provide any feedback about the showings of the house other than approximate number. They constantly approached me about dropping the price of the house and I advised that I had to have so much to cover the loan and I did not have funds for closing. They left the house unlocked on 2 separate occasions for an unknown period of time. when it was time to renew contract. I declined initially because it was a 6 month contract. I felt that they provided poor service. After much assurance that I could cancel "at any time" and they were aware of my financial situation I renewed my contract. I had a "cash offer" of $190,000 and the buyer would pay "all closing cost". I countered at 192,000 to cover cost of loan with the understanding that the patient was paying all closing cost. I signed forms tht they did not explain but the price I saw on sheet from them was 214, 999 I thought that was the additional to cover the closing cost to the buyer . The day of closing I found out that I was supposed to pay approximately $17,000 in closing cost. Actual closing according to lawyer was approximately $14,000. I could not close. They did not review forms with me and I would not have knowingly signed a legal document making me responsible for that amount of money because I do not have it. My realtor has been pushing me to get all of the money and will accept nothing less. They stated I could get a "small loan" and that she spoke with Damon and stated "we don't care how you get the money". I have attempted to get some funds to proceed with closing in good effort and no one will negotiate. Buyer is threatening to sue. It is now affecting work and my ability to pay my current bills--due to time spent to resolve this issue and cost of procuring an additional loan. Incidentally I do not quality for the full amount...Desired Settlement: 1. I would like to to close on the house before 4/11/2016 but I will only pay $6000 to cover what ever closing/commission from my side. The 2 realty companies can split the commission however they see fit.

2. I want out of the contract with Damon Gettier and Associates immediately if they do not agree to the above terms.

[redacted] listed her house with us originally on 6/4/15. The appraisal came in low due to the poor condition of the house. We were not able to make the house available to the market until 8/10/15 due to the poor condition of the house and the quantity of possessions in the house. We had the house listed for 6 months. We started the house at 206,000 and due to the poor condition and the feedback we received from showings and Shared with [redacted] reduced the price to $199,000. We had more showings and more feedback which was shared with [redacted] and she agreed to lower the sales price to 196,000. We received an offer substantially lower than the list price and [redacted] requested that we raise the sales price to $220,000. It remained at $220,000 until the listing expired.The house was expired on the market for about 2 month. [redacted] went back and forth on whether or not she was going to relist her home. We finally told her that if we did not get the documents back, we would pick our signs and lockboxes up. She relisted and soon thereafter received an offer on the house. We did a Seller net sheet which [redacted] signed that showed very clearly what she would owe. Not only did she sign the seller net sheet but I was sitting with [redacted], the agent that went over the net sheet on the phone with [redacted] and heard her explain the net sheet and they she would need to bring 17,000 to closing. [redacted] asked her if she could get a personal loan or use a Credit Card and [redacted] told her that it did not matter how she got the money but she had to have the money. Please note that the net sheet showed her bringing MORE to closing than she actually had to bring. The net sheet is an estimate, not an exact figure.Several facts that need to be pointed out-[redacted] claims to own 3 homes currently.[redacted] claims to be a Nurse.[redacted] also claims to "not be good at math".Someone that currently owns three homes and is a nurse is not some poor dumb victim. I have emails, recorded phone calls and signed documents to back all of this up.Damon Gettier

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.There is no offer of resolution in Mr Gettiers comments. 1. I am not a nurse and have never claimed to be. As their client the don't even know what I do2 I do have 3 homes because I was unable to sell my first home when I moved to [redacted]. It sat empty with me paying 2 mortgages I lived paycheck to paycheck.3. I can do math but large legal documents are not easy to read and when you are rushed and you are assured by your realtor that the buyer would pay "all the closing costs" you tend to trust the 'expert'. Especially since they are supposed to help and represent my best interest.3. when we discussed funds $17000 was not mentioned as per my recollection. 4 I cannot get a loan for $14000 or even $10,000. I am unable to obtain the money they require for closing. At time of this writing I am juggling finances and paying some bills late to make ends meet. 5. They do not deny that on repeated occasions I specifically told them I had no funds. I told [redacted] multiple times. Damon sent contract for rental as a result. Reading that contract it that was extremely complicated and gave them a lot of authority to represent me and hire people to do repairs and charge me without contacting me under a certain amount. I did not feel comfortable and declined. I repeated myself several times before renewing their contract to sell my home that I had "no money"Next week I will have to return funds for a loan I was able to obtain to try and close (in good faith)because I can't pay it and the mortgage on the house.I am in process of retrieving documents they sent me.

Review: I put my house on the market with Damon Gettier May 14, 2014. With the understanding that if for some reason my house did not sale in 6 months, that they would purchase from me at my asking price. ( this information was provided from an ad they were running). I had a meeting with them and a friend to help listen to and ask any questions I may not have thought of. We decided to list the house for 300,000.00. At this point all that was said to me was it was very aggressive pricing. But still good to start at. In order for the process to start I had to write them a check for $3000.00, this was to cover photography, and advertising, also this would be their portion of the commission on the sale. After having paid the money and putting the house on the market. Weeks, days went by and nothing... no calls no folks from any other realtors coming by. I would make numerous calls and emails asking how things were going, as to why NOT a sole has shown any interest.The response I received was, due to the pricing there had been no interest. I asked if this was the case, why had this not been discussed at the onset of putting the house up for sale. We lowered the price. I was always under the understanding, if it was liked a offer was made.My neighbors Sons [redacted] was interested in the house, and tried the number on the sign to call anytime. He did numerous times... no answer... I did... no answer. So I emailed and called the office to find out the scoop. Was Told there was a issue, and it was been fixed. I also went and met with my realtors on the 5th of August concerning ALL my concerns. They again informed me it was being fixed. So for the time it was on the market until my neighbor informed me, even if someone was interestd they could not get through. I at this point asked for my downpayment back, due to their lack of advertising.. was informed by [redacted], they could not do this. In the mean time I have 5 different folks knock on my door, due to the number not working for purchase. I showed it!!Desired Settlement: I would like my deposit of $3000.00 returned. This is the total amount of the check given for my house to be put on the market.
