MATTHEW S. DANA COMPLAINT:
I accuse Mathew S. Dana, attorney in Scottsdale, Arizona, and by extension, The Dana Law Firm, of deliberately ignoring obvious signs of advanced dementia in my Dad and had Dad sign numerous legal documents at my siblings' direction.
My Dad, Frank M. Baker, Sr., passed away on January 29, 2015 at the East Valley Hospice at the age of 97. The estate has since been settled. I have no objections to the distributions made. I am, however, very concerned about what occurred at Matthew S. Dana's law office where Dad, on August 14, 2014, was brought in by my two older siblings and made to sign 7 complicated documents.
These documents mostly replaced previous similar documents but with extraordinary changes, particularly in the Health Care Power of Attorney and the new Living Will attached to this power of attorney. These powers of attorney seem to have made it far easier for my two older siblings, Michael Cairy Baker and Anne Marie Baker, co trustees on the Trust, co agents on the Durable Power Of Attorney and co agents on the Health Care Power Of Attorney, to put Dad in a Hospice environment, which they did a few months later in December of 2014 and where my Dad subsequently died a few weeks later.
The new documents also appear to legitimize my sister Anne's bilking the estate out of 20K to 30K, money she used to redecorate Dad's house, which she was to inherit.
Had I known about Mike and Anne's shenanigans, I would have called the police and district attorney immediately. This is because at the time these documents were signed in Dana's office, Dad was in the deepest throws of dementia and could not have possibly made an appointment, communicated what he wanted, discussed what he wanted or understood what he was signing. Dad was incapable of reading and digesting the simplest of prose and many times could not remember Mom was dead. The most facile of vetting would have revealed to Dana that Dad was no longer capable of signing legal documents and that my siblings were pulling some kind of scam.
This lowlife just saw an easy few thousand and took it. If this isn't malpractice, then what is?
