Danaby ConstructionHopkins StreetBuffaloNY 14220###-###-####October 2015RE: COMPLAINT ID It [redacted] To Whom It May Concern:I am writing in response to the complaint made to the Revdex.com from [redacted] in regards lo concrete work that was performed by Danaby Construction at her residence in [redacted] made this complaint after a year the work was completedAs stated in our previous response dated September 17", concrete is known to crack which no contractoror business has control overLast year was an extremely difficult winter and the worst one recorded in history with freezing temperatures for extended periods of timeSo much so that the ground was frozen below the frost line, which causes any structure to shift especially concreteAlso as stated in our previous response Danaby Construction did not modify a pre-existing concrete pad with a drain on the premises and it was this concrete structure that shifted during the intense winter that caused [redacted] 's back door not to function properly.As for the phone calls that [redacted] claims that MrL [redacted] offered to give a monetary compensation to resolve the issue is completely untrueDanaby Construction attempted to correct the situation but [redacted] "stopped it in time' according to her letter that goes to show we were going to address the concerns [redacted] has but she did not allow us to do soAt this point, Danaby Construction will not make any repairs to the concrete structure as this work was completed over two years ago.Sincerely,Connie K [redacted] Office Manager

September 23, 2015Revdex.com Re: Danaby ConstructionlTim L***Bryant Woods South Hopkins Street, Buffalo NY 14220Amherst, NY Contract for concrete work###-###-#### Case #***Dear Sir or Madam:In regards to case # * ***, I am requesting to continue the complaint, as not resolved, against Danaby ConstructionMrTim L***, of Dana by Construction, has been notified on many occasions of the concrete drive-way issues by telephone, as well as, through text messagesMr. L*** was contacted immediately after the cracking appeared on the back section of drive/steps of the concrete driveway in early Spring of At that time, he requested to be contacted when the weather turned for the better, so he could come out and assess the issues furtherMrL*** was contacted regularly by phone to determine a time to assess the concrete issues, but continued to push off the meeting/rescheduled due to weather or contracted work he needed to attend toIn addition, MrL*** sent a representative out without my knowledge/approval to try and force a correction that was not satisfactoryThe correction was not completed because it was able to be stopped in timeThe attempted repair actually made the issues worse, causing continued deterioration/separation along the steps and retaining wallAt this point, MrL*** was notified immediately of the issues that were of concernHis representative notified him of the complaint as wellDue to this, during the Summer of2014, a verbal agreement, by phone with MrL***, was reached for repair of the drive way/back step and retaining wall, but was never followed through on/completed by Danaby ConstructionThe solution continued to be pushed off to later dates, thus no completion or satisfaction of work promised.The 9'7"x 17' 5" area, of drive-way in reference, does not have a control/construction joint or expansion joints in place causing a crack to occur and stream where the ft joint should have been placedIn addition, due to the pressure of the immobile concrete pad and design, the connecting steps and retaining wall continued to crack, due to, the lack of shifting that should have been anticipated with his designThirdly, additional pressure continues to be placed on the back door of the residence from the lack of expansion in design, causing the door to go out of alignmentIf, this alignment was due to shifting of the home, there would be stress fractures within the dwelling and there are none presentThe main issues concern the back area of the home and are not completely due to the challenges of the weather.MrL*** stated he would repair the driveway piece and steps to resolve the issue and notify me when it was to be scheduledHe wanted to resolve the problem and "just get it done and over with." MrL*** continued to reassure me, by phone, thru to Spring of 2015, that he did not forget about the issues and had the property on the list for repairIn Summer of 2015, Mr. L*** was contacted again by phone and proceeded to declare that he was not going to repair the driveway steps and retaining wall and that an agreement was never reachedIn addition, he offered to give a monetary compensation to resolve the issue, but offered nothing further in elaborationAt that point, no agreement was made due to the fact that more information was needed to determine a reasonable resolutionMrL*** at that lime stated he would make contact in a few days to determine a proper resolution to the issue of the concrete repairAs of today, no contact in regards to the repair of the concrete drive-way and step/retaining wall has been made by MrL*** or Danby ConstructionIn addition, based on the Danaby Construction contract, there is no statement of "no guarantee of concrete work" and per contract, they "guarantee all workmanship".A resolution to this issue would be greatly appreciated with an appropriate/acceptable repair to the concrete drive-way and stairs/retaining wallThank you for your help in this matter; it is greatly appreciated.Sincerely, *** ** ***Enclosures .cc: NYS Attorney General's Office, Consumer Frauds and Protect ion BureauFile Number: *** ***Danaby Construction

Danaby Construction at her residence in 2013. [redacted] has stated in her complaint that within a few months of installntion there were several sections that where pitted and severely cracked. She has also stated that the shifting of the concrete were exacerbated during this past winter and precluded her from opening and closing the front and back doors and the constant shoving to open the back door cracked the top of the door.[redacted] did not contact Danaby Construction back in 2013 when she first noticed any visible signs of what she considers poor workmanship but contacted us a year later. If a client should have any issue with craftsmanship we do come back and inspect the work but there are time constraints of any type of guarantee/warrantee on work performed, which is usually a year. Our salesman Tim did go out and inspect Ms. Fraturra'sS complaints. The pitting was caused from rock salt and there was one noticeable crack. Unfortunately, concrete is known to crack which no contractor or business has control over. Last year was an extremely difficult winter and the worst one recorded In history with freezing temperatures for extended periods of time. So much so that the ground was frozen below the frost line, which causes any structure to shift especially concrete.There is a pre"existing concrete pad with a drain on the premises, which Danaby Construction did not modify as it was not part of the signed contract. It was this concrete structure that shifted during the intense winter of2014, which caused [redacted]'s back door not to function properly. She also indicated that the front door was not functional either. The front door opens to a set of stairs, which means the entire set of stairs would need to shift.Unfortunately, there is no control over the acts of Mother Nature and what intensity it has on concrete structures. So there is no refusal to make any repairs as stated by [redacted]. If this was faulty product that caused any damages a manufacturers warrantee would be implemented but weather does not fall into this category because structures expend and contract with the fluctuations from cold to heat.Respectfully submitted,Connie K[redacted]Office Manager
