Sent: Tuesday, March 03, 8:PMTo: drteamSubject: Case #*** Dear Revdex.com, March 1, Case # *** I am writing you in hopes to clear up the derogatory remarks, and misunderstandings that were made against my company, staff, and myselfThis has been an extremely overwhelming process with this family, and I want it made known that my company is trustworthy, and reputableMy staff and I have done everything in our power to make sure every student, and their family feels warm, welcomed and invited, and most importantly feels safe in my studios environmentTeam Onyx scheduled class time for Thursdays from 7-8pmTimes was established in June of The student in question inquired class back in November We explained class time, costume fees, competition fees, and expectationsThey were interested in Onyx, but son wrestled on ThursdaysThe instructor of the class, Alex W***, offered to work with student on Fridays, when time allowed in both the studio and with instructor, but that the child would have to attend some Thursday practices to work on choreography with the rest of the teamThis was agreeable to the student’s family, and they even enrolled their daughter in a different class on another dayThe family paid for costumes, totaling $and competition fees, totaling $We informed the mom of competition dates that my studio had selectedThe Mom had informed me that the date Febwould not work with them because their son had a wrestling match that dayWe decided as a studio that it was important that the team compete as a whole, so we changed the date for this team, so we could accommodate this particular student’s scheduleIt is mandatory for all dancers to be at the team practice the week before competition which meant this student had to attend Thursday, January 29th to compete SatJanuary 31st, for two reasons, the whole team needs to practice together before competing, and we travel on Fridays before Saturday competition, and there are no instructors availableThis team has attended one competition, January 31st, where they won seconded place in their divisionDuring the months of January-April we do not have any classes on Friday and Saturdays as those are used for additional team practices and solo practices and we are usually travelingAdditionally we close all classes with less than three students in it, as it is not financially feasible to pay utilities and instructors when the class is so smallWe explained to this Mom that Alex would no longer be able to hold private classes for this student due to Alex schedule, but that we really wanted this student to join the regularly scheduled Thursday classesThe mom did not want to continue and chose to withdrawal both of their childrenWe refunded February tuition because they had not danced that month yet, but are not refunding competition fees as the entire team pays the same amount so they can competeThese fees are based on the numbers of dances and number of competition the team will be attendingFees are based on 5-dancers, this team is made up of dancers, and therefore the studio was paying the difference in price for this team to go to competition By unrolling their son, they hurt the team in that it changes the category in which the team competes and the cost of the team. When dancers register for competition they commit to paying through the end of April, and understand there are no refunds of costume or competition fees, as those funds get paid as soon as they are collectedWe did not hold his family responsible for the remainder of the contract, however competition fees have already gone out and his team is already registeredThere seemed to be miscommunication between the mother and father as we believed all was clarified between the studio and the mother, until the receptionist was confronted by the mom at the studio the following week concerning the Friday dance classAgain the receptionist double checked with me as the director to confirm that Friday classes had been cancelled and I explained to the receptionist that “Alex and I had already spoken to the mother and explained that it would no longer be feasible to our instructor or team to continue the Friday classThe mom was in full understanding when she left that Thursday.” My receptionist explained to the mom what I had told her, and the mom got very angry in the studioBegan cussing and demanding her February tuitionMy receptionist explained that she is not authorized to give back moneyThat it would need to be handled between her and the directorThe mom got louder and explained that “her husband was very angry and he had already been in jail once and he wasn’t afraid of going back.” That everything she understood is all being twisted and distorted and so the receptionist showed the mom where they had text in past to make clear that other issues she’s talking about where not on our end as a studio but her misunderstandings. Finally when receptionist saw that we have a paper trail and that she was in the wrong, she calmed down and left with her daughter. The next day my receptionist text the mom to let her know that she could come to the studio and pick up the tuition for the month of February, the mom then text back my receptionist explaining that she could not be there that day, that she would come the next day to pick it upMy receptionist text back explaining that would be fine that she is there from 5-9pm When the mom came by the next day to pick up the $in cash she told my receptionist that her husband wanted the competition money back as well, my receptionist explained to her that “due to the contract and their agreement that she would not be getting her competition money back”, and she again got very loud saying that “her husband is extremely upset and like I’ve said before he’s not afraid to go back to jail, no matter what.” My receptionist told her that she would need to contact our director directly, and that there was nothing on her end she could doThe mom got very angry saying that “her husband would be up there that evening to talk with our Director, and that it wasn’t going to be pretty.” My receptionist then called me, I told her I would be at the studio that evening to take care of the problemI arrived at 6:30pmBy that time he had not shown up, I waited an hour and half, with the dance instructor my receptionist and another staff member for him to come in so we could talk with him and try to resolve whatever issues he hadWhen neither parent’s showed up I asked my receptionist to text the mom (so that there would be a paper trail) to let her know that I am here at the studio that I was more than willing to speak with her or her husband, but that I would be leaving at 8:and if the matter was not addressed then she assumed the situation they had with the studio was resolvedWithin minthe husband called at the studio, my receptionist answered and he explained who he was and that he was very upset on how things were handled and he began cussing at my receptionist calling her names, and though my receptionist did not get vulgar back, and continued to ask him not to speak to her that way, he said he would come up to the studio and talk to her any way he wanted she explained that if he did, she would call the police and his words to her was he wasn’t afraid of the police and did not careMy receptionist preceded to hand the phone to me as the director, I then introduced myself as the owner and director and was then berated with foul language, menacing phrases, and basic disrespectI repeatedly said “excuse me sir, may I please respond “and was answered with more swearing and phrases such as “you can pay me now, or you can pay a lot more in the long run”I again tried to speak, asking if we could please discuss this in a professional manner, but I was not permitted to speak beyond this, I said I felt we were not getting anywhere, and that I fund his tone and language offensive and that I did not want to speak to him anymore until he could be more mature about itHe said he was going to speak to his wife and we would be hearing from him, and he hung up Following the conversation my staff and I agreed that we could not risk having his behavior on our property, that we felt fearful of his next actions, so we chose to call the non emergency police line to make a record of the situationWe were attempting to protect ourselves, our property and most of all our studentsThe League City Police department felt it necessary to send out an officer close byOfficer LS*** came to our studio and took our reportHe asked if we were offended by the man’s language and both myself and my receptionist, Chrissy B*** agreed we wereThe officer said he would write citations for this offenseHe looked over our contract, and heard our side of the storyHe gave us a case number ***, and said he would go to his home and speak to himSince then we have spoken to our land lord about getting a property restraining orderShortly after we all left for the evening, Chrissy B*** received a text on her personal phone by the mom involved where she said extremely derogatory things about me, and my business, Chrissy chose not to respondShe also went on Moms of Galveston County and slandered myself, my instructor and my studio, and luckily one of my staff members saw it online and was able to have it deleted because it was a police matterSince then she has filed a complaint with your organization slandered me and my studio on social media, and contacted the competition company asking for their money backThis company gave them their policy on returns, but also explained to her that studios all have different policiesAnd when they receive money it’s not from individuals but studiosAgain they have contacted my studio demanding their money back by email, and I have explained through email as per the contract they will not be receiving any money back. My staff member did talk to the mom, and recorded the whole conversation with her, with the mothers knowledgeAnd this leads me responding directly to your notice Thank you for hearing my side of this situationThis has been an extremely frustrating matter. I take my business very seriously, and personalI consider each of the students enrolled as one of my own. I also understand that this family is going through a financial burden, and though I understand money being tight with a family, I do not respect the way they are going about trying to hurt good people, and a fast growing competitive business like Dance GemzI hope this clears any questions you may have, and you allow us to keep our good name, as it means so much to me and my staff who work so hard at keeping my business running Thank You, Jodi M***-K*** Dance Gemz Director Case #***
