Review: I purchased a 2.1 carot engagement ring in a platnum setting for $11,550 for my fiance on April **, 2013. Only five months later, on September **, 2013, the stone fell out at some point while dining at a restaurant in midtown NYC. Notwithstanding a comprehensive search by me, my fiance and the restaurant staff, we were unable to find it. We went back to Daniel Jewelers on the following monday to advise them of what had occurred and to see what they could offer us. Instead of being helpful and apologetic, the owner was rude and dismissive. He basically threw his hands in the air and repeatedly stated that this is why you should get insurance. In fact, the ring was partially insured and we were advised by USAA that if the product is defective - as in this instance - we were not covered. The owner then tried to blame my fiance for banging the ring. We note that at no time in the mere five months we owned this ring did she ever bang it hard or otherwise hit it in any forceful fashion. In fact, she took it off when doing any type of activity such as swimming, running/gym, cooking, cleaning etc. Also, in speaking to a number of reputable jewelers since the incident, we have learned that the only way a ring could fall out of a PROPER setting is if there was severe force so that your hand would actually be injured too. Still, the owner refused to do anything for us. We even asked him to sell as a ring at cost. His insulting response was to offer us a similar diamond for $8,000 - clearly NOT cost for such a diamond. And also not particularly helpful when we were sold a DEFECTIVE PRODUCT FOR WHICH HE TOOK NO RESPONSIBILITY FOR.Desired Settlement: I do not trust this jeweler to provide us with another diamond so we are seeking a full refund of the $11,550 we paid for the ring.

The ring our mutual customer bought for $11,550 was a real beautiful ring a 2ct princess in a chanel platnium, the head where the diamond was set in is platnium, in a four prong setting. After 5 months after purchase they came in and said we lost the center diamond after 5 months , they demanded a new diamond from us for free, since they lost it, I told them you need to have insurance for the ring just for these kind of problems, you really never know when can loose a stone or the whole ring, or get robbed, I offered them a discount for a new diamond for about $8500 since they are my customers and I felt sorry for their lose but they insisted on a free diamond only and I explained to them that the diamond was set in platnium which it only had 4 prongs not six like for a shape you have to be careful, if you hear it shaking in the ring you can always come in and we would tighten the diamond for free, if it was bad it would have fallen out the first day sh wore it, With every purchase we provide a full certificate for every diamond in our stock for that opurpose so the customer can fully insure it with with the insurance company, because you never know when something can happen, we sell over 2000 diamonds a year we can not be responsible if she lost it, thats why insurance companies are in bussiness, for that reason, like car insurance, home insurance, fire insurance, & life insurance, we have been in business for over 25 years I never ever had this happen to us that I give them a diamond for free and if they want I could replace that diamond with a simular diamond for $8500-$9000. Thank You

And since when did the customer know what is the cost of my diamond that I offered to them, he offered me $5000 he thinks that I made 6500 off him last time that is really funny, my offer still stand I could replace a diamond similar to the one they had for about $8500-9000 Pass the info.

For my second response to this is, like I said in my first one our mutual customer bought an engagement ring from us for $11500 that was a 2.10ct princess cut in a gold diamond setting. We had provided them with a certificate for their diamond with the retail replacement value of 150000 or more, that certificate was provided for them to use to get it fully insured. We provide the diamond and setting. The diamond was a princess cut shape that only has 4 prongs on the head to protect it from falling out or getting chipped. Its like buying a car in NYC its mandatory to get insurance because you really never know when an accident can happened, its not a guarantee from my store states that I am an insurance policy, I'm here to dicust a refund of any sorts, when they came last I offered them a similar diamond same quality for my cost $8000-- all included, and he has the guts to tell me its clearly not the cost for such a ring than why did he buy the first one for $11500. And for the future please do no respond to me take it up with my lawyer and please don't mail me anything about this again.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

It is clear from this business' response that they have no regard for thier customers or the quality of their product. The fact that this business owner is comparing auto insurance to obtaining insurance for a diamond ring is ludicrous. Auto insurance is mandatory for the protection of other drivers should an accident occur - it is not for the protection of the car owner. Insurance for rings is in no way mandatory and many people opt not to get it because it is very expensive and you end up paying for ring again after about five years. In no way did we anticipate that the diamond would fall out of the setting after five months with zero trauma to the ring. Also, we not that if a car company sells a car with a defective part - that part is recalled and fixed for free by the car company - this is NOT something that is covered by the insurance policy. That is the situation that exists here.

It is clear that this business owner has no intetnion of doing right by us. Thus, we have filed a claim against this business in Court. We request that the information we have provided regarding the neglicence of this business remain on the Revdex.com website so that other customers are not duped the way we were.
