I am writing in response to the
above-referenced complaint filed by the consumerIt is important to note that the complainant is not a customer of oursHe is an adversary in a legal proceedingWe do not believe the the Revdex.com is a proper venue to lodge a complaint about a legal proceeding, and thus we do not recognize any authority of the Revdex.com in this matter
I represent the consumer’s legal adversary, Asset AcceptanceThis consumer was personally served in with a summons and complaint filed by my office, on behalf of my client, to collect the consumer’s unpaid Citibank/Zales accountThe lawsuit was filed in Spokane County, Washington, and the consumer was served there on January 5, He chose not to appear or contest the action in court, and a judgment was validly entered against him accordingly on December 11,
The consumer did not make any attempt to pay the validly entered judgment, and thus garnishment and collection efforts ensued over the subsequent yearsPursuant to state law, we are required to send copies of court documents to the consumer every time we file something with the courtThus, from time to time, the consumer may receive documents in the mailIf the consumer moved after entry of judgment, that does not invalidate the judgment and it does not require a change of venue
We have also attempted to contact this consumer by telephone over the years to arrange for voluntary repayment of the judgment, but he did not contact us to let us know of his situationIf he had, circumstances may have been different, but at this point that is neither here nor thereThere is no merit to the complaintAccordingly, this complaint file should be closed
