Initial Business Response /* (1000, 10, 2015/03/05) */
Received business response via email on 3/5/15:
Let me start out by saying that it has always been my goal to create a quality product and experience for my customers
With that said, in addition to doing extra work for which I did not
charge, once the project was completed, I went back to Ms***'s property in response to her contacting me about concerns with the systemFrom my inspections, some of her concerns were my responsibilityHowever, some of her complaints were not even my worki.eRepair her front irrigation which was leaking out into the street
On numerous occasions, I tried to accommodate Ms***For example, I, immediately, responded to one of her complaints, which turned out to be an old broken irrigation which we did not installWe repaired it and did not charge her
Another example was when she requested I put a large screen in to hide her neighborI told her it was too high and that she needed to go back to the home owners association, but she did not want toShe just wanted me to build itA neighbor complained to the home owners and *** called me and asked that I remove themI sent of my people out to remove the ones that were not to be there and did not charge her for that, either
Additionally, contrary to her allegation, not only did I not leave her place a mess, but we did additional cleanup of the plus plants on her deck, moving them off their stand cleaning leaves and debris and then organizing them back the way she wanted them at no charge(I have pictures of the completed project) I am unaware of what she calls a leakThere is an overflow attached to the pond someone may have lowered its level causing it to appear to leak, since this is the first I have heard this complaint,( in the attached Revdex.com complaint) I have not visually inspected it myself to see the problem
To describe in complete detail what my experience has been with Ms*** would take days' worth of hours, copying many earlier responses, photos and many responses attempting to have her be as satisfied client as I can, given the difficulties presented from the beginningI am more than willing to do so if you think it would help
However, the essence of my experience with Ms*** was that we completed the project and did not charge her for several additional adds she requestedFurther, we responded to her numerous complaints and addressed them even though many of them were not legitimate or created by us
Things began to deteriorate when Ms*** began demanding an expensive replacement filtration system at no additional costWhen we advised her that there was nothing wrong with the filtration system we installed, but offered her a discount to install the one she wanted, she got an attorney involved to threaten usThat is when we consulted an attorney and made the below offerThat offer was followed by the attorneys talkingApparently, things fell apart when our attorney advised that we would want a release if we did any work or made any accommodationAfter that, the only thing we received from Ms***, are threats and negative reports about us to known agencies
In short, we tried to accommodate Ms*** at every point ranging from discounting the contract price, not charging her for additional work and even offering a discount to do additional workAs you can see, however, she wants more
To be clear, we stand by our work and have had many satisfied customersBecause we would like to resolve this, we would be willing to consider trying to address Ms***'s complaintsHowever, at this point, it is unclear what she wantsIf we knew that, we could respond accordingly
Thank you for your courtesy and considerationShould you have any questions, comments or need further information, please do not hesitate to contact usPlease see below for our communications with Ms*** in an effort to resolve her concerns

Initial Consumer Rebuttal /* (3000, 14, 2015/03/21) */
(The consumer indicated he/she DID NOT accept the response from the business.)
he didn't mention that the pond completely broke a few days after he finished, and flooded my back yard and that is why he had to come back and build it stronger
he did charge me about $3,more than the $20,we agreed upon
the front irrigation system was effected by his work......he shut off the water without telling me and thus many of the plants and some rose bush trees and a lemon tree died
he left the place a mess and I hired a crew to clean up.....can produce those bills.....still haven't redone the path he completely destroyed around the side of my home
also I had to hire an electrician because he built a $20,project by running extension cords from my home no GFI instead of what is required by code......and to keep the home safe
he said the project would take about WEEKS......it actually took about MONTHS
His denial is a fabrication in his own mindHe gave no assurance of his work, i.eno guarantee although he bragged about winning lots of prizes for his work .....it was close to impossible to get him to attend to any problems without many calls , emails and finally a lawyer to help bring him around to completing a project that took from March well into August to complete and even then more people had to fix his attempts to do a proper job
Final Business Response /* (4000, 16, 2015/04/07) */
*** *** response to *** Rebuttal
At the outset, I reiterate the closing of my prior response, that, even with her rebuttal, it is unclear exactly what Ms*** wants to resolve this matterNevertheless, in the below response, in addition to pointing out inaccuracies in her rebuttal, I renew the previous offer made to her initially in September and, again, in my initial response to her Revdex.com complaint
Issue No1: while it is true that the wall needed to be rebuilt, there was no "flood damage" because the water drained directly into a culvert and out to the streetAs soon as I was advised of the problem, I went out there to fix it - at no cost to Ms***
Issue No2: Alleged leaksI am willing to inspect the system to determine the source of the problem
Issue No3: alleged overchargeContrary to Ms***'s allegations, I submitted a proposal for $20,which Ms*** acceptedHowever, Ms*** refused to sign a contractA copy of the letter I sent her regarding her refusal to sign the contract is attached
Also, attached is a final invoice showing that all the work in the initial agreement was completed for $20,However, Ms*** requested additional work which is shown at the bottom of the invoiceThat additional work was not part of the original agreement, but she asked us to do itWe did it and she paid money over and above the original $20,to have it doneTherefore, it is disingenuous of Ms*** to claim that she was charged more than the original estimate without explanation
Issue No4: alleged broken irrigationWe never worked on this areaHowever, we were called out by Ms*** a month after we finished at which time, she asked us to fix the problem - which we did - for free
Issue No5: left place "a mess." We dispute this allegationAs explained in our previous response, we cleaned the property and have pictures to prove itPlease advise if you would like us to provide the photos
Issue No6: No GFI/Electrical claimsContrary to Ms***'s claims, the only thing requiring electricity is the filtration system which does not need a separate line for useWe hooked it up to a GFI and even showed her what we didOn this issue, Ms*** tripped the GFI when she sprayed water on the outletShe called us out and we reset the GFI and showed her what happenedIf she incurred electrician bills as alleged, we request she provide them for review
Issue No7: length of projectContrary to Ms***'s unsupported claims, the project commenced on or about late June or early July (when Ms*** approved the final plans - there were five design revisions) and the bulk of the job was completed by August The project took that long because of the additional work Ms*** requested
Although Ms*** has yet to provide a clear statement of what she wants, I am prepared to renew the proposal made last September:
The filtration system we installed cost $and is more than adequate for the pond installedThe system Ms*** wants would have cost approximately $2,in that the system's list price is approximately $2,000, permit/electrical would be $1,000, external pump would be $and labor would be $1,for a total of $4,Thus, if this system was included in the bid, the bid would have increased by $4,
Although we do not think she needs the filtration system upon which she is insisting, if Ms*** still want the other system, as an accommodation, we are willing to install the new system with a credit for the current filter and labor ($675) which would bring the installation to $3,This is what Ms*** would have paid if the system she wants was included in the original bidAlso, we would guarantee the work

*** *** has landscaped one of my homes - did a fantastic jobIt was easy working with him, he did an amazing job, and was reasonably priced
