This is in response to the complaint filed by *** ***Mr*** did put a $deposit on a fawn female Great Dane puppyAt that point in time we did not have any available and he was advised that he would have the first one that we had availableHe was agreeable with thatMr***
currently resides in New MexicoAs with all purchases the price is FOB our kennel in IndianaSince we do make occasional trips to Colorado Springs I told him that IF timing worked out and we were going to Colorado for personal reasons we would try to save him some money by bringing the puppy with us and he could pick it up thereThe emphasis was on if the timing of any travel on our part matched up with the availability of a puppyThere was NEVER any promise on our part that we would deliver the puppy to Colorado unless the timing matched with an unrelated tripAt the point when we did have a puppy available in August of 2015, we were not able to get away to go to Colorado SpringsMr*** was advised that we were not able to make a trip at that timeMr*** became quite angry but decided to slide the deposit to another later litterOur policy is and always has been that deposits are nonrefundable unless we are unable to provide the customer with a puppy matching their original requestI advised Mr*** that we could ship the puppy to him via air, but he declined citing fears for it's safetyIn our many years of shipping puppies we have never had one injured or affected negativelySometime later Mr*** advised us that he would not be getting a puppy from usI do not know what the reason wasHe never did sayWhen he was advised of our policy in his phone call he became upset and started multiple phone calls and emails to harass us
We pride ourselves on customer service and have for the past yearsWe will do whatever is necessary and reasonable to assist a customerMr*** expected us to make a mile, four day roundtrip to deliver a $puppy to him at no chargeThat is not what we consider reasonableIt was emphasized to him at the time the deposit was made that delivery to Colorado was only available if we were in fact going there for other reasonI have absolutely no idea where he got the idea that the price included free delivery to Colorado regardless of circumstancesI can only assume that he simply did not want to pay for shipping and has found another puppy locallyObviously a completely separate trip to Colorado Springs solely for the purpose of delivering the puppy was out of the question

Good afternoon ***, I just received the email today saying this case was closedI just today was able to read the response from Dan Lea FarmsI wanted to let you know how I feel about the responseI am disappointed that they refuse to give my deposit backDan Lea Farms never informed me that deposits are not refundable and it is not on their website at allAlso, they failed to say that before I put the deposit down that Dan and I discussed and both agreed via telephone that shipping a puppy was no goodDan assured me that he could meet me in Colorado as he goes there all the time because they own a place thereI would have never put a deposit down otherwiseAnd in my email to them and in the note section of pay pal, I specifically put puppy to be picked up in ColoradoI had plans to go to Colorado and many people from here and in Colorado were going to be part of this trip/vacation timeEveryone that was a part of this trip had vacation time taken off at their workEverything was a go right up until the very last minute and Dan Lea Farms just cancelledI just want my deposit backI cannot believe that they won't give it backI also cannot believe that they will not admit that they did promise to meet me in ColoradoI truly think that there is a huge communication gap between Dan and his wife who also is the one who was very rude to me the only time I talked to her and she hung up on me That’s why I tried calling back to speak to DanI had full communication with Dan...not his wifeMy pay pal and the email I sent to Dan Lea Farms clearly states that puppy will be picked up in ColoradoIt is not my fault that they did not fulfill their promise to me and I want my deposit backI am deeply saddened that I was unable to get the puppy and that everyone's vacation plans were all messed up because Dan Lea Farms did not fulfill their promise and have the nerve to keep my deposit and blame me***, Thank you for listening to me...I hope that this case is not closed but if it is....I am sorry because I wonder how many other people's money were taken from them like me and how many more people may have their money taken from them because of the miscommunication between Dan and his wife and Dan Lea Farms not telling you that your deposit is nonrefundableThank you again and if there is anything else I can do concerning this matter please contact meI think I submitted copies of the email and pay pal stating that puppy will be picked up in Colorado but if I didn’t here is a copy of themI will also point out the dates...I was very patient waiting for the puppy as they said they had different problems with different littersWhen the litter did finally come everything was a go...right up till the last minute when Dan Lea Farms backed out on the deal and refuses now to give me my deposit backThank you *** *** Regards,*** ***
