stating that upon approval of his application the holding deposit is nonrefundable. The application was approved in 48 hours. Two weeks later the customer called and cancelled his rental claiming the apartment was not going to be big enough to suit his needs. Since we had held the apartment off the market for two weeks and in accordance with the document he signed at the time of rental we did not refund his deposit.
Just recently we received a notification from our credit card merchant services department that the customer has filed a chargeback request. Although we feel that we are legally entitled to retain the deposit, as an act of good faith we are not going to contest the chargeback request allowing the customer's credit card to be fully refunded.
Based upon the customer's full refund of the security deposit paid we consider this matter resolved.
