Ms [redacted] ,Please remember when I showed you the building, I offered you multiple apartments in the building You chose to rent this one knowing about the shared washer and dryer on this apartment's bill Also, I explained that this apartment was in better condition than the others that would share the laundry The lease states "Management agrees to reimburse tenant for utility overages due to washer and dryer" I have asked you to show me what those overages are You have shown me that your bill is over $ This is an average that you came up with It is too low and unrealistic In fact, everyone else in the building pays more for utilities than you The other tenants utilities are used in other common areas of the building including, stairwell lighting, outside lights and the water spigot It was a common practice when this apartment was built I do not mind helping pay for the utilities consumed by the washer and dryer and have already offered to pay $ The amount you came up with, $386.47, is way to high This assumes that in the last months, it cost $on average to run the washer and dryer That is not realistic and this also assumes that you did not do any of you own laundry Because you have not shown me that you have had a utility "overage", I have not compensated you If you proceed with withholding rent, I will hire an attorney If we prevail, the attorney will also be seeking reasonable attorneys fees from you I am suggesting that you be more reasonable Please understand that $avg utility is not reasonable and neither is $to run a washer dryer for months plus the cost to do your laundry on top of that Please advise me how you plan to proceed.Sincerely, [redacted]

I am rejecting this response because: See below and arttached.Hi Ms***, per our conversation today I am requesting to have my complaint re-opened due to *** *** hitting *** ** I was without power for a week and was unable to respond with a rebuttal *** and a friend, did met Mr*** in June but only to view *** *** *** *** * * which was occupied, no other renters were presentAlthough, the viewed apartment was occupied *** was advised that she would be moving into that apartment *** did not explain to her that a unit # will be assigned upon deposit The damages that I have spoken of in my initial complaint are very serious and presents a safety issue *** and staff have been made aware of these concerns in writing and verbal The apartment should have never been rented under these conditions *** maintenance personnel made contact with us on 8/26/and advised that he was enroute to the apartment to view the repairs as listed on the moinspection sheet On 8/29/2016, I contacted *** office and spoke with ***, *** *** to advised that no repairs had been done ***, assured me that he would call me back to explain why no repairs had been done and provide an update as to when they will be finished 8/29/2016, after waiting for a return call from ***, and never receiving, I filed this complaint with Revdex.com On 8/30/2016, only the following repairs were made Ice maker ( needed to be turned on and given hours to make) Kitchen outlet- (was mounted correctly) Downstairs bathroom-has multiply issues but only the toilet seat was secured Did not have fire extinguisher-now she does Advised that fire place cage and poker are not provided by mgmt.Again these are all the repairs made from the moinspection sheet, none of the safety issues have been addressedAs of today’s date-9/16/ no other repairs have made***, note according to *** maintenance personnel he would not work on the flooring he doesn’t do that type of repairs. I have attached an itemized repair request from the moinspection sheet. Thank you for your assistance in this matter. *** ***

When I looked at the property two units were shown to me; the two on the bottom floorWhen I went to sign the lease, I was told that the second unit was already rentedIt was not until AFTER I signed the lease that I received a phone call from Mr*** telling me that this unit had the washer/dryer connected to the meter and he decided to add the amendment to the lease agreement that management would agree to reimburse me for utility overages due to the washer/dryerI have provided previous utility bills and charges to support my argument of an average utility cost of $In fact, my previous utility bill was $71-$so $is more than fair and accounting for my use of the washer/dryerThe other units in the building have more people occupying the space than I doI am ONE person; the other units have two or more people occupying the dwellingSo, to compare my utilities bills to their's based on the size of the apartment is unacceptableSo, for me to be paying for other people (at least 6) to do their laundry the cost can add upI have provided paperwork to back up my claim to the money I am owed Mr*** on the other hand has offered me $as a reimbursement, with no paperwork to back up his claimIt is Mr***'s right as a U.SCitizen to seek legal counselI have already sought legal counsel and they advised and instructed me to serve Mr.*** with the 7-day notice of intent to with hold rent for money owed to me.Regards,

We are working to get these items requested finished up Some items had already been addressed and some are being addressed now This home was in no way unlivable at the time it was leased but will be nicer once we finish these improvements It is a practice to have items like these replaced over time before they are out of useful life which is the case with many of these maintenance items listed I have heard this morning that the resident has been to the property and is pleased with this progress

*** *** met me at *** and *** *** *** on 4/15/ At the time, I was also meeting with other prospective renters and we all looked at multiple units I explained to all parties that they would be assigned a unit # once they made deposit and signed the lease On
4/25/16, Mrs*** sent us a digital application and on 6/8/signed the lease for unit *** *** *** for 8/5/move in All units at this *** ** property are very similar I would have been happy to show her the unit *** at any time had she requested it Maintenance was sent out to the property on 8/26/to address all concerns Mrs*** could not be home while the tech was there but he did call me to go over the list while there I hope that this clarifies any concerns and we can move forward from here

This situation was brought to our attention the same day that Ms*** filed this complaint She was dissatisfied with the immediate response she received from our office.I am the Property Manager for thie location I met with Ms*** at her home yesterday We reviewed the
situation together and talked about possible resolutions I will be discussing these with the property owner I promised Ms*** that I would follow up with her today.*** ***

I am rejecting this response because: I disagree that the apartment was suitable for live in.  Giving the facts that several windows did not open and close properly and had missing locks and window screens either missing or damaged.  The tub/shower were rusted. And other items listed should have all been addressed prior to anyone moving in.  Some of these same items are required by code enforcement.  Because it has taken [redacted] exactly 4 weeks to begin any repairs on this unit is unacceptable.  I made several attempts  to resolve these issues prior to taking further action, with no additional responses from [redacted].  I truly believe that the only reason work is being done is because we severed [redacted] with a 7 day termination letter on 9/16/2016. The work begin on Monday, 9/20/2016 and code enforcement was contacted the same day.  It is sad and discouraging to rent from someone whose only concern is the dollar, not the fairness and safety of  the tenant.  I am a firm believer that one should treat others as they want to be treated. [redacted]s action reflects that he does not care about his tenants.  I regret that I fail to review previous tenants comments that are posted, labeling [redacted] mgmt. as horrible, uncaring and never repairing anything in a timely manner. The list goes on and on as to the disappointment from these tenants. I am requesting that this lease be terminated and monies return.

Ms. [redacted] lived at [redacted] from July 2012
through April 2014. She vacated the property three months prior to her scheduled
lease end date of July 31, 2014.
Ms. [redacted] reported mold on her bedroom walls in 2012.
Because we are particularly sensitive to mold issues, our...

manager checked the
situation. He cleaned the mold with bleach and reported that it was a
housekeeping issue. This is the only report of mold ever on the property.
The property owner’s daughter lived in the property prior to
Ms. [redacted] taking occupancy. Ms. [redacted] completed a thorough move-in inspection
in July 2012 and made no report of mold issues. We did a thorough move-out
inspection after Ms. [redacted] vacated and had no report of mold. A new tenant
took occupancy of the property in 2014 and has not had any issues with mold in
the house.
During her nearly two year tenancy Ms. [redacted] reported the
maintenance issues listed in her complaint – stove, water heater and air
conditioner. We provided prompt service for each call, and the service was
satisfactory at the time.
We provided documentation of the final charges of $2,186.49
to Ms. [redacted] by certified mail in 2014. Most of this amount is for unpaid rent
due to her breaking the lease. The charges are fair and accurate.

that would share the laundry.  The lease states "Management agrees to reimburse tenant for utility overages due to washer and dryer".  I have asked you to show me what those overages are.  You have shown me that your bill is over $110.  This is an average that you came up with.  It is too low and unrealistic.  In fact, everyone else in the building pays more for utilities than you.  The other tenants utilities are used in other common areas of the building including, stairwell lighting, outside lights and the water spigot.  It was a common practice when this apartment was built.  I do not mind helping pay for the utilities consumed by the washer and dryer and have already offered to pay $50.  The amount you came up with, $386.47, is way to high.  This assumes that in the last 8 months, it cost $48.31 on average to run the washer and dryer.  That is not realistic and this also assumes that you did not do any of you own laundry.  Because you have not shown me that you have had a utility "overage", I have not compensated you.  If you proceed with withholding rent, I will hire an attorney.  If we prevail, the attorney will also be seeking reasonable attorneys fees from you.  I am suggesting that you be more reasonable.  Please understand that $110 avg utility is not reasonable and neither is $386.47 to run a washer dryer for 8 months plus the cost to do your laundry on top of that.  Please advise me how you plan to proceed.Sincerely,[redacted]
