Please find attached a copy of a document enclosed in his complaint to the [redacted] This differs substantially from the document which I received from youI would like to know whether you have seen it before.? If you have not, I would like to submit it as evidence to support my opinion in point of my response to his complaint.? I would also be interested in your comments, if you are able to make any.In respect of his rebuttal:Re"First": In point of my response I am quoting from his complaint, not making an admission.Re"Second": This contradicts his complaint wherein he states that "...nothing had been done..."He does not deny or refute any of what I wrote in my previous response or offer evidence to support his complaint.The only apology he had from me was for not having time to talk to him when he arrived unexpectedly at my shop.I have not received any communication, by any medium, from him regarding the carburetor.As stated previously, he inspected his car and paid for the work I had done before he took the carHe did not indicate, at that time,? that he was unhappy with the work done or? the time taken.I was not aware that the car had broken down until I received his complaint from you on August 26th., days after the event.He would not, or could not, give me any specific example of my work being defective or unsatisfactory during the two phone conversations which we had (7/& 7/10).During those conversations, although I tried to suggest that it would be appropriate,? he did not offer me the opportunity to examine the car or to rectify the alleged problems.He did not, in his complaint, give any examples of specific problems with, or caused by, the work I had done, nor has he provided any evidence to this effect.He has not offered any evidence that the car broke down or was towed or otherwise transported to his home, or that the alleged breakdown was a result of the repairs I performed.I? will not, therefore, offer any refund other than that which was stated previously as the difference between what he paid me and what he owed me, that is $23.76.Robert A Darling

First Point of answer: admitting he's done nothing to my car four months.Second: Providing my (to do list) only items 3, & were completed - along with gas tank & alt - generously, a days work.Dash & trans cover left off purposely to make easy access.This is a hand made sports car & any year old could remove & put dash together in matter of minutes (screws) to secure.Lastly, his opinion of me is not suprising as he's already apologised for being rude to me.Finally, MrDarling, please return my stromberg carb, as I have already requested? "If not returned in a reasonable amount of time I will have to report it stolen!"Sincerely, [redacted]

my *** *ccount,print out of my work record (*** spread sheet), letters or affidavits from others who saw the carduring the time it was in my shop if required.Please email me with any questions/requests or call ***Thank you.Robert ADarling, Midland Eurosport, Weston, WV 26452.Response to the complaint: 1. Re“Completely restored”: While the car had been restored in respect of its outward appearance (paint, chrome, trim etc.) and, I was told, the engine had been rebuilt, it had a number of drivability issuesThe engine leaked oil the whole time it was in my shop, and the floor panel over the transmission was missing and a number of trim panels had not been fitted leading me to believe that he intended further work after I had finishedMy opinion is that the restoration was not complete2. Re“Minor adjustments”: Since the car broke down on the way to my shop it is evident that the car needed more than “minor adjustments3. Re“Delivery”: The car was delivered on Saturday, May 5th not May 7th, after I had towed it in following an engine failure on the trip4. Re“Nothing had been done”: Between May 5th and July 6th, when the car was collected, there were phone calls between us to discuss problems, progress or parts ordersI kept him fully informed of each major stage in the progress of the repairsHe also stopped by my shop with some friends during the repair period5. Re“Tuning the car”: Engine tuning was not requested in the original manifestTuning the engine was carried out, as a matter of necessity, while I was working on the fuel problemIgnition timing and valve gaps were checked and adjustedThe carburetor was adjusted for a good idle 6. Re“Fixing a few lights”: An understatement of the problemLights were not working due to problems with the harness, fuse box, a bad bulb holder and grounding issues, all of which took time to diagnose and repair 7. Re“Dash etc.”: Once the dashboard and all warning lights were installed, the alternator warning light indicated a problem with the alternatorI called him the next day to ask him to get a replacement alternatorHe was made aware of installation of the dashboard at this time8. Re“Horn”: The after-market steering wheel had a part of the horn button (called a Horn Brush) missingI informed him of this and made temporary substitute9. Re“Held hostage”: When I called him on 7/6/he asked how much he owed meAs I did not consider the car readyI began to estimate, but when I had reached $he interrupted me and said he would bring me $It is a complete misrepresentation to suggest that this was a ransom payment10. Re“Broke down”: The first I knew of this was when I received the letter from the Revdex.com with his complaint attached11. Re“One week”: There was no mention, ever, of a time line or deadline and specifically not one weekAs the car needed engine work which took priority over the specified work, the schedule which I had initially planned had to be abandoned12. At no time between 5/and 7/6, in phone calls and a visit, did he state or indicate that he was unhappy with the progress of the work or the time taken13. I told on him 7/in a phone call and at my shop, many times, that I did not consider the job finishedI had called him that day to ask him to come and inspect my work and discuss what was necessary for completion to his satisfactionI was not expecting him to want to take the car at that time 14. I performed the work completed diligently and professionallyHe took the car before my work was finishedHe did not listen when I tried to inform him of the unresolved issuesHe never informed me of the breakdown on the trip homeHe never gave me details of the problems he subsequently had with the carHe had other people “fix” the car once he got it home without affording me the opportunity to resolve the issuesBecause he had other people work on the car, and because of the time passed, any claim he could make, now or in the future, about problems with my work could not be verified or fairly judged to be a consequence of my work15. Against my wishes, and despite my objections, he took the car away before it was finishedAs I was not expecting him to take the car on 7/I had not prepared a final account or an invoiceThe total amount includes $for the specified work, $for the installation of a new gas tank and other fuel system work, $for the tow in, $for installation of the new alternator and $for parts and sundries supplied, making a total of $+ WV sales tax @ 6% $= invoice total $He paid me cash and never asked for an invoiceI would not, therefore, consider that I owe him any more than the difference between $and $920.96, ie$16. In the light of and 15, above, I do not consider that I would owe him a refund, other than that stated above, for any reason pertaining directly to the work on the car or my conduct in my behavior towards him during that workNor do I believe that anything I have done allows him the right to criticize the way I conduct my business or my personal character17. Finally, it is my opinion that he has contrived, in his complaint, a description of events which is almost entirely misleading and to the point of being false, in order to make his case viable
