On March 14th, 2020 my daughter, in good faith, tried on “a like” dress at the Darla Foxx dress store for her senior prom. The “like” dress was used as a template for the dress they were going to special order. They told her to put a down payment of $310. 50 for special order dresses. (please remember the words ‘special order’).
Unfortunately, the covid virus (presumably) made the store shut its doors just a few days after our down payment. Because the store was closed and we made numerous attempts to see where the dress was with no call back from the store, my daughter had to begin her search elsewhere for another dress because prom was coming up FAST and we needed alterations. We eventually got a cell number to call and we text them that we had been trying to get in touch, they texted back "Hi this is *** from Dalra Foxx. We're still open but just not to the public". Well WE ARE PUBLIC. The ys said the gown came in but we can not come try it on or pick it up because "they are closed to the public". They said "hopefully, they would be able to open by April 6th". "hopefully". We still did not receive a call. We told her that the tailor needs to do something to the dress. The told us " once the dress is paid in full, the 'we' schedule u with a 'seamstress'. We have this is text messages. First we told them a tailor. We have a tailor we have been working with for 25 years. they said, and I quote "we schedule you with a seamstress". So we never got a call of when all that would take place but the store was still closed to come out there and pay apparently because of Covid, but we don't know why is was closed or no calls were being returned. lastly, on the back of the receipt point #2 says: "we will only issue full refund if unable to receive special order". Well if you are closed to the public and we are awaiting your seamstress and not our tailor and this was a special order because you didn't have the dress in the store. WHY ARE THEY NOT RETURNING OUR MONEY???!!!
The dress store was unable to order the dress in the specified color. I asked for a refund since the order could not be fulfilled. The store indicated that a refund was issued on 8/3. It would take 5-7 business days. It was not received. After daily follow up, I was told a check would be issued. I have yet to receive any form of a refund as of 8/20.
I'm responding to your communication dated 8.27.19. Yes the customer is entitled to a refund of $400. I processed the refund and for some reason the refund wasn't being processed by my bank so I cancelled the refund and issued the customer a check. In the interim I went on a business trip to Chicago and was using a debit card that is attached to that same bank account. My bank assumed that the charges being made in Chicago were fraudulent and froze my account and then decided to just close my account. I couldn't even retrieve the funds; I have to wait for them to process and send me a cashier's check for the balance. I opened a new account at a new bank and am waiting for a new debit card so I can access my funds. As soon as I receive this debit card I will complete the refund to the customer in a form of a money order. I did send her a message regarding the bank situation and not to deposit the check until I straightened out the situation but then they just decided to close the account all together. Then I received the complaint in the mail and am now making any responses to you. I apologize for all the inconvenience!!
