[redacted] D. [redacted] sold us our home with the understanding that the common area would be titled to the HOA and we would be able to use it for recreational purposes. He has retained the title and has now submitted an application to the land use office to use the common area lot to build another home.
Every homeowner in [redacted]'s [redacted] Subdivision has been told that this common area was for our recreational activities and would be owned by the HOA.
