In response to *** ***'s (client) complaint about our company, we have paid the client all monies we have collected, minus our commissionsWhen we met with client in June 2015, from what we learned on how client bills their patients, we
realized at that time there was an issue how we were charging interest and posting payments on the client's accountsThis client charges interest up to the date of assignment to collections, which we were not aware of until this timeWe were charging interest from Date of Service, which is a common practice in the collection industry and allowed by law, in the state of CaliforniaWe tried to explain this issue to the client, but many times were told to "be quiet and to stop talking"We did take steps to update each of the accounts by refunding any interest payments made to us, from the patientsWe sent these refunds to the patientsThe client requested we send this money to the client, but the client did not make the payment, the patient didWe also took steps to refund any of our commission that was taken in error, which we did and presented detailed reports to support this
As far as not being able to collect on accounts that are years and months old, is simply not accurateA collection agency can pursue accounts and place the account on the patient's credit report for up to seven years from date of serviceIn our year history, it has been our experience that accounts don't actually pay until a few years down the line when people get "back on their feet" financially and are able to take care of their debtThe only limitation on collection activity, for this type of business, is a four year statute on filing any LEGAL action from the date of service
Regarding the settlement offer from client, this is simply ridiculousIn every contingency collection agency in America, there is no guarantee of the return on the amount assigned for collectionsI'm sure *** *** never made a guarantee of how much would be collected from the $191,assignedWe NEVER make a guarantee to any client of how much will be collected from their assigned amountThe industry recovery average is all over the map depending on various factors: (age of account, type of debt, client services, age of guarantor, job status, demographics, time of year, etc.)
In Summary, after meeting with the client in June 2015, we quickly corrected any collection errors that may have been made in the acquisition of these accounts from the *** *** purchase

This account has a charge off date of 1/31/2010. The credit reporting agencies keep accounts on their system for about 6 years, 9 months. At this time, we believe this account is accurate and will stay on the consumer file.

two validation letters to the consumer in recent months. We would be happy to help consumer settle this debt, if they so choose to.

The response by Data Central is not acceptable.
They mention the "charge off date of 1/31/2010" - however, this information is irrelevant.
According to the Fair Credit Reporting Act, negative information may remain on the credit report up to seven years from the DATE OF FIRST DELINQUENCY, which in this case is June 2016. It makes no mention of the charge off date.
It is obvious Data Central is still violating the Fair Credit Reporting Act.
I demand that Data Central remove this inaccurate information. I have already filed a complaint with the Consumer Financial Protection Bureau and will consider filing suit if this is not promptly resolved.

We are not violating the FCR. The date of first delinquency is the date the account was charged off, not the date reported to your credit report. Due to the consumer response, to basically defraud the creditor their due money and to continue to argue the matter, which is minuscule at this time, we will request this debt be removed from the credit bureau. This process can take up to 90 days depending on the bureau.

I am pleased that the company will remove this trade line, although I still disagree with their understanding of a "charge off date" vs. a "date of first delinquency".
