I guess the best way to explain this is as follows: say that someone
gave you a nice flat-screen TVYou tossed your old tube TV in favor of
this nice flat-screen, got an entertainment center to put it in, bought a
nice Blu-ray player - all because you now have this nice TVA couple
of months later, the police knock on your door and say, "the TV you have
was stolen, we traced it to you through the person who gave it
to youIt was not theirs to give and the rightful owner wants it
back." The police take away the nice flat-screen TV and give it to the
rightful owner
You no longer have the new TV or your old TV, and
given what has transpired, you now either have to acquire a replacement
or go without TVOf course you are mad, but whom should you be mad at?
The person whom gave you the TV, that's who! It was not theirs to give
to being with! The rightful owner took it away, but it makes no sense to
be mad at them - they are victims too!
This is the exactly the
situation we are in as the rightful owners of the IP address space that
was being used unlawfully to host Ms ***y's websiteMs ***y is mad
because her
current host put in her this situation through his actions and did not
protect her when it became obvious that he would be forced to return to
us what is ours - and it happened when she was out of town, so she did
not
know until days laterI'll reiterate that Ms ***y told us that she
did not have a copy of her hosted content - I was one of the people that
talked to herI told her that, since she did not have a copy of her
content, which would have allowed us or any other hosting
provider to get her site back up, the best thing for her to do was to
contact her current host and demand that he immediately get her existing
site back onlineApparently that is what she didIt's true that we do
not offer free hosting, but if she did have access to her content we
would have done our best to work something out with her so that she
could have her site back upAs I said, that was never an option due to
the circumstances
Again,
we regret that her existing host's laziness and inattention to clients
led to her site being down, but her anger and her complaint is
misplacedWe did not do this to her - her current host victimized her as he victimized usAs such, we
ask that the Revdex.com remove this complaint

appreciate Ms [redacted]'s position and we are sorry that she has been
negatively affected by this court-ordered action. However, she has
registered this complaint against the wrong entity. She finds herself in
this...

unfortunate situation because of the (in)actions of her hosting
provider ([redacted]), not because of us. We have merely been awarded what
was already rightfully ours in accordance with the law. Her hosting
provider was using IP address resources that were not theirs to host her
website. They had received clear indications well in advance of this
action that they would need to return our resources to us. They could
have taken that opportunity to correction that situation so that their
clients, including Ms [redacted], would not be affected by the inevitable
outcome. They did not. In fact, according to Ms [redacted], for at least ten
days after our resources were returned to us by judgement of the court,
her hosting provider still had not restored her hosting account, which
they could have done at any time. We received many other calls and
contacts from other clients of this hosting provider, who were similarly
left in a lurch because their provider failed to issue them new IP
resources in advance of the reclamation of our resources by us. All of
them seemed able to grasp the situation and place the blame where it
rightfully belongs: at the feet of their hosting provider.
Again, we sympathize with her situation, but the dereliction of duty
exhibited by her hosting provider is not our fault. We would have
offered Ms [redacted] a hosting account, hosted by us, which would have
allowed her to keep the IP address that she had before, but she
indicated that she did not have access to the content so there was
really no way we could help her, other than to suggest that she contact
her hosting provider and demand that they rectify the situation -
something that they should have done weeks ago.
It
was only after months of legal work and considerable cost that we were
finally able to reclaim the IP resources that have always been
rightfully ours. Allowing this compliant to stand just victimizes us
again, wrongly blaming us for the (in)actions of others. We ask that you
please close this complaint.

I am rejecting this response because: the point of my complaint is in direct relationship to your treatment.  You may have had the right to turn everything off however, that does not mean it was the right thing to do.  It is your actions as a company , and the abuse of power that I have issue with.  
 
You are in a highly competitive business and what sets apart excellent service is the commitment to doing the right thing while you had the legal right it still was not the right thing to do, and potential customers need to know how you as a company conduct yourself when you have all the power.  If you felt good about what you did and your public imagine you would not have a problem with the perception of what you did.
 
The truth is you were in a position of power and could have done the right thing and chose not to - own it!

Review: Our site is being hosted at no charge (it is donated) as we are a very small 501 C 3 by [redacted]. Apparently, Datacate and [redacted] are in a legal dispute according to the gentleman I spoke to last night and again this morning after receiving numerous emails and calls from my concerned clients that our site was down.I checked into the situation immediately and found this note where our site should be...You are seeing this page instead of your content because IPv4 address space in the range [redacted] - [redacted] was revoked from [redacted] Inc as the result of a Court Order, effective at approximately 2pm on June 26th of 2014.The IP range has been transferred to our company in accordance with said Court Order. If you would like to keep your IP assignment(s) from the range [redacted] - [redacted], please contact us to discuss hosting / colocation arrangements.Please use the contact form here or call us toll-free at [redacted].Best, Datacate TeamI did as the note requested and called the number to which I was told there was nothing they could do even when I asked about paying them to host our site.We are the injured party stuck between two for profit organizations. Our site is being held hostage and they will not turn it back on or give us our site so we can make other arrangement. The unprofessional behavior of this company is unacceptable. All of this could have been avoided with simple straight forward communication instead they behaved in a very underhanded way that is affecting our reputation.Desired Settlement: Would like our site back up and we will move it ASAP, but the note that they have put on it impugns our reputation when the truth is we have nothing to do with the legal proceedings between these two companies.
