To whom it may concern: I, Dave B[redacted] signed a contract with [redacted] C. [redacted] for construction of a d[redacted] on 6/12/2015. I very carefully explained the entire contract with him and how and when all payments were due. I began construction on the d[redacted] shortly after contract signing. [redacted] paid the first...

installment and construction was proceeding much ahead of schedule. After we obtained the first footer inspection from town, which was satisfactory, he towncode enforcement officer explained that their town requires additional flashing to include full coverage of d[redacted] plate attached to house. This additional flashing was not included in contract and was not specified on architectural plans. I informed [redacted] that this would require much more labor and material. I explained that I would need additional payment to cover the additional material right away, and that I would charge him for only the additional labor after we finished additional work and knew exactly bow long it took. He agreed and said "No problem". He wrote me a ch[redacted] that day for the additional cost of material (2 rolls trim coil). It 1s important to know that this additional flashing work is not normal and not considered typical installation in most towns and municipalities, and was not stated as work to be performed on the contract, and was also not stated on the architectural plans. Work continued at an excellent pace and was far ahead of schedule. We were now ready to begin the railing installation. In the contract [redacted] had agreed to a railing from lows that required handposts every 5-6' and rail sections to be installed in between those handposts. When we began, we quickly realized that the railings he purchased where entirely different, and the railings had to be completely assembled first and then installed in-between posts. This was not acceptable to me considering that in the contract it states that we would be using rail sections, not railings that had to be assembled. This would drastically increase the installation time of the railings and more than double my labor cost for the railing potion of the project. l explained this to [redacted] and he told me "no problem, just keep going'"' as he wanted completion for and upcoming event with his family. I also had to purchase additional materials for the project, which [redacted] was supposed to provide as stated in contract. He told me that he would gladly reimburse me for additional material that I bad to purchase, just as long as we kept going on the project. We continued on the project almost to completion. After I exhausted all monies collected from [redacted] and almost S2000.00 out of my own pocket, I then gave him the bill for the extra charges so that l could continue and finished the project. He adamantly refused and said be would not give me another penny. He ordered me to finish at once. I told him that I could not financially finish, and that I would not finish without the payment that he agreed to earlier. So after this incident I had no choice but 10 stop work completely. I explained to him that if he at least paid me a portion of his balance I could continue. He sternly refused. Please carefully consider the following:1.) The d[redacted] was constructed exactly to the architectural design.  r adamantly dispute his claim otherwise  Please note that the town of Manlius requires different guidelines for stair widths and landing sizes. Work was performed to exact specifications as in architectural plans, as was stated in contract.  2.) I never received the full amount of the contract to this very day. I also never  asked for additional money in advance. All the money for additional work inwhich he verbally agreed to pay, was not asked for until all the additional work  was fully completed.  3.) I fully communicated about how to correct the problem of the stair issue. I told him that we could have the architect write a letter to the town stating that the stairs built as in the plans was satisfactory and he would sign off on it. I explained that the architect would charge an additional fee for this. Me and [redacted] talked  extensively about this and [redacted] wanted me to try to get the architect to do this for free.  4.) After 1 asked for payment, he stated that he would not pay me additional money,  ever, under any circumstances, as he earlier verbally agreed to. He also indicated that he wanted to wait for a final inspection from town before he would be willing to discuss any payments. 1 bad previously explained at great detail that l could not wait for final payment until after the town final inspection. He agreed and signed and initialed this on the contract.  5.) He also never paid the permit fee as he agreed to in ·writing as in our contract I paid for the permit fee of$ 500.00. I will enclose this receipt He called and texted me. I did speak to him on one occasion and told him that I could not and would not finish this project without payment. He owes Dave B[redacted]'s Remodeling a total of$ 2805.46 $ 1388.00 for additional work (completed and verbally agreed by [redacted])$ 417.46 for additional materials (verbally agreed to be reimbursed by [redacted])$ 500.00 Original final balance of contract (signed and initialed by [redacted])$ 500.00 permit fee (verbally agreed to be reimbursed by [redacted])lf he agrees to pay this amount as stated in the contract and contract change order, l would gladly finish his project.  If he does not agree to this in a timely manner I will have no choice but to proceed  with a small claims action.I will enclose a copy of the contract, contract change order, receipt for my payment of architect fee, and a copy of the building permit, and also a copy of his certified letter to me.  Please feel free to contact me directly on my cell at [redacted] or at my office at [redacted]. I would like to apologize for my late response as I was out of town several times and very busy.   Thank you, Dave B[redacted]
