Initial Business Response /* (1000, 15, 2015/09/14) */
We have been in business for almost 40 years doing auction. Unfortunately the [redacted] do not understand how auctions work and that you do not always get what you might think somethings are worth to yourself.
The items were sold on auction...

and I tried to explain to them the items that were is questions with the email below. Some of the items had different names such as end table versus coffee table another example would be they called an item a chain hoist and said it wasn't on their list when in fact it was called block and tackle on our description.
They apparently thought that dishes have value, as they need to be bottom marked to have value and yet the market on dishware has gone down in the last years. The items are only going to bring what someone is willing to pay for them.
I hope this helps explain out situation with the [redacted].

Initial Consumer Rebuttal /* (3000, 18, 2015/09/14) */
(The consumer indicated he/she DID NOT accept the response from the business.)
My husband and I went to the first auction which was April 2 where they auctioned off some of the items that we brought in. They pulled our clock from the shelf and auctioned it off by itself and one of the helpers bought it. The clock isn't listed on the printout that they gave to us for that auction date. The only dishes that are listed was on this date as well. The dishes in question which are the gold trim China Sets were NOT auctioned off with the rest of the dishes. When my husband asked them on July 10 they said that they donated the dishes. We were not asked if it would be okay to donate the dishes. Now they are stating that they sold them at the first auction. The dishes were brought in on April 7 so I am not sure how they could sell them on April 2 when they weren't there yet. We brought in 5 end tables and a couple of coffee tables. They sold 4 end tables at this same auction. The coffee tables were not brought in until April 7 so again I am not sure how they sold something that they didn't have yet. After they stated that they had sold all of our items that we brought in they then sold a snowblower and ice auger in mid July. It was brought into them in March when there was still snow. They sold it after my husband went with the list of items that were not listed on any of the printouts that they gave to us. I would not recommend them to anyone nor would I ever do business with them again. We have been to many auctions and we do know how they work and how the larger items are listed. They are usually listed either separately or with something else but they are listed. I have all of the printouts from the auction company and I have the list of items with dates that I made and the auction company took copies of them when my husband was bringing the items in to them. They seemed like they would be honest.
Final Consumer Response /* (3000, 22, 2015/09/21) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I was not disputing the end tables. I stated that the coffee tables were not brought in until April 7 and the end tables were sold on April 2. They had stated previously that the coffee tables were sold with the end tables. That would be impossible since they did not have the coffee tables yet. They also stated that the china sets were sold as dishes. The dishes are on the April 2 printout. The china dish sets were not brought in until April 7 so they could not have sold them on April 2 as dishes. They need to read what I am stating and not reword it to something that I am not stating. If all of the items that were brought in have no value why didn't they tell us that when my husband was bringing the items in? How do they make money if so many things have no value? I have been to many auctions and we have put things on auction with another auction company and didn't have the problems that we are having with Dave Miller Auction.
Final Business Response /* (4000, 24, 2015/09/29) */
Good Morning!
Received your responds today. I don't believe that I can state anything that will make them happy. I do know that all of their items were sold. We sell for over 500 + customers a year, and am sorry if we did not explain out policy of items that have little or no value clearer to them. I think it was a misunderstanding of value of items. If they would attend one of our auctions, they would see how those type of items are sold. We do the same thing each week with box lots of low value or no value items. Again items are sold and described differently per auction company and customer.
Thanks,
