The statement and claims by the [redacted] 's are falseHe did let us know he would have to cancel the work, after our company spent nearly hours working with distributors to get the cheapest materials and discounts on all products under our company nameOnce all invoices were finally generated they client began insinuating that he wasn't going to pay for materials and wanted us to pay for them, even though all contracts stated he was responsible for materialsThe night he told us he needed to cancel the job 3/2/17, I explained to him that I would talk to our accountant and get the funds together to refund him, but I had spend many hours on their projectServices that are included in the bid we write, at the [redacted] 's were told the day they signed their contracts by my husband Adam "my wife will handle the invoices and materials once you pick out the tile she will get everything together and ready to be paid for, and she will find all the best prices on materials for you"On the morning of 3/3/my husband called [redacted] back and told him "we will send you a refund and some paperwork" [redacted] was fine with that, but called right back and said he would like to go ahead and do the downstairs bathroom anyways and we would do the upstairs laterWe said that we didn't mind doing that and I began changing the invoices so they would only have the materials for the basement bathroom and were ready for purchaseWe were about days out from this project and the client knew we had to order materials at least days prior so they would be in on timeThe clients down payment covered the entire basement bathroom project with an over payment of $782.05, which at first the client wanted back before we start and we agreedBut then the client said he wanted us to either pay that back plus half of the deposit for the bathroom till it was done, or us purchase that amount in materialsWe were advised by our lawyer not to purchase any materials for the job, as the client has already been a lose cannon towards our company due to no fault of our ownWe told [redacted] that we would give him a check for the $and do the basement project in a week and be out of there, no problemsHe refusedOur lawyer informed us that if [redacted] refused our offer, to walk away from the job because there is no telling if we would ever even see the final payment from this client if we did the work, because of the way he was already acting, because of a previous builder in no relation to usOur lawyer said to inform [redacted] that we would send him a refund minus our billable time spent on the job as well as an invoice for all the work we did ordering materials and planning the job [redacted] was not happy with this and said he would be talking to his lawyer (from the previous builder issues) about us as wellI informed [redacted] that if he is represented by a lawyer that we can no longer speak to him and he would need to provide us with his lawyers contact info, which he never didWe have continued to make every attempt to resolve this matter, even offered a full refund in the beginning which he denied and wanted to move forward with the jobThere is no making this client happy, and now because of the issues he has had with another builder, he is running a smear campaign on our company, that has never had a bad review, and all of our clients are always happy with our work as well as working with usWe have made it through a year on referrals and repeat customers alone, because we try to do everything we can for our clients, unfortunately this is one client that will never be happy with the outcome with us because he is mad at someone else and taking it all out on us, hoping it will fix everything

Again the client is making statementsOn 3/3/at 8:19am adam called *** *** and told him we would be sending him some paperwork and a refund the following day, *** said "alright thanks" after they hung up, *** *** called Adam back at 8:39am and said he would rather do the basement bathroom than to receive a refund and that he would talk to the inspector to get the basement bathroom approvalOn 3/3/*** *** text adam at 9:06am to let him know the inspector said we could do the work on the basement bathroom, but only the basement, and said that would mean he over paid us $for the entire job now that we can only do the basementWe informed *** that we are more than willing to refund the $that was overpaid and still start the basement project as scheduled and finish on time as we plannedThen there would be no final payment due*** was not happy with this arrangement and asked that we purchase that $in materials as well as half the labor costs and he would pay us back the half of the labor costs when the job is doneWe explained that because of how things have gone we do not feel comfortable purchasing materials for his home, and that he knew he was responsible for materials from the beginningWe consulted with a lawyer and he confirmed that under no circumstances are we to purchase materials, and he advised us not to give the ***'s any money unless they were cancelling the entire project, because they are unlikely to actually pay us, given the chain of events and how untrustworthy it felt working with ***The lawyer advised us and we gave *** his optionsEither we give him the $back and do the full basement bathroom, or he cancel the job and we send him a bill for the time we had already put in along with a refund of the remaining balanceHe did not like either option because as he put it "we wouldn't have any skin in the game", when clearly, as we sit here, our reputation WAS our skin in the game, and after he chose not to go with the work, he still decided to attack our reputation through Revdex.comAs our previous response stated, our company has grown and thrived solely off of word of mouth, the referrals we gave the ***'s were a lawyer and an interior designer, and that's after they got our card and referral from a tile vendor, whom *** had threatened on the phone to me if we didn't do things his way, he would call our vendor partners and slander us to them as well on 3/1/at 8:20pm, when I would have been reading a bedtime story to my children, but instead I was on the phone with the client, who insists I should not be paid for the time I spent on his projectNo matter what the work was that was performed on this project we account for that and roll it all together in our bidsYou are paying for any and all of our time spend on your projectsAny time I have spent on your project, was valuable time I wasn't spending with my children, or on other clients that were actually going to get work doneThat week slot that we blocked out for you, that you cancelled a week prior to the work is a slot that we can no longer fill with another $8,projectWe lost time, customers, and money on going back and fourth with *** *** and we deserve to be compensated for that timeHe chose not to get a finished bathroom included in all of thisWe have already gotten our billing statement drafted and a check sent out to *** *** for the UNEARNED funds on this file

I am rejecting this response because:Attached is the contract and list of material, there were no line items for shopping around for pricingWhen Adam was out at our property quoting the job, he reported that he had a list of prices from various tile and construction vendorsWe did not send tile selections till late afternoon of Feb 27thMy wife and I went to two tile shops to pick out tile, those selections with product numbers and pricing were sent to Everest Customs that eveningWe notified Everest Customs on Wednesday March 1st at 5:54PM regarding our construction/permit issue and and asked to cancel the project and to meet somewhere to have our deposit returnedAt 7:Wednesday March 1st, I received a message from Stephanie stating, " I went over things with adam, and our accountantThe accountant says that he has already allocated the funds for the GL, MV, and WC as well as some other company overhead and my payroll for time spent on the jobWe are going to work on things tomorrow to see where we can afford to pull money from to give you a refundGenerally we do not do refunds on deposits because we book many people in advance and when there is a cancellation or reschedule we loose income for that entire time slot with no time to schedule someone into it." "Please be sure to send over your lawyers information if you don't see any further communication with us"I have documentation of these communications via textI tried to work with Adam several times because I did not feel it was appropriate for them to take money out of the deposit for Stephanie's business managementWe were never told they would give us a full return of our deposit or we would have gladly accepted the offerI am not sure about the reference to the smear campaign, we have only contacted the Revdex.com and are waiting for a call back from a lawyer
