Here is Dave's Gunsmithing's response to the complaint from [redacted] You will see from the attachments that we made quite a few attempts to contact this customer. On 4-28-2014 Clinton [redacted] brought a [redacted] M4 .22 LR Carbine in to be repaired. The gunsmith looked the gun over and informed Mr...

[redacted] it would be expensive to repair and if it was sent back to [redacted] that all Mr [redacted] would have to pay is the shipping to [redacted]. At the end of 2014 Mr [redacted] came into the store to check on his gun. We had told him that the companies are usually backed up and it could take months. We told him to check back every 2 weeks. As you can see we received a firearms shipment approval letter from [redacted] on 1-29-2015. We received the firearm back in early Feb 2015. We tried to contact Mr [redacted] but there was no response. We sent certified letters to the address given. On the second letter a woman called us and said that house was empty when she moved in a year before. If I had a firearm in for repair we would update our information so they could call us. We looked up the cost of that firearm and our competitor was 559.99 not 700.00If you look at the repair ticket we let the customers fill out the workorder. He gave his phone number with one number wrong to his real number. We had actually in addition tried looking him up on [redacted] and [redacted]. Mr [redacted] called us again on 3-14-2016. I answered the phone and Mr [redacted] asked about his rifle. I informed Mr [redacted] that it was sold and why. No one was rude or loud or nasty to Mr [redacted] We talked to him in a normal voice. Mr [redacted] was the person who got very angry and making statements back. I asked Mr [redacted] 3 times where he was all this time but he would not answer me. We have to dispose of firearms that have been in our custody too long of a period or sell them to pay for our fees of shipping and storage. We have inspections from the [redacted] and [redacted] and I have to be given write-ups from them for having the guns stored too long. We do charge a 5.00 per day storage fee if firearms are left in our possession and after repeated letters and phone calls the fees start. His storage fees would amount to 1,200.00

Gentlemen,Dave's Gunsmithing agreed to call me to pick up my air gun which I already did a few days ago. It wasn't repaired.Thank you for your assistance.[redacted]

I am rejecting this response because: I will start by saying that I did estimate the 700 so I will just believe the price he provided. However he was very rude when I spoke with him asking where I have been which I did respond by saying I have been in Yuba city the whole time I had just moved and got a new job. He probably didn't hear that because of his rudeness trying to speak over me the entire time we spoke. I don't believe I wrote my number down wrong because he did call me back 1 time so how did he not have my number? That doesn't make any sense at all. And if I was running a business I would update my customers when I change my phone number or at least check the messages from it as I had called his old number  which was [redacted] too many times to count. I wasn't able to just go into his location anymore because his shop is closed the same days I am off work Sunday and Monday.

Review: Gentlemen,

I brought in my .22 [redacted] air gun along with the air pump to your store for possible repair in early or mid March 2016. I was advised that it would take about a month to repair it. If it needed repair, you would have to order the seal.

After a month gone by, I called several times without being able to reach anyone. One time, I left a message with a woman. She said she would leave a message for her supervisor to call me. My call was never returned.

I also stopped by more than three times, but your office was closed. The last time I was able to talk to a lady in person in your office was on the 3rd week of April 2016. She told me that your office was going through your paper works and calling customers. So far I haven’t heard anything.

If you can’t fix my air gun, just give me a call and I will pick it up to other gunsmithing stores.

Sincerely,

[redacted]Desired Settlement: If you can’t fix my air gun, just give me a call and I will pick it up to other gunsmithing stores.

Response:

Gentlemen,

Review: I brought a 22 caliber gun into Dave on 4/23/14 because the weapon would not come off safety. After having it for a week Dave said he could not fix it and would have to send it to the manufacturer to be repairs and that could take 6 months or longer to get it back. After a couple months I called multiple times for an update, when he finally called me back he said it just takes a long time and he would call me back with an update. I am off work the same days they are closed so I was not able to just go into the store. After about a year I kept calling and calling only to get a message saying the magic jack customer could not take any calls at this time. About 2 weeks ago I finally found out they had a new number and called it about 7 times leaving messages every time to call me back. Today 3/14/16 I finally got ahold of them to find out they sold my gun. Dave told me very very rudely that they sent a letter to my house that got returned to them because I had moved and that he could not call me because I wrote my number down wrong, which is not true at all and if so how did he call me back last time then?!?Desired Settlement: I would like my gun back but since he sold it out from under me I would like a full refund of the purchase price

Tell us why here... We did notify people about our phone number change. The phone number is also posted on the door. Had he came by the shop he would have seen the number. We have not heard from [redacted]s the middle of January 2015. He came by and he was notified then that his weapon was being shipped back and we should have is soon. As soon as it came back we tried to notify him with no response. Also, we are closed Sunday and Monday BUT we are in the shop on Monday's. We are just not open to the public. He was told that, he was also told he can come by on Monday's just knock. It is not my job to track you down. We ask for that information for a reason. He could have also contacted us through e-mails. The only time I have spoken to Mr. [redacted]'s is when he had come by the shop. We were never able to contact him with the number we were given. We fund out his number when he called recently. We did everything we could to contact him. We are only requires to hold the weapon for 90 days or when the storage fee's are higher then the cost of the repairs. We contacted Mr. [redacted]'s twice by registered mail and once by regular mail and held the weapon 5 months longer then we have to. I was not rude. I did however state the facts and ask Mr. [redacted]'s where he has been. He should have came by the shop he knew in January 2015 his weapon was on the way back.

Review: Paid for parts and never got them. Company is ignoring my messages and calls.

Company cashed my postal money order for parts I bought from them and have not sent them. Its been over a month. Company manager was extremely rude, cussing and yelling and is not ignoring my messages and calls. Desired Settlement: I want all the parts that were promised to me. I want the original parts I ordered and the ones [redacted] said he was going to throw in for not shipping right away the first time.

In mid July 2013 Dave's Gunsmithing had joined a chat page with other members of Facebook. Mr [redacted] had asked members in the forum if they had some very old and hard to find parts. Dave's Gunsmithing is a very small business with 5 employee's. On this forum there are over 5,000 members. Mr [redacted] the founder of the company had informed Mr [redacted] that he might have the parts he was looking for and they could fit many old revolvers of that same class. Mr [redacted] informed Mr [redacted] if he sent 60.00 Mr [redacted] would look in his old parts for what he wanted. Mr [redacted] has been an old gunsmith for over 30 years. Dave's Gunsmithing is a small gunsmith shop with a retail up front that is run by Mr [redacted]'s wife [redacted] She is assisted by our sons and one of our son's girlfriends. [redacted] operated the back of the gunsmith shop repairing the guns. We repair a lot of guns per week and the front of the retail are told what parts to order for the guns. About 500.00 to 1,000.00 dollars of parts are ordered or replaced per month. About 3 days after Mr [redacted] requested these parts Mr [redacted] had a heart attack and ended up in the hospital. Everything went into chaos with parts and firearms. [redacted] my wife had just started learning the gunsmithing trade about 1 year prior when Mr [redacted] and [redacted] were married. [redacted] was checking the messages on facebook and [redacted] started on about the parts he was promised for a gun. [redacted] stated what had been happening that Mr [redacted], [redacted] had a heart attack and she was trying to find out what and where [redacted] had left off with the business. Mr [redacted] stated he did not care what happened to [redacted] that he ordered parts from [redacted] and [redacted] did not send them to him. [redacted] was explaining it was hard to communicate with [redacted] in his condition and wanted to know what the parts were because [redacted] had collected old parts for over 30 years and all she could do was look for them. Mr. [redacted] stated he had better get his parts or he will report our company to the police and a lawyer and give our company a bad name if we did not send him the parts he asked for. Mr [redacted] was told by [redacted] over 2 weeks after the going back and forth that he was not allowed to go back to work or out from the home until he was cleared by the heart doctor. [redacted] was and still is very sick. [redacted] also told [redacted] if he could get back to work and remember where he had the parts stored at he would give him a few extra's for the inconvenience. Mr [redacted] started to get real aggressive and threatening and [redacted] told him to stop being so threatening. [redacted] was getting upset being called names and being threatened that Mr [redacted] told Mr [redacted] that we were going to cut him a money order and mail it back to him. Mr [redacted] got even more threatening that [redacted] informed [redacted] that we were not going to find and mail parts to an individual that was threatening. [redacted] will not swear or call people names on facebook. [redacted] was never talked to on the phone by either [redacted] or [redacted] We were informed by our customers that [redacted] had posted derogatory information about our business all over the internet on different sites. No person from Dave's Gunsmithing or [redacted]'s wife [redacted] ever made threats or swore at Mr [redacted]. That has been a policy since our business started if threats are made to our business or employee's we will not send firearm parts to any individual. Our employee's and Mr [redacted] stated to Mr [redacted] we would mail him a money order and return his money but not the parts. Mr [redacted] keeps demanding the parts. The Money Gram for the 60.00 is issued from Walmart and the number is RXXXXXXXXXXXX. If Mr [redacted] does not cease the threats and ruining our business we will have no other cause but to inform our attorney for further action.

Consumer's Final Response

(The consumer indicated he/she DID NOT accept the response from the business.)

This is a complete lie and I have all the messages back and forth for proof. Lets start with our first contact.

"Hi [redacted], its long distance for me to call. I am hoping you could give me a price breakdown on here. What would you charge me for the entire ejector assembly (including; Tube, spring, rod, screw and bushing), The whole parts gun and what its missing. And then just the rod, screw and bushing? Thanks [redacted]

Dave's Gunsmithing

I know I could hold people almost ransom on this because I know it is a hard to find gun for parts and most places would gouge you. Luckily you have a fellow gunsmiththat did not get into the business to rob people but just the opposite. I was looking on gun parts corp at prices and the ejector rod is 11.25, the spring is 3.50, screw is 3.00 and the ejector tube is 14.10. I will give a discount. I was looking at the cost for the other parts and they are pricey. The cylinder goes for 60.00 the back strap 30.15, barrel for 58.10 and hammer 30.00 and thats just those parts."

After agreeing on a price and mailing a money order here is our next conversation.

Dave's Gunsmithing

"Mike when I talked to you last I had them boxed and ready to go before I had my heart scare. I am in the shop tuesday and they will go out that day.

June 27

10:03pm

"Hi [redacted], hope all is good. I would like to confirm the parts did ship out today. Thanks"

12:25am

Dave's Gunsmithing

"Actually no he had to go to the hospital this morning had a small attack have it here on the counter ready to go out tomorrow. This is [redacted]'s wife [redacted] he told me to make sure it goes out priority mail tomorrow. Sorry for the delay."

June 28

2:31pm

"Sorry to hear that hope they are treating him well. Can we confirm that it did go out today. Thanks"

"Hope all is well with [redacted], I would still like to confirm that these parts did go out."

5:47pm

"I can see that you saw my message yesterday at 5:16 pm and my message today at 4:22 pm. I wish [redacted] the best, I just want to know if my items have shipped. Thanks"

6:35pm

Dave's Gunsmithing

"This is my dad's daughter I am writing down messages he is in the hospital and I texted my Mom. I will let them ok."

8:27pm

"Alright thanks."

June 30

3:45pm

"Any word on if my parts shipped?"

4:21pm

"Still no parts in my mailbox. Trying to be patient here, was told twice they were shipping out. I understand [redacted] is in the hospital but he told me they would ship. Is he the only person that can send mail?"

July 6

11:28pm

"Its just kind of frustrating when I see you post about how terrible (and I agree) [redacted] is on your page, but you cant tell me when or if my parts have shipped."

11:46pm

Dave's Gunsmithing

"[redacted] didn't post that I did! He hasn't been on the computer. It's either me or an employee or one of our kids. I have been running this by myself because [redacted] had a mild heart attack so I am doing the best I can."

11:50pm

"Oh okay. Well again, I do hope [redacted] is okay I unfortunately had to go though this with my father last year. Have you had a chance to mail my parts? They are for a customer and I have been telling him they are on the way. If they have not mailed yet could you let me know when they do. Thanks."

July 9

2:46pm

"Alright this is it I'm starting to feel like this was a scam from the get go, I have tried being nice all I can. You don't answer me, you wont tell me when or if my parts have shipped and you ignore my messages. I'm giving you till Friday of this week to tell me my parts have shipped, if I don't hear from you by then I'm going to let everyone I know and post it all over the Internet not to do business with your company because you are a scam! I will contact the Revdex.com and the police in your area! I paid for my parts and I don't get them. What do you expect me to do! This will be the last time I contact you."

Now as you can clearly see from the above messages that [redacted]'s response is a complete lie. He did not tell me to send him money and he would look. He told me he had the parts and we discussed them at length along with the price I would pay. [redacted]'s statement that read, "Mr [redacted] stated he did not care what happened to [redacted] that he ordered parts from [redacted] and [redacted] did not send them to him" Is no less than a slap in my face. As you can see from the above messages I was being nice and wished [redacted] well on many occasions. This lie kind of hurt really.

I have all of our messages and emails [redacted]. You might want to consider that when/if you contact an attorney. You just lied to the Revdex.com and I have it all on record here. Today is August 21st and I still don't have my parts or a refund. I will continue to inform everyone I can that you are a scam and can not be trusted. No one deserves to pay for parts and not get them.

YOU TOLD ME THEY WOULD SHIP TWICE, PROMISED ME FREE PARTS, THEN I WAS TOLD THEY WERE IN A BOX READY TO BE MAILED. YOU DROPPED THE BALL HERE [redacted]!

Business' Final Response

Concerning the open case with [redacted] I wrote my last comments to close this case. Things did get out of hand because when I first started dealings with Mr [redacted] I was not doing too good and had a heart attack. I had a small business where I was just a gunsmith and when I had this heart attack 3 month's ago my wife was trying to run a business she knew nothing about. I sent Mr. [redacted] a money order for 60.00 to reimburse what he had sent so this matter was supposed to be settled. I am trying to settle on my end and close this out. Mr [redacted] seems to be dragging this out.The Money Gram for the 60.00 is issued from Walmart and the number is RXXXXXXXXXXXX
