We are resolving the issue with the customer.  The shop has been impossible to reach and the customer is aware.

Cancellation laws are set by the state and not by the warranty company.  The cancellation law in Virginia states that in order to cancel your policy, the vehicle must be stolen, repossessed or a total loss.  We cannot cancel a contract because the customer decides to get rid of the...

vehicle.  Our hands are tied.

The coverage I have, on the contract I signed, gives a very broad description of what it covers.  "All internally lubricated parts and components."  Every mechanic I've talked to, including the ones at [redacted], where I brought my truck for diagnosis, say that head gaskets and injectors are internally lubricated parts and/or components.

Mr [redacted] has a 12 month Powertrain coverage.  Diamond Warranty offers stated component coverages, which means we will cover what is listed under the contract that is purchased.  If it is not listed, it is not covered.  If it is listed under a coverage that has not been selected it is...

not covered.  The parts that were called in for failure are not internally lubricated as he suggested.  The Cylinder Head gasket is a covered component only under the Security Plus coverage.  The injectors would only be covered under the Enhanced coverage.  The Engine Cooler is not listed as a covered component under any coverage.  The Fuel pressure unit is also listed under the Security Plus coverage.  Please let me know if you have any further questions.  Thank you!

Cancellation amounts are pro rated by time/miles used less any claims that were paid. Diamond Warranty paid out $1190.00 in claims.

I am rejecting this response because: it is confusing and I have not received the amount of $1,199 as the business has indicated.  This really has to do with a repair claim that was incorrectly denied (not a cancellation refund).  Either way, this complaint is still open as no payment has been received to date.

Complaint was not satisfactorily resolved and I have since canceled the warranty with Diamond Warranty, leading to this complaint. I did receive a refund for a portion of the warranty price, per their own cancellation form this should have been based on a percentage of the unused warranty based on time or miles remaining. While I believe due to the nature of my original claim this should be 100% reimbursement, the reimbursement of $1000 for a $1795 purchase price is approximately 56%, my calculations based on their own documentation should be greater than 92% of the purchase price at a minimum.Refund the remaining $795 purchase price.

Diamond Warranty contacted the dealer and the dealership advised that the customer was refunded.  If this is not the case, please let us know.  thank you!

I am rejecting this response because:Patrick called from dealer on Wednesday, July 15. He said if I sent an email before 5:00pm to request my refund, he would mail my check that day. I sent the email and he should've sent the check. I've been inconvenienced enough. I live in Southern Maryland I'm not traveling to Dumfries, VA.

It states in our contract that : Covered Parts will be made with original equipment manufacturer parts, re manufactured parts, non-OEM, or used parts, at the choice of the Administrator, Diamond Warranty Corp. (under definitions on page 2)It also states:  Labor Rate: Repair time shall be based...

on All Data standard flat rate time. The hourly labor rate to be paid on this Agreement shall be determined by the Administrator unless extended labor rate has been chosen. Any additional cost incurred for hourly labor rate or time charges beyond the labor rate and repair time approved by the Administrator at the time of a covered component failure shall be the sole responsibility of the Agreement Holder. (page 3 #8)We will allow the customer to cancel the contract.  All they have to do is contact the selling dealership.

As stated on the contract, unless the cancellation is requested within the first 30 days, the vehicle must be repossessed, stolen or totalled in order to cancel this agreement.  I apologize if the customer could not get in touch with anyone, but the office and phone lines are open from 8:30 to...

5:00 Mon-Fri.  The customer called here and spoke with Denise, who advised the customer the same thing I am advising in this response.  He advised that he wanted to cancel because he couldn't get in touch with anyone, although he ended up speaking with someone about the cancellation.  There are some instances when everyone may be on the phone, but if a message is left, the call gets promptly returned.  The customer also indicated that purchased another warranty through someone else for the same vehicle so the customer may be trying to get something back to help defray the cost of his most recent warranty purchase.

I am rejecting this response because: No other warranty company in VA ([redacted], etc.) has statements within their extended warranty policy which reads that a car must be a total loss or repossessed in order for the policy owner to cancel his/her warranty. I personally feel like Diamond Warranty Corporation has entered language into their warranties to keep individuals locked into their service regardless to their service no longer being needed. Who would waste $1995.00 on a 5yr/100,000 mile warranty that was only active for 1 out of 5 years. It's entrapment by their company and it's not fair to us, the consumers. This needs to be researched and an action plan needs to be put into place to avoid second hand greedy warranty companies like this one from taking advantage of customers and their hard earned money. Yes all of us (customers) want to know that our cars are protected, but most importantly, we want to know that we're not being taken advantage of by greedy/sneaky companies with entrapment language embedded within their contracts. Again, no other extended warranty company in the state or surrounding states has this tricky entrapment language within their warranty contracts. Pleas look deeper into this matter so that this doesn't happen to anyone else in VA/DC/MD. I would really like to get some of my money back from Diamond Warranty Corporation for the 4 years of the warranty that will never be used, especially since I no longer own the vehicle.

The
vent valve that is part of the valve cover is not an internally
lubricated component withing the engine block.  As stated in the
contract, the failure must be an internally lubricated part.  This is
noted on the contract I attached under the Engine section in both the
Powertrain section and the Elite Plus section.

Diamond Warranty will be issuing a pro rated refund back to the dealership and the dealership will forward a check to [redacted].  Being that we receive payments from the dealer and not the consumer directly, we refund the entity that pays us.

We paid the shop for the drive shaft and the labor.  We were able to get the part for $280.  We offered to ship the part into the shop so the customer wouldn't have to come out of pocket and they refused.  There was only 0.7 hours of labor time required to make the repair so we would...

not be able to pay for a rental.  Our rental reimbursement policy requires at least 10 or more labor hours in order to qualify.  Lastly, there was no mention of other problems called in so the shop would need to open a claim for any future repairs.  It may be in the best interest of the customer to find a different shop to do the work.  We can assist in finding someone if they need help.  We cant pay $1200 for something that we can get for $280.  Thank you
