agree they don't have to sign the lease, that is called common sense. I have never withheld a deposit unless a lease is broken or damage has occurred to the property, being filthy and leaving it that way is considered damage. The lease requires the rent to be paid on a required date, which he never met and was never charged a late fee. He never fulfilled any of the maintenance requirements of his lease and was utility abusive.He was required to maintain the hot tub, the front lawn, and take his trash bin to the curb. The other renters took out his trash and complained to me.The hot tub filters had to be replaced and I had to rake, clean the hot tub,and trim the lawn twice during his tenancy. I couldn't even mow the lawn because he lent my mower to a friend that lived in another town. When he moved out I hired a day laborer to clean up 500 gallons of leaves from the lawn and driveway, and mow a lawn that hadn't been cut in over a year. That is just the outside-·of the· house~ the inside-was also left a filthy mess-for the new tenant-His-deposit will never be·refunded by me, and I will happily move back to Anchorage just to take him to court for late fees and court costs.
