David Gooding/Drei-Katzen Communications

Beginning in January 2012:
· Writer agrees to collaborate with Client and produce one complete, first draft of a 150-225 page book detailing Client's account of his Walmart event and lawsuit.

· Prior to writing book, Writer will present to Client an outline of the overall book's structure for discussion and approval.

· Prior to writing chapters, Writer will present to Client an outline of chapter content for approval.

· Writer will present suggestions to Client for new title.

· Upon completion of outline and first two chapters, a query letter will be completed and proposal will be developed for Client to attract attention of prospective literary agents.

· As they are developed and written, Writer will present Client with completed pages for approval.

· Writer agrees to have a complete, first draft of Client's account of Walmart story four months from the date above. If more time is required because the scope of the book changes, then Client and Writer agree to revisit terms of agreement.

Payment

Writer shall receive a total of $1275.00 (Twelve hundred seventy-five) dollars per month for writing/research/interview services, to be paid by the 15th of each month. The assignment is expected to be completed within four (4) months from the date above.

Ownership of Work

This work shall be considered made-for-hire under the United States Copyright Act and, at all stages of development, shall be and remain the sole and exclusive property of Client.

This agreement is effective on the above date entered into and will terminate upon satisfactory completion of agreed upon services. If Client is dissatisfied with the results and Writer fails to correct any deficiency, Client may terminate this agreement at any time without any further obligation to pay Writer.

After every excuse in the world, David Gooding has disappeared. I have had no communication with him since 2015. David Gooding successfully received $5100 from me, and I am a fool for falling in his trap. Apparently, he makes his living stealing.

Review: A Work For Hire Agreement was entered on January 17th, 2012 to David Gooding, dba DKC Drei-Katzen Communications for services which were set forth and out-lined in agreed contract, to wit the following: (1) Writer (David Gooding) agrees to produce and complete a first draft of 150-225 page book. (2) Prior to writing book, Gooding will present an outline of overall structure for approval. (3) Prior to writing chapters, Gooding will outline for approval. (4) Gooding will present suggestions for new title. (5) Upon completion of outline of first two chapters, query letter will be completed and proposal will be developed for literary agents. (6) Gooding agrees to have complete, first draft within four months, which would have been May 17th, 2012. (7) A fee of $5100 is paid to Gooding for above stated services. Two years after contract, fragments of work have been generated. No agreed work has been completed. I have heard everything from health problems to divorce proceedings as excuses. No contact has been made since Monday December 2, 2013, where Gooding states he will write on the upcoming weekend and get back with me. Haven't heard from him since. It has been one promise after another. We are headed into a third year of a four month contract.Desired Settlement: To avoid other costs by means of legal remedies, I am respectfully requesting a full refund for Breach of Contract.
