Review: We purchased our home in October 19,2013 with a one year warrantee.(enc 1) from Brookwood Partners,LLC. (enc 2) Immediately we noticed when it rains there are sections around the house where water leaks between the edge of the gutter and fascia board. Rainwater will blow into open windows and leaks into the garage.The bad part is we noticed some water in the window sill (actually, it was under a metal strip the window sets on), and a small piece of the window frame near the sill (the drywall section) was damp. When we told the contractor about this he said he would send the gutter sub.Shortly thereafter the sub came by and applied caulk and said the problem was the shingles were not extending over the edge of the roof. After the next rain we still had water coming through between the gutters and fascia in quite a few areas but the volume was not as much.The volume of water went down but we still had areas dripping on both sides of the house.I wondered why we were having such a problem with leaks as everything was brand new.I got out the ladder went up to take a look at one of the gutters.I could see that there was caulk running on the inside edge of the gutter the entire length of the house.I thought that it was proper to caulk the hangers where the gutter attached to the house,but I didn't know about going down the length of the entire gutter.I stopped in at [redacted] and asked if this was a usual installation procedure and was told that it sounded like someone was trying to cover up a bad job.I got almost an identical answer at the local [redacted]. Mr. [redacted],VA Codes Inspector also indicated a similar response. (enc 3).After researching the problem of water running behind the gutters online, it seems most of the time the trouble is with either how the shingles or drip edge are applied.My shingles do not overhang the drip edge at all so I think that is the cause of my problem.I could find no one that recommended using caulk to fix itSeveral people that said not to.Most of the suggestions centered on installing some type of flashing or apron to channel the water properly into the gutter.The contractor and I seem headed for a big dispute over this because I told him the caulk fix was not acceptable to me and he seems to think that if he can get enough caulk onto the gutters to stop most of the leaks he has done his job.I now have two 52 foot seamless gutters complete with a 52 foot long seam of caulk running down each one and rain still leaking between the gutter and facia.The contractor is unresponsive and told me I never heard such [redacted]. The contractor has been completely unresponsive and this is a very serious problem. He is just waiting for the year to be up so he can escape his responsibilitiesDesired Settlement: Repair

Brookwood Partners LLC August 1, 2013 In Response to ID# [redacted]. On 7/11/13, Homeowner called and said that there was water on his garage floor, supposedly the rain water was overflowing the gutters & entering garage. He also said the shingles were not hanging past the drip edge far enough for water to enter the gutters. I went to property and inspected Homeowner’s issue. On 7/17/13, I had the roofing contractor come to property and inspect issue. The original shingle was ¾” past the drip edge, enough to allow water to drain into gutter properly. The homeowner disagreed, so I had the roofing contractor install a new starter shingle to hang past the drip edge 1 ¼”. On 7/18/13, I had the Siding and Gutter contractor come to property and inspect issue. He installed a new down fall in the middle of the gutter on back of house. This adds more down fall volume to carry away storm water during heavy rain. On the front of the house, we increased the downfalls to a commercial size to allow more volume of water to empty out faster. Back on Nov. 10, 2012, Siding Contractor added a downfall to the right side of the garage because gutter was filling up & overflowing faster than one downfall could handle with amount of rain coming off roof. That was the first time the Homeowner called about a gutter problem and I did not hear from him again regarding a gutter issue till 1st of July, 2013. Also, of note, back in October 2012, when Homeowner purchased property, Homeowner had us remove a downfall at the front porch and move it around the corner 10’ away. I also sealed a crack between the concrete slab on the front porch and brick rowlock to stop water from going in on the garage floor. Homeowner states in his complaint, that rain water will blow in to open windows, this is something that has nothing to do with workmanship or material quality, as rain will enter an open window during a heavy rain or storm. Also, his complaint states that the caulk fix is not acceptable to him. The caulk used was a 25 year silicone that seals the top, back of the gutter to the metal fascia board. This stopped water from overflowing behind gutter and the additional downfalls were used to control water coming off roof during heavy rain. The Homeowner’s property is a well built home and the gutter issues were not the fault of “someone trying to cover up a bad job”. The gutter issues were not present during normal rain fall, only during heavy rains. The house is a ranch style house and has a large roof area, this means more downfall has to be used to accommodate the amount of water coming off roof. I have been very responsive to the Homeowner and have visited his property multiple times to help him. I have been in this business for over 30 years and I most certainly am not waiting for the year to be up to “escape my responsibilities” as Homeowner accuses. I want the Homeowner’s property to be in good working order and I have diligently worked to resolve the issue and I stand by my warranty and workmanship. I do not think that an employee from [redacted] or [redacted] can speak to the issue without seeing the specs and the Building Inspector mentioned, [redacted], was the local inspector from start to finish during the construction of property. Therefore, I submit that I have tried to resolve this matter with Homeowner and have pictures and a log of activity of my actions and responses, as I have outlined in this reply. At this time I feel as I have satisfactorily addressed the gutter discharge issue and the gutter system is in working order for the home. I am available to make adjustments to the gutter system as it applies to the warranty and have communicated clearly the solution as well as have completed the work. If the Homeowner chooses to get advice from others or another contractor to do the repair as he wants, then he will have to pay for it and it would void the existing warranty.
