Dear [redacted]:On June 30,2013, [redacted] retained this office to represent her in her Social Security Disability Case. Attached please find a copy of the Social Security Fee Agreement for [redacted].On July 5,2014, the Request for Reconsideration was filed....

On July 15,2013, this office faxed my appearance as counsel for [redacted] to the Social Security Administration. Attached please find a copy of the Fax Confirmation receipt.On July 25,2013, this office spoke with [redacted] and put together the Social Security Disability Intake.On September 14,2013, the Social Security Administration awarded [redacted] her benefits. Attached please find the Notice of Award from the Social Security Administration.On September 11,2013, the Social Security Administration sent a check to this office for $1097.69. Attached please find a copy of this check. On February 3,2014, the Social Security Administration sent a check to this office for $105.80. Attached please find a copy of this check.On July 21,2014, [redacted] called this office and claimed that the money that I received did not correlate to her Social Security Disability case. Rather, the money that I received correlated to her children’s Social Security Disability case. [redacted] then stated that this money that I received should be converted to payment of my fee for representing [redacted] in her desired Chapter 7 Bankruptcy.  I told [redacted] that this office would research the matter and let her know.  My assistant was given this task and she did have some difficulty speaking to an employee of the Social Security Administration Field Office located in [redacted], Maryland.On August 20, 2014, my assistant spoke with Ms. Bundy who informed her that the Social Security Disability benefit checks that [redacted] is receiving is for her Social Security Disability case rather than her children’s Social Security Disability case. In feet, Ms. Bundy told my assistant that she did not see any application for Social Security Disability Benefits on file. On August 20, 2014, this office sent an e-mail to [redacted] stating that “My assistant called the SSA Office (###-###-####) and spoke with [redacted] who confirmed that the payments that you are currently receiving are for you rather than your children ” [redacted] called this office shortly thereafter and I reiterated my message to her over the phone.First, I always returned [redacted]’s phone calls. I always had time to speak to her about her case. Her calls were never ignored. This first claim is simply not true.Second, I never denied receiving payment from the Social Security Administration for this case to [redacted]. The second claim is simply not true.Third, I did not receive a payment of more than $ 1500.00. I received two payments that amounted to somewhat substantially less than that. The third claim is simply not true.Fourth, I was only retained to represent [redacted] in her Social Security Disability case. I was never retained to represent [redacted]’s children in their alleged Social Security Disability case. In fact, it appears that no claim was ever even filed with regards to [redacted]’s children. The fourth claim is correct, in part.Fifth, this office did receive payment from the Social Security Disability case with regards to [redacted]’s claim. This office never received payment from the Social Security Disability case with regards to [redacted]’s children alleged claim. The Fifth claim is simply not true.Sixth, I did respond to [redacted]’s e-mail with an e-mail explaining what my assistant was told by the Social Security Administration. This e-mail also gave the name of the agent that my assistant spoke with and the phone number to the Social Security Field Office in [redacted], MD. Furthermore, I also gave her this information over the phone. The Sixth claim is simply not true.Seventh, I was very responsive to [redacted]’s phone calls and I always communicated with [redacted] in a respectful manner. Furthermore, the money that this office received from the Social Security Administration is allowed by law. While I am sorry to hear that [redacted] was not pleased with my service, I don’t believe that this office was deficient in any respect. [redacted] has come to the conclusion that the Social Security Disability benefit checks are for her children rather than for her. I am not sure how [redacted] came to this false conclusion. Regardless, the Social Security Administration has stated otherwise, Furthermore, there is some doubt that any claim was ever filed for her children.If you have any questions or concerns, please don’t hesitate to call this office.  Thank you.Sincerely,David I. Review: I am submitting this complaint because I cannot get any satisfaction from Mr. David I Steinberg. I have been trying to resolve an issue of monies that he received but was not entitled to. More than a year ago I went to Mr. Steinberg for his assistance with my disability claim (the appeal). After I obtained Mr. Steinberg to assist with my appeal suddenly he had no time for me, he became unable. However, so I would not miss the deadline for filling my appeal my sister completed the online process for me at my request. Although I had not heard from Mr. Steinberg before the need to complete my appeal I included his name as my attorney on the appeals form. Now that the appeal has been completed to reflect Mr. David I Steinbergs name we wait. After weeks/more than a month had passed I contacted Mr. Steinberg to check the status. Mr. Steinberg did not have the status he seemed disheveled. I explained that I completed the appeal online and I was wondering if he had made any contact with Social Security regarding my case and his response was that he had not. However, he would have his assistance make contact and follow up with me so I accepted that.Another a few months Mr. Steinberg and his assistance continued to ignore my telephone calls and message. After getting bushed off by them both for months and no response from Social Security I started to call Social Security myself. As a result of my telephone calls I finally received a letter I learned that I could not receive monthly Social Security payments or back pay for myself because at this point I was receiving long term disability from my former employer.At the same time, I learned that my 3 juvenile children however would receive Social Security and back pay. I also learned that although Mr. Steinberg told me that he had not obtained the status by placing telephone calls and he had not received anything from Social Security by mail he did in fact receive a payment of more than $1500.00I learned that the Mr. Steinberg received a payment from my childrens back pay and that is the payment he was not entitled to. My childrens case was total separate from my case and Mr. Steinberg was not involved in that case at all. A meeting was scheduled and took place (my sister attended) with Mr. Steinberg and he informed me at that time (although I had already known) that he was representing my children that I Detrina Marshall was his only client. He was not involved with anything dealing with my children. Mr. Steinberg did nothing to help me with my Social Security case and again he was not involved/representing my children AT ALL. However, a part of their back payment was paid out to him. Mr. Steinberg. He received the payment although he know I would not receive a monthly payment and, or back pay. The week of August 18, 2014 after making several calls and leaving several message I finally received a call back from Mr. Steinberg and he informed that that he was able to get in touch with someone at Social Security and he was told that the money he received was from my case. He and I both know that is not true because I did not receive any money from/for my case. To put this issue to rest, I asked for that information in writing to be sent to me via e-mail. However as of August 22, 2014 Mr. Steinberg has not sent me that information via e-mail. Mr. Steinberg is fully aware that he did not handle a case for my children and he was not entitled to any back pay and, or payment of any kind as it relate to my children so I am requesting that all the money he received from my childrens pay is turned over to me.I have also tried to address this issue with Maya Barman who is the assistant to Mr. Steinberg and I have not been successful. She has failed to return my calls as well and, or address my concerns as it relates to most recent need to contact Mr. Steinberg and, or the matter that I discuss in this letter.Lastly, this letter does not provide all the details of my poor experiences with Mr. Steinberg and is office. If I shared with you every detail of every unpleasant incident I would be writing all day. This letter/complaint is being sent because I am not pleased with the level of service he has provided. He is not responsive to my calls and messages. He does communicate without being sarcastic (if he communicates at all), he has abruptly ended calls and he did nothing to assist me with my Social Security appeal and most importantly he has received and accepted money he was not entitled to.
