Draw #4 was due, there were several items that...

needed corrections, that where being scheduled.   There was work completed that was part of the next draw, of a greater value than the items to be corrected.   When The [redacted]’s refused to release the 4th draw,  I had to make the business decision to stop work on their home until the draw was released.  They release the draw,  the bank inspector was on vacation this delayed it another week.I attached change orders #4 and 5 these where large changes to the home that where requested after construction began therefore creating delays.   The [redacted]’s have released the draw and the bank has paid the draw.   Sub-contractors are being scheduled to finish the home.Sincerely Yours.Merle L. I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
There seems to be a bit of confusion over the source of the delay on our home.  The two change orders referenced by Mr. Heckman were never any cause of a delay.  The change order referencing the finished bonus room was initiated when framing and subfloor were taking place and was paid to David James out of our pocket in January.  The other change order including the brick was initiated because our prints did not include steps, the VP of construction informed us we needed more brick to get to the sill line, and we wanted brick and stone on some exterior places.  Again, this was paid out of pocket by us and did not cause the delay on our home.  What caused the delay is David James requested money for work that had NOT been completed.   We did not approve this request until the work was completed.   This took a month and David James halted all other work on the home during this time. This delay happened well after the bonus room and the brick.  The cause of rhe delay and the source of our everyday frustration is very poor workmanship.  As for contractors at the house now, this is quite a stretch as there really hasn't  been much work done since this episode.  We bring up issues to our project manager and they do not get addressed.   It is actually too many issues to put into this reply.  I am disheartened to think that the reply to our complaint from this company is to replace the blame and ignore the real issue of very poor customer service.

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.We do not accept the response by David James Homes.  Obviously he builds to minimum standards instead of doing what is right by the customer.  I thought we had chosen a reputable builder that cared about customer satisfaction but obviously not.  This response does nothing to change the fact that the deck board spacing is inconsistent and looks terrible or that the screws come out and we have lose boards.  It does nothing to resolve the issue of uneven boards or that the railing was installed crooked.  His response does nothing to fix the nails coming through the railing on the screen porch.  And, I don't care if the lumber is grade 1 or not, it stills looks terrible.  I am disappointed with this response.  I have pictures also that support our complaints but will save those in case we decide to bring legal action.

Compliant Number [redacted].Attached are pictures taken last week of the [redacted] Deck.   The Deck is built to code using #1 materials.   There has been no maintenance on the pressure treated materials.  The spacing of the Evergrain deck floor boards calls for a minimum of 1/8” spacing,  No reference to maximum spacing.  The Deck and Screen porch have been built to code, inspected by the county.At this time there are no deficiencies in the deck that would be covered by David James Homes Warranty.  Workmanship or Craftsmanship.[redacted]

Review: We have been living in our David James Home for 28 months. We are very dissatisfied with the way our deck was installed. The spacing between the deck boards is uneven. There are wide spaces between some boards and then areas where there is hardly any spacing. The boards at the end of the deck were not cut evenly. The railing at the end of the deck was not installed straight. Our screen porch is terrible. The spindles are warped and uneven. There are nails that have punched through the 2 X 4 into the porch area and is a safety issue. The deck boards of the porch have the same issue as the boards on the deck. Some of the wood still has bark showing even though it is supposed to be grade 1 lumber.Desired Settlement: We have written Mr. [redacted] a letter asking that the deck and screened porch be replaced. We want the boards to be installed properly with hidden fasteners so the spacing of the boards will be uniform. We would also like the railing to be installed properly at the end of the deck. To date, he has not responded to this request.

Customer complaint #[redacted], [redacted]Attached is a copy of the purchase of deck materials showing the materials were of #1 quality and an e-mail from the supplier indicating “We are selective on the quality”Statement from Care and Maintenance for pressure treated lumber – “Since the characteristics shown below are natural wood, they are not warranted against such occurrences Here are examples of what can happen.SHRINKAGE As wood dries you can expect some slight shrinkage in both width and length to occur. As wood is exposed to alternating cycles of wetting and drying some checking and splitting may be expected. Wood may bow, crook, cup or twist in varying degrees depending on stresses released by initial sawing of the lumber and moisture absorption. Ms. [redacted] states we used a poor quality of lumber. The attached invoice and statement indicate we use #1 quality lumber. As in the statements above Pressure Treated lumber is susceptible to shrinking, splitting, warping and twisting, due to the character of the material can’t be warranted.RegardsMerle [redacted]President David James Homes

For your reference, details of the offer I reviewed appear below.I do not accept this response because he did not address all the problems that were cited in the complaint. He only cited the grade of lumber which wasn't in the complaint. He did not address the poor installation of the composite boards of our deck which should be included in the 5 year workmanship warranty. He made no mention of the uneven way the boards were cut at the end of the deck nor the fact that the railing was installed uneven.

I am an owner of a new home that David James Homes built last year(from Aug. 2014 to Aug. 2015). I moved in this house on Aug, and I found leaking basement spots on Sep. so I asked DJH(David James Homes to repair leaking basement.

BUT,

DJH just sent guys to look at leaking spots on the basements, and guys just come and see them, but they did not anything to resolve problems. I have poor English because I am a foreigner. So I sent e-mail and photos about problems spots. I have called and have sent e-mails more than 10 times to ask repair leaking basement for 6 months.

It is 9:52pm. on Wed. 24th of Feb. It is raining with wind, also it is leaking on the basement a lot too. They have not done practical anything to repair leaking basement.

There are 3 leaking spots on the basement. These are all under the windows. I can find leaking spots whenever it rains with wind.

Do them build your Dream HOME and it will not only leak on the basement but they will also do nothing after building finished.

Review: SMe and my wife handed a house Drawing to Mr.[redacted] the Sales Consultant. And ask if they can builed this house even though it was not one off there models. And we was told they could but it would take $1000 dollars to make the blueprints. Well they could never get it right when we check the check drawing that was 8 1/2" by 11" paper. The one thing we needed to do was stay in budget. But the coast keep going up so we told Mr. [redacted] that we can not afford that coast and that the check prints did not match the house we gave them. So I ask for my $1000 dollars back and sorry that it did not work out. I was told that we would not get are money back. WE never recived the drawings,or the Engineering,or the Material Lists that was what we was being charged for. I'm a disabled man that got took for a $1000 dollars. So I well have to take them to court to get my money back nothing was singed by David James Homes. At the bottom of my check in writing has Design Fee but we never could agree on any of there check drawings they just could not get it right. They tried to make one of there homes work to the one we gave them. When we ask them if they could do it all they had to say was yes we could or no we can't do it that's all. I feel we was miss lead and are out a $1000 dollars I just don't get it. Way a big company would need to take my money. And I well not let them get away with it.Desired Settlement: Just give me my $1000 dollars back because I have nothing from David James Homes to show for it they know it and I know it and the court well know it to I am talking to my lawyer now about it.
