Thank you for your recent letter and the opportunity to give some additional information about the refund policy and this particular situationBelow is detailed the following:* Our cancellation policy is made clear at the top of "Important Information" on the tournament homepage.*Registrants are
responsible for reading the important information before registering and deciding if they wish to register after reading that information.*Although credits are recommended, Tournament Directors are not required by the USTA to issue refunds or credits.*Many players use their credit quickly and easily, and David Lemair Tennis offers over opportunites for credits to be used.*David Lemair Tennis pays to use FCPA Tennis Courts.*Although grievant indicated he would not be able to use the credit as his son is no longer playing, he has played tournaments since our conversation.*There is no mechanism for Tournament Directors to refuse credit cards.I did speak with the grievant on the phone at length earlier this monthAt on point, he was yelling at me so loudly that my child was sitting next to me heard what he was sayingAfter a few minutes went byI started a sentence with"if you continue to yell at me", and he yelled "Yes, I am yelling at you!" Finally, I told the grievant that we were not getting anywhere and that if he continued to yellI would need to hang up.When we applied for sanction for this tournament, the following note was listed first under important information on the tournament homepage:"This is an outdoor tournamentAs long as the temperatures are degrees or above for a decent part of the day, we will play! if the tournament cannot be played on this weekend due to rain or cold, a credit will be issued that can be used for any David Lemair Tournament in 2017."This note is now at the bottom of a list of communication we posted the weekend of the tournament, but remained the only note at the top until after registrationWe work very hard to be extremely clear with everyone about what to expect, regardless of the situation.Tournament Website:http://***

I am rejecting this response because:While we are glad to hear Lemair actually pays to utilize a public facility, the "business" remains unscrupulous and anti-consumer with regards to it's lack of any refund policy for kids and their families regardless of any anecdotal information Ms. Lemairs contends. Anecdotally, Ms. L[redacted] began raising her voice at me and instigated the entire unpleasant conversation herself with her intransigence and her business' staunch anti-consumer stance which she continually justifies by going against established better business best practices and norms. If Lemair tennis bothered to benchmark any of this with other like businesses, they would understand just how out of touch Lemair is with their lack of ANY refund policy when no benefit accrues to the customer. In Lemair's inflexible world there is no customer service and the customer is always wrong. Amazing hubris from a semi-legitimate business operating in the public domain ostensibly for kids - when it's really all about the almighty dollar for the benefit of Ms. L[redacted]. That much is clear as Lemair is seemingly and shockingly unwilling to even attempt to offer compromise in any way.So we continue to reject this kind of bad business behavior and practice in which the benefit only goes in one direction - to this inflexible and anti-consumer/customer "business" and again request a refund of $65.00. Of course, it's not a lot of money but the principal as we've also heard from numerous other parents since this experience that Lemair is a terrible organization to deal with and that they've had the exact same bad experience - and just written off the money. Thus, we continue to fight today on behalf of all the families who are out money for their own kids - FOR THE KIDS - and have just given up dealing with stubborn and anti-consumer Lemair tennis. Our collective hope is that the Revdex.com (which Ms. L[redacted] told me to "go ahead" and complain to) can fight on all our behalf to explain why this anti-kid, anti-consumer policy is unacceptable despite all the legal fine print and disclaimers they have so carefully crafted. God bless America and the Revdex.com for advocating on our behalf against these unscrupulous actors disguised as legitimate players benefitting families but in reality taking full advantage of kids and those same families.Regards,[redacted]
